Minutes - 1986 - City Council - 04/08/1986 - RegularPageil CITY OF EAGLE COUNCIL MINUTES April 8, 1986 The City Council met in regular' session at the Eagle City Hall, on Tuesday, April 8, 1986, at 7:30 p.m. Mayo~ CAROL HALEY absent, TOM MAILE, President of Council presiding. Roll call showed the following members present: MAILE, GUERBER, MINOW. Councilman MATLOCK excused. Motion made by MINOW to approve the minutes of the March 11, 1986 council meeting. Motion seconded by GUERBER. Discussion followed and MINOW withdrew the motion. New motion made by MINOW that modification to the paragraph relating to the Banbury letter to the Ada County Commissioners be modified to state that a letter was to be directed to the Ada County Commissioners indicating why they had approved the Banbury subdivision without notification or over the objections of the previous Eagle City Council. (page 3, paragrah 2, of the minutes of March 11, 1986) Motion seconded by GUERBER. ALL AYE: Motion carried. Motion made by GUERBER and seconded by MINOW to accept the minutes of the special meeting of March 25, 1986 as printed. ALL AYE: Motion carried. Discussion FABCO: Letter of complaint from Deborah Finley read to council. Mrs. Finley's letter indicated that a residential dwelling was converted into an office. She was advised that the property in question is zoned residential, that a Fabco sign had been placed on the front of the dwelling, and the lawn had been removed to provide parking area. Mrs. Finley feels that this is a misuse of property and that the values of the neighborhood property will decrease as a result of Fabco's actions. Mr. Les Cullen arrived 'and further discussion took place regarding the possibility of the property in question being zoned commercial or residential. Mr. Cullen was advised of the complaint. Mr. Cullen stated that he had removed a sign that had been placed on the property. He was advised that the signs would have to go through Design Review. Motion made by MAILE that a letter from c~ty hall be directed to Mr. Cullen requesting him to bring to city hall a legal description of the property to make sure the area is within our commercial district. The motion further directs the city clerk to provide Mr. Cullen with a copy of the complaint so that he can see the nature of the complaint against him. Motion seconded by GUERBER. Roll call vote resulted as follows: AAL AYE: MAILE, GUERBER, MINOW. Motion carried. SOUTHWEST PRIVATE INDUSTRY COUNCIL discussion resulted in a motion by MINOW that we are interested in the. youth program offered by Southwest Private Industry Council and that we post for the job of supervisor and see if we have any people interested. Motion seconded by GUERBER. MAILE called for the question. ROLL CALL resulted as follows: AYE: MAILE, GUERBER, MINOW. Motion carried. Page 12 their COMMITTEE REPORTS: Parks: Chemlawn contract accepted for both parks. Company from Middleton is going to do preliminary work to clean up the park. Getting repair work on water system. It was suggested that if we do hire youth we will have to buy or rent equipment for lawn care. APA: Nothing pertaining to Eagle. LIBRARY: No news to report D.C. WEAVER Annexation discussion: Motion made ~y GUERBER to allow the annexation procedures on this piece of property to start. Motion seconded by MINOW. ALL AYE: MAILE, GUERBER, MINOW. Motion carried. Discussion BANBURY: Speakers: Tom Wright, Harvey Hoff and LaRue Bevington. Presented was phase 1 of the project. It was stated that the subdivision would have it's own septic tank system. The subdivision is located at Eagle Road and Chinden Blvd. and consists of 520 acres, 225 lots plated at 1.7 of an acre. Ada County zoned that area R-8. MAILE made a ~otion that we direct a letter to Ada County saying, in no uncertain terms, that we object to'how they handle the acceptance of the application of banbury. Just as Ada County objected to Eagle's Comprehensive plan to preserve ~a~ rights with any disagreement with Ad~ Eagle C~n~ that we tell them Council objects to the way that was done because it was done in violation of the Eagle Impact Agreement and of the comprehensive plan. It is up to the City of Eagle to consider the extent of this proposal and development and it is within the city impact area and is a ~city decision, not a county ~decision. VALLEY NEWS: ~GUERBER made a motion that we prepare an ordinance to designate Valley News Times as Eagle's legal Publication. Motion seconded by MIN©W. MAILE called for the question. Roll call vote resulted as follows: AYE:. MAILE, GUERBER, MINOW. Motion carried. DESIGN REVIEW: Baird Oil/Dennis Baird. Change of window size in Go-Fer Mart on State Street. Motion made by MINOW to approve the change as presented in the design review application and as has already been done. MAILE seconded the motion. Roll call resulted as follows: AYE: MAILE, GUERBER, MINOW. Motion carried. ADA COUNTY TRANSMITTAL 85-10-CU: Temporary living quarters on lot 3, Los Luceros acres subdivision. Motion made by GUERBER to approve the conditional use permit so long as the approval does not conflict in any way with the restrictive covenants and provisions that may apply to Los Luceros subdivision, and furthermore that this conditional use permit be for no more than two years. Motion seconded by MINOW. MAILE called for the question. Roll Call vote resulted as follows: AYE: MAILE, GUERBER, MINOW. Motion paqe ].3 carried. ADA COUNTY T~ANSMITTAL 85-13~CU: A trout fishing Pond. Motion made by MAILE to approve the conditional use permit as presented. Motion seconded by MINOW. Roll call vote resulted as follows: AYE: MAILE, GUERBER, MINOW. RESOLUTION 3-86, Accepting Ownership of Park read into the minutes. Motion made by MAILE to adopt the resolution. Motion seconded by GUERBER. MAILE called for the question. Roll call vote resulted as follows: AYE: MAILE, GUERBER, MINOW. Motion carried. CLAIMS AGAINST THE CITY: Motion made by MAILE to approve as presented. Motion seconded by GUERBER. Roll call vote resulted as follows: AYE: MAILE, GUERBER, MINOW. Motion carried. RIVERSTONE SUBDIVISION: Motion made by MAILE that this issue be calendared for the next EagLe City Agenda and if in the mean- time the year is run we will waive that so we can have full consideration. Motion seconded by GUERBER. MAILE called for the question. Roll Call vote resulted as follows: AYE~ MAILE, GUERBER, MINOW. Motion carried.
