Minutes - 1994 - City Council - 12/20/1994 - RegularEAGLE CITY COUNCIL MEETING December 20, 1994 Pre Council~ Jerome ~app presented the closing papers for the Downtown Redevelopment Grant. The m~ers of the senior citizen center asked him to approach Council regarding a request for a new grant in connection with the senior center. The grant would specify needs such as vestibules and light wiring changes, plus possibilities of a paved parking lot. The members wanted to include new carpet and floor refinishing; however, that cannot be part of the grant as it is aesthetic rather than a need. The state will allow up to $100,000 for a grant. The seniors have $20,000, in kind match, plus a donation for gravel for the parking lot from Lowes Gravel. The perking lot could be double bay parking if the street is vacated. The public hearing for the grant would have to take place in January. Mr. ~app will keep the Council informed. Charles Trainer presented a Transit Services Report from APA. APA would like the City of Eagle to appoint a 7 to 9 person task force from Eagle residents, business people, Chandler of Conunerce, etc. Homeowner associations should be involved also. He asked for authorization for a task force from the Council. The Mayor indicated that authorization had been received before, but right now additional consideration should extend to additional mend~ers. Mary Berent will work with different groups of people in order to get the task force started. BarbaraMontgom~rypresented a proposed amendment to the 1993 Eagle Com~rehensive Plan, information and statistics on schools. Mary Berent presented a proposal from Walt Wanner/Crandlemire regarding a proposed com~rehensive plan amendment to increase the land use density on the north side of Floating Feather Rd. in the Crandlemire location. Mr. Wanner would like to submit a preliminary plat for a subdivision et the same time as submitting the com~rehensive plan change. The Council did not agree with both being presented at the same time, but asked Mary Berent to contact Mr. Wanner regarding his proposed comprehensive plan changes. The Eagle City Council met in special session on December 20, 1994. Mayor GUERBER presiding. The following members were present: STAN BASTIAN, MORGAN MASNER. RICK YZAGUIRRE, THOMAS EASON, Moved by YZAGUIRRE and seconded by BASTIAN to approve the minutes of the November 22, 1994 meeting as presented. ALL AYE: MOTION CARRIED. Extension of Time/Impact Area Agreement Fall Creek Subdivision: Moved by BASTIAN and seconded by MASNER to approve the extension of time for one year. ALL AYE: MOTION CARRIED. Moved by YZAGUIRRE and seconded by BASTIAN to authorize the Mayor to execute the letter to the Ada County Commissioners to begin the renegotiation process regarding the Eagle Area of Impact Agreement in connection with the trade for Fall Creek property. ALL AYE: MOTION CARRIED. Design Review Bid: Dave Koga of the Land Group presented the bid to the Council. The bid includes the revision of the landscape and design review provisions of the code. The bid amount is Moved by MASNER and seconded by BASTIAN to accept the bid as presented as an initial step toward amending the code. ALL AYE: MOTION CARRIED. APPOINTMENTS: Mayor GUERBER asked for a continuation of the appointment until the next regular session. Moved by MASNER and seconded by EASON to continue the appointment until the next agenda. ALL AYE: MOTION CARRIED. Ada County Transmittal: 94-64-CU Boise City Cellular Partnership. Moved by YZAGUIRRE and seconded by EASON to approve the Ada County Transmittal 94-64-CU subject to the conditions of the notice and procedures requirement and landscaping. ALL AYE: MOTION CARRIED. Gibbons, Scott and Dean Audit proposal: seconded by EASON to approve the proposal Audit in the amount of $2,700. ALL AYE: Moved by BASTIAN and as presented for 94-95 MOTION CARRIED. Beer, Wine and Liquor License Renewals: Eagle Beverage, Eagle Flower Shop, Eagle Foodtown, Eagle Hills Golf Course, Eagle Uni-Merc, Circle K, Justo's, Chicago Connection, Arbor Bakery & Cafe, Bank Club, Bob's Trolley House, Gloria's Restaurant, Regal Eagle. Moved by BASTIAN and seconded by EASON to approve the license renewals as presented to subject to receiving all material appropriate to meet the state guidelines. ALL AYE: MOTION CARRIED. ORDINANCES-RESOLUTIONS: Moved by BASTIAN and seconded by YZAGUIRRE to dispense with the three day ruling and to consider Ordinance #254 at this time. ALL AYE: MOTION CARRIED. Moved by BASTIAN and seconded by YZAGUIRRE to adopt Ordinance 254, An Ordinance annexing the parcel of land known as "Van Engelen Estates #2" on State St. ALL AYE: MOTION CARRIED. Resolution 7-94 Support of State General Revenue Sharing to Cities, Counties & School Districts. Moved by YZAGUIRRE and seconded by EASON to approve the Resolution as presented. ALL AYE: MOTION CARRIED. Reports: MAYOR'S REPORT: YMCA project would like Eagle to commit $40,000 within the next 5 years to the project with an agreement that Eagle residents will not be subject to extra charges for aquatic privileges for out-of-city usage. The Mayor also reported on ITD activities regarding SH55. The IViayor asked that staff begin spring work for furnishing Friendship Park a picnic table and light. Tennis court lights operated by coins is an option for lighting on the tennis courts. Sewer: Masner reported on the activities of the sewer district and the Mormon Seminary location. Library: Negotiations/Ada County for approximately $7,000 are continuing. The board is looking for new carpet for the library. ATTORNEY'S REPORT: Mona Mack presented a letter that the Council might consider sending to ITD regarding the right-of-way for the SH55 realignment. The Mayor will review the letter and go over it with Mona prior to sending it to ITD. Mona also reported on progress with the Brighton case. CITY CLERK: Barbara Montgomery reported on information received from Larry Sale regarding the Ada County Highway Enhancement program. She presented some of the projects that might be included in a letter of request to ACHD and asked Council for input. CLAIMS AGAINST THE CITY: Moved by MASNER and seconded by BASTIAN to approve the claims as presented. ALL AYE: MOTION CARRIED. Moved by YZAGUIRRE and seconded by MASNER to go into executive session to discuss personnel. ALL AYE: MOTION CARRIED. The executive session adjourned at 9:40 p.m. and the regular session of Council reconvened.
