COUNCIL }{INUTES
March 11, 1986
The Council met in regular session at the Eagle
City Hall, on Tuesday, March 11, 1986', at 7:30 p.m.
MAYOR CAROL HALEY presiding.
Roll Call showed the following members present:
MAILE, GUERBER, MATLOCK & MINOW.
Motion made by GUERBER to approve the minutes of
the February 11, 1986 meeting as printed. Motion seconded
by MATLOCK. ALL AYE: Motion carried.
COMMITTEE REPORTS: MINOW: A.P.A., most of the APA meeting
was devoted to budget problems, no real decisions.
GUERBER: Parks, we ar~ in the process of obtaining a bid
on the new park from Permagreen. Chemlawn is contracted
on the Hillside Park, we can made a decision when the bid
comes in. He is in the process of checking into landscaping
the park which should make it easier to mow and take care of.
MAILE: Library, the Library Board has expressed concerns
regarding the Library District and that the board expects
to .hire a part time employee for the library which is contingent
to funds from the district. MATLOCK: Planning and Zoning
report will be included in the discussion with members of
Planning and Zoning attending the meeting tonight. MAYOR
HALEY reported on Air Quality, Ore-Ida Bike Challenge, a
bike ride starting in Emmett and passing through Eagle. It
was suggested that we work with the Business Men's Association
to aid the bike riders and obtain publicity of the City. BFI
is looking toward the spring clean up in May.
GUERBER initiated a discussion regarding the Air Stream
Convention coming up and that he understands that there is
a need for parking locations for self-contained motor homes
prior to the convention. He suggested that he will contact
Boise Chamber of Commerce and the Convention Center to see
where the needs are in order to see if Eagle can assist with
the parking probl.em.
MERIDIAN SCHOOL DISTRICT, NICK HALLETT, SUPERINTENDENT:
Discussion regarding the new school, and the effect on Eagle
students, enrollment, and future schools. There is a question
as to the boundar~s are that determine where students go to
school. Mr. Hallatt indicated that that question would be
on the agenda of the School board in the fall of 1986 and that
we should have a representative at that meeting to express
the desires of the people of Eagle on that issue. He suggested
that council write the board expressing their desires also.

Motion made by GUERBER that a l'etter be drafted and sent
to the Meridian School Board indicating that this community
and the Eagle City Council are interested in seeing that as the
boundaries are drawn that the students from the!Eagle area
attend the school which would be the mos% geographically ~,
convenient. Motion seconded by MATLOCK. ALL AYE: Motion
carried.
EAGLE SENIOR CITIZENS BLOCK GRANT: MAYOR HALEY advised
council of our quest for a block grant for this project and
of the public hearing meeting scheduled for March 25, 1986.
Motion made the MAILE to pursue the steps to obtain the
block grant. The motion was seconded by MINOW. ALL AYE:
Motion carried.
PAT MONTGOMERY/HAZARD COUNTY GARAGE: discussion regarding
business problems and complaints. Mr. Montgomery will be
moving his business to Garden City. MAYOR HALEY indicated
that he would need to remove the remaining two car bodies
within a week.
PLANNING AND ZONING: Discussion regarding Ada County's
efforts in over-riding P&Z and Council decisions in regards
to Eagle Impact Area. Mr. Wilson sited a Ballantyne subdivision
that Eagle disapproved and Ada County subsequently approved.
The question of Banbury was brought up. GUERBER suggested that
this may have been ~approved prior to any Eagle Comphrehensive
Plan. Mr. Wilson askedif it would be possible for the city
attorney to check into ramifications involving Ada County's
ability to over-ride Eagle P&Z and Council decisions. MAYOR
HALEY brought up the fact that part of the problem may be that
our comprehensive plan has not been officially accepted by Ada
County. Mr. Vogt noted that on May 29, 1985, Ada County Transmittal
#85-10-CU Packard was presented at Planning and Zoning, there
was not a quorum and it went to council April9~hwith a resulting
decision to delay decision until after comphrehensive plan was
in effect. Ada County approved a conditional use permit under
rule #6.4-1.2 and 6.4-2.2, the point is that they did approve
this request without regard of council. The issue of Banbury
was brought into question, MAYOR HALEY suggested that the
representatives of Banbury speak to both P&Z and Council. That
this project would have to return to Eagle for approval for the
final plat, which would not be approved at this time, and that
she understood that Ada County was now advising business seeking
people in the impact area to start with Eagle prior to Ada County.
She further advised that it might be best that those inquiries
be sent to P&Z. MAYOR HALEYaskedcity Attorney, Pat Riceci to
check with Ada County Commissioners as to where we are in the
process of approval of the comphrehensive plan-and why the

decision was made to approve Banbury. MAYOR HALEY further
suggested that we ask Ada County to notify us on action
taken on those transmittals with which we have had input.
MAILE suggested that we also notify the applicant of action
taken on Ada County Transmittals as well as the county.
Mr. Wilson again brought up the question of the approval
of Banbury. It was suggested that the answer to that question
should be provided in the minutes of Ada County Commissioners
and that the City Clerk should call regarding that question.

Motion made to accept the claims against the city by
~ILE, seconded by ~TLOCK.

Motion made by MINOW to approve the minutes of the March
11, 1986 council meeting. Motion seconded by GUERBER. Discussion
followed and MINOW withdrew the motion. New motion made by MINOW
that modification to the paragraph relating to the Banbury letter
to the Ada County Commissioners be modified to state that a letter
was to be directed to the Ada County Commissioners indicating why
they had approved the Banbury subdivision without notification or
over the objections of the previous Eagle City Council. (page 3,
paragrah 2, of the minutes of March 11, 1986) Motion seconded by
GUERBER. ALL AYE: Motion carried.
