SPECIAL MEETING MINUTES OiN4 /December 3,2020
1. CALL TO ORDER: Mayor Pierce calls the meeting to order at 3:00 p.m.
2. ROLL CALL: Present: BAUN, GOLD, PITTMAN, PIKE. All present. A quorum is
present.
3. PLEDGE OF ALLEGIANCE:

5. PUBLIC COMMENT 1: The Eagle City Council is taking remote public comment via
Webex. Meeting login instructions are posted on https://www.cityofeagle.org/1698Nirtual-
Meetings. If you just want to watch the meeting, without giving comment, please watch our
livestream at https://www.cityofeagle.org/305/City-Agendas-Videos.
This time is reserved for the public to address their elected officials regarding concerns or comments they would
like to provide to the City Council regarding subjects not on the agenda. At times, the City Council may seek
comments/opinions regarding specific City matters during this allotted time.This is not the time slot to give formal
testimony on a public hearing matter, land use application,or comment on a pending application or proposal. Out
of courtesy for all who wish to speak, the City Council requests each speaker limit their comments to three (3)
minutes.

6. ADDITIONS,DELETIONS OR MODIFICATIONS TO THE AGENDA:

Pittman moves to place the City Attorney report following the other business items on the
agenda. Seconded by Pike. ALL AYE...MOTION CARRIES.
7. NEW BUSINESS:None
A. ACTION ITEMS Fleet Service Agreement: An agreement between Commercial Tire and the
City of Eagle to provide fleet services on City owned vehicles. (EZ)
Mayor Pierce introduces the item.
Public Works Director,Eric Ziegenfuss reviews the Request for Proposal process and recommends
the award of the service agreement to Commercial Tire.
Discussion.
Pittman moves to approve 7A Fleet Service Agreement. Seconded by Baun. BAUN AYE;
GOLD AYE; PITTMAN AYE;PIKE AYE. ALL AYE...MOTION CARRIES.
B. ACTION ITEM: Service Contract with Idaho Power: A contract between the City of Eagle
and Idaho Power for the installation of a single-phase line extension for power and fiber optics to
the modular buildings located in the City Hall parking lot. An amount not to exceed $35,755.
Funding will be provided through the CARES Act. (EZ)

C. ACTION ITEM: Service Proposal with Rocky Mountain Electric (RME): A service
proposal between the City of Eagle and RME to provide power for the modular buildings. An
amount not to exceed$5,465. Funding will be provided through the CARES Act.(EZ)
Mayor Pierce introduces the item.
Public Works Director,Eric Ziegenfuss reviews the service contract.
Baun moves to approve 7C Service Proposal with Rocky Mountain Electric. Seconded by
Pike. BAUN AYE; GOLD AYE; PITTMAN AYE; PIKE AYE. ALL AYE...MOTION
CARRIES.
D. ACTION ITEM.- Service Contract with Mark Guho Construction Company: A contract
between the City of Eagle and Mark Guho Construction(a certified asbestos removal company)to
provide services for the restoration of the Museum.An amount not to exceed$14,165.
Mayor Pierce introduces the item.
Public Works Director,Eric Ziegenfuss reviews the service contract.
Pittman poses questions regarding gutters and color match. Discussion.
Baun moves to approve 7D Service Contract with Mark Guho Construction Company.
Seconded by Pike. BAUN AYE; GOLD AYE; PITTMAN AYE; PIKE AYE. ALL
AYE...MOTION CARRIES.
E. ACTION ITEM Ordinance No. 838 (Monticello Estates Subdivision): An ordinance
annexing certain real property situated in the unincorporated area of Ada County, Idaho, and
contiguous to the corporate limits of the City of Eagle, to the City of Eagle, Idaho; changing the
zoning classification of said real property described herein from RUT(Rural-Urban Transition)to
R-3-DA (Residential with a development agreement); amending the zoning map of the City of
Eagle to reflect said change;directing that copies of this ordinance be filed as provided by law;and
providing an effective date.The 4.07-acre site is located at the southeast corner of North Park Lane
and West Floating Feather Road at 1232 North Park Lane. (MJW)
Mayor Pierce introduces the item.
Pittman moves,pursuant to Idaho Code,Section 50-902,that the rule requiring Ordinances
to be read on three different days with one reading to be in full be dispensed with,and that
Ordinance#838 be considered after being read once by title only. Seconded by Gold. ALL
AYE: MOTION CARRIES.
Pittman moves that Ordinance#838 be adopted. An ordinance annexing certain real

F. ACTION ITEMS Ordinance No. 839 (Martin Storage): An ordinance changing the zoning
classification of the real property described herein from A-R(Agricultural-Residential)to MU-DA
(Mixed Use with a development agreement); amending the zoning map of the City of Eagle to
reflect said change;and providing an effective date.The 7.3-acre site is located on to the south side
of West State Street approximately 400-feet west of the intersection of South Payette Way and
West State Street at 1601 West State Street. (MJW)
Mayor Pierce introduces the item.

G. ACTION ITEMS Request for Qualifications (RFO) for City-wide Facilities Master Plan:
The Fiscal Year 2021 Capital Plan set aside$100,000 for the development of a City-wide Facilities
Master Plan. Staff is requesting the Council's review and approval to release the RFQ. (NBS)
Mayor Pierce introduces the item.
Planner III,Nichole Baird Spencer reviews the request for qualification and seeks direction from
Council.
Baun discussions the option of request for proposal process vs request for qualification process in
order to potentially get better price point. Pittman would like to be ensured that the members of
the review committee will be disclosed. Baird-Spencer states that a resolution will be brought forth
identifying the members of the review Committee. Discussion.
Baun moves to approve 7G Request for Qualifications(RFQ)for City-wide Facilities Master
Plan amending to change to a Request for Proposal (RFP). Seconded by Pittman. ALL
AYE...MOTION CARRIES.
8. UNFINISHED BUSINESS:
A. Fiscal Impact Tool Training Session:Presentation by TischlerBise of the City of Eagle'Fiscal
Impact Tool. (NBS)
Mayor Pierce introduces the item.
Nichoel Baird Spencer introduces the representative from TischlerBise.
Colin McAweeney, with Tischler Bise reviews the fiscal impact tool that has been customized for
the City of Eagle.

9. City Attorney Report:
City Attorney Villegas discusses the purchasing policy and purchasing thresholds. Council asks
that the City Attorney work with Department Heads and bring forward suggested amendments to
the current policy.
Villegas also reports on the hearing petition for judicial review on the Molinari case that was filed
by the citizens. The court ruled from the bench denying both the developers and the City's request
for attorney's fees. The judge has taken the motion for reconsideration under advisement and will
issue a written decision
