The Eagle City Council met in special session on November 1, 1994.
Mayor GUERBER presiding.
The following members were present:
MORGAN MASNER, TOM EASON
RICK YZAGUIRRE, STANBASTIAN,
PUBLIC HEARING/First Security Bank - Conditional Use Permit
Mayor GUERBER announced that this was the time and place set for a
public hearing on a CUP for a mobile home unit in a C2 District

Public hearing closed at 8:15 p.m.
Moved by MASNER and seconded by BASTIAN to approve the Conditional
Use Permit with the following conditions:
1. A chain link fence on the west side of the property
2. A plan be developed between First Security Bank and Justo's for
the landscaping and parking
First Security Bank will submit a new landscaping and parking plan.
Councilman YZAGUIRRE excused himself from further involvement.
AYE: EASON, BASTIAN, MASNER. Abstain: YZAGUIRRE. MOTION CARRIED.
UNFINISHED BUSINESS:
Findings of Fact and Conclusions of Law/Custom Masonry-Rezone.
Moved by BASTIAN and seconded by MASNER to approve the findings and
conclusions as presented. ALL AYE: MOTION CARRIED.
Moved by YZAGUIRRE and seconded by BASTIAN to add to the agenda the
ratification of the Agreement to Negotiate in Good Faith to the
agenda, and that the motion is in conformation to the Mayor's
earlier action placing the item on the a~enda.

ALL AYE: MOTION
Moved by MASNER and seconded by BASTIAN to authorize the Mayor to
execute the agreement. ALL AYE: MOTION CARRIED. Discussion:
BASTIAN questioned the water rates. Mayor GUERBER stated he will
bring the water rate issue back to the Council prior to any
decision on rates.
The Agreement calls for representation by Mayor GUERBER and an
alternate person. YZAGUIRRE volunteered to be the first
representative and MASNER the alternate. The City Attorney noted
that she should be involved as legal council providin~ the Eagle
United Water has legal representation present at the meeting.
