Minutes - 1986 - City Council - 09/09/1986 - RegularPa~e 30 CITY COUNCIL MEETING September 9, 1986 The City Council met in regular session at the Eagle Primary School on Tuesday, September 9, 1986, at 7:30 p.m. MAYOR CAROL HALEY presiding. Roll call showed the following members present: MAILE, GUERBER, MINOW, MATLOCK. Motion made by MAILE to approve the minutes of the August 12, 1986 meeting with the exception on page 3, paragraph 1, Design Review in which MAILE cast a NAY vote. Also the exception noted on page 3, paragraph 2, Budget in which.MATLOCK cast a NAY vote. Motion seconded by MATLOCK. ALL AYE: motion carried. Motion made by GUERBER to approve the minutes of the August 25, 1986 meeting, Budget Hearing. ~otion seconded by MATLOCK. ALL AYE: motion carried. Motion made by MAILE that in accordance with the provisions of Idaho Code, Section 50-90 that itbe m~%edthat the rule requiring ordinances to be read on three different days be dispensed with and that ORDINANCE # 110 be considered immediately. Motion seconded by GUERBER. ALL AYE: ~otion carried. Motion made by MAILE to adopt ORDINANCE ~ll0,Annexin~ %he S&H property and designating zoning to be Agricultural. Motion seconded by GUERBER. ALL AYE: motion carried. Motion made by GUERBER that in accordance with the provisions of Idaho Code, Section 50-90 that it be moved that the rule requiring ordinances to be read on three different days be dispensed with and that ORDINANCE #111 be considered immediately. Motion seconded by MATLOCK. ALL AYE: motion carried. Motion made by GUERBER to adopt ORDINANCE #111, Annexing the Holgate/ Renauld property and designating zoning to be R-5 and C-3. Motion seconded by MINOW. Discussion by ~ILE regarding the separation of legal deScrip- tion of zones. MAILE called for the question. ALL AYE: motion carried. ALL AYE: Motion made by MAILE to adopt Resolution 5-86, amendments to the Eagle Comprehensive Plan. Motion seconded by GUERBER. AYE: motion carried. ALL PUBLIC HEARING: BANBURY. Application by Hoff's Co. Inc.,located at N.W. corner of Eagle Rd. and Chinden Blvd. Thomas Wright is representing the property ownerS. Public Hearing opened at 8:00 p.m. Public Hearing closed at at 8:02 p.m. NO testimony given in opposition. GUERBER questioned the consideration given to the possible move by Banbury into the Eagle Fire Dist. Tom Wright indicated that Banbury would not have any objec~2ion to that puoposal. MATLOCK moved that the Banbury property be annexed to the City of Eaqle and that it be zoned R-5. Motion seconded by MINOW. Roll call on the motion resulted as follows: AYE: MAILE, GUERBER, MATLOCK, GUERBER. Motion carried. APPOINTMENTS: Planning and Zoning Commission. Daryl Watson Motion made by MAILE to approve the appointment of Daryl Watson to the Planning and Zoni~ng Commission, pursuant to the appointment request of Mayor CAROL HALEY. Motion seconded by GUERBER. ALL AYE: motion carried. Second appointment of Thomas R. Eason, Jr. moved by GUERBER to be accepted to the Planning and Zoning Commission. Motion seconded by MINOW. ALL AYE: motion carried. APPOINTMENTS: Design Review Committee: Karen Kreps and Wayne Crosby. Motion made by GUERBER to appoint Karen Kreps and Wayne Crosby to the Design Review Committee. Motion seconded by MATLOCK. ALL AYE: motion carried. The third appointment, Ada Costanza to the Library Board: Motion made by MAILE, seconded by GUERBER. ALL AYE: motion carried. WOOD BURNING: GUERBER designated to draw up a resolution in favor of voluntary compliance with wood burning problems. Moved by MATLOCK to approve the claims against the city.
