Absent: GUERBER. A quorum is present. CONSENT AGENDA: ALL CONSENT AGENDA ITEMS ARE CONSIDERED ACTION ITEMS. ♦ Consent Agenda items are considered to be routine and are acted on with one motion. There will be no separate discussion on these items unless the Chairman, a Commissioner, member of City Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in a sequence detennined by the Rules of Order. ♦ Any item on the Consent Agenda that contains written recommendations from the City of Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda approval motion unless specifically stated otherwise. A. Minutes of October 18, 2021. Discussion amongst the Commission. McLaughlin moves to approve the consent agenda as presented. Seconded by McCauley. ALL AYES... MOTION CARRIES. 4. UNFINISHED BUSINESS: NONE. PUBLIC HEARINGS: ALL PUBLIC HEARING ITEMS ARE CONSIDERED ACTION ITEMS. Commissioner Smith makes a motion to remove item 5A from tonight's agenda for the following reasons: "First, I received a packet like everybody else and I'm making the assumption that everything I read in the packet is true. So making this statement about this Benari application my intent is not to be disrespectful or disruptive, but I do intend to be combative. In all the time that I have served in this position I have never ever asked for any such thing previously until tonight. So if I am out of bounds, in violations of the City's trust in me, denying the developer any rights or if my request is inappropriate, I ask forgiveness and I'll resign if I have to. So I want you to know that the traffic study that was commissioned for the applicant by GE Engineering was a thorough job in terms of gathering data, all hundred and thirty five pages of it, that makes three traffic studies in all. ACHD, ITD, and GE Engineering. Now without exaggeration I did review that report until my eyes ached. And read a great deal but I did not understand very much. Now that may be my fault, but if the goal was to educate, I fear it intended to exasperate. The vastness of the report is overwhelming. It is difficult to read, the data presentation is in many cases mediocre and in most cases too difficult to read without using a magnifying glass. Examples of this kind are found on pages 37-45. Now I know that in the spirit of transparency the whole study was included but I truly found it to be an example of death by data. I struggled to find a summary and a meaningful conclusion. I wonder if this was shared with the neighbors of the proposed development. However, Mr. Terry Hall and Ms. Merrilou Terpenning referred to the study on page 257 of this packet, so maybe they did see it. Not only this report, but the disappointing behavior of the all powerful ACHD puts this entire application at risk for not receiving my quote "recommendation for approval" quote vote. However, I am only one of four commissioners in this meeting. Now from the packet I read on page 250: ACHD indicated in a meeting with Pine Ranch residents that they cannot modify any details related to access, as the report has already Page 1 of 6 KAP&Z\MINUTES\Temporary Minutes Work Area\PZ-11-01-21min.doc been submitted to the City of Eagle. And that determinations of the submitted development application and plan by Eagle Planning and Zoning and or the City Council is the only mechanism by which the access plan can be modified. This is a letter from Pine Ranch Subdivision: So, I was just curious when it was Pine Ranch inquired of ACHD, so I made a note in the margin simply saying, when? Then it goes on to say that a copy of the report was requested on April 9, 2021, and we were informed that we would receive a copy when it was completed. It did not arrive until October 6, 2021, which was after the 10-day period for comments. ACHD approved the applicant's proposal, that a stub be placed approximately 600 ft from the property line, with a sign to indicate that this road be extended in the future. City Attorney Villegas interjects making judicial correction regarding Commissioner Smith's statements and Commission hearing legal procedures. Villegas states that Commissioner Smith's comments are legally improper and are introducing bias prior to hearing applicant overview and presentation. Villegas asks Commissioner Smith to "wrap it up" or recuse himself. Ensuring the applicant has the right to present their application. Commissioner Smith: I will close then with my last statement, which should not be controversial. To that end I believe the proposal to be flawed because: the people who are surrounded by this project were not served by ACHD, did not get the chance to respond to it, and the approval was made without their input. And with that I'll stop. And, it may well be that I should probably recuse myself, because I will tell you when I started to read it and saw the comments of people involved, 41 pages of it, I thought: this cannot be correct Is there something flawed about this. So, I will stand corrected, and I will stand down. Thank you. And, I will recuse myself. City Planner, Mike Williams, requests that item 5B be moved in place of item 5A regarding tonight's agenda. A.&ACTION ITEM: A-02-21/RZ-02-21/RZ-23-07 MOD3 & PP-03-21 — Terra View Subdivision — Terra View LLC: Terra View LLC, represented by Dave Sterling with T-O Engineers, is requesting annexation and rezone from RUT (Rural -Urban Transition — Ada County designation) to MU-DA (Mixed Use with a development agreement [in lieu of a PUD]) for approximately 44-acres, a development agreement modification, and preliminary plat approvals for Terra View Subdivision, a 460-lot (396-single family residential, 4- commercial [may allow up to 192-multi-family residential units], 60-common) mixed use subdivision.
