OCTOBER 11, 1994
Pre Council: Wayne Stollfus outlined the North Channel Center
project to Council. This will be a mixed use development
(residential, commercial & office use) project. Council had no
objections to the concept of the plan.
Mary Berent gave the P & Z report.
The Eagle City Council met in regular session on October 11, 1994.
Mayor GUERBER presiding.
The following members were present: RICK YZAGUIRRE,
BASTIAN, MORGAN MASNER Absent: THOMAS EASON
STAN
Moved by YZAGUIRRE and seconded by MASNER to approve the minutes of
the September 23, 1994 meeting as presented. ALL AYE: MOTION
CARRIED.
Moved by MASNER and seconded by BASTIAN to approve the minutes of
the September 27, 1994 meeting as presented. ALL AYE: MOTION
CARRIED.
PUBLIC HEARING/ORDINANCE #249 - Areas of Critical Concern.
Mayor GUERBER announced that this was the time and place set for a
public hearing on a proposed ordinance establishing the boundaries
of the areas of critical concern within the City of Eagle.
Public Testimony: none
Public Hearing closed at 7537 p.m.
After discussion by council it was decided to do a first reading of
Ordinance #249 by title only and have the second reading at the
next council meeting on October 25, 1994.
GOLF MAGIC: There was no representative from Golf Magic present
at the meeting. Moved by MASNER and seconded by YZAGUIRRE to grant
a 60 extension to Golf Magic to comply with the Eagle Landscape
Committee conditions of approval and to notify Golf Magic in
writing. ALL AYEs MOTION CARRIED.
EDGEWOOD ROAD IMPROVEMENTS: The Council agreed to leave the road
improvements as planned, if there is no major impact on Mr. Gilkey,
the property owner at 426 N. Edgewood Lane. Morgan Masner will
contact ACHD to set up a meeting time between Mr. Gilkey, an ACHD
representative and himself to come to Eagle and review Mr. Gilkey's
concern that ACHD's need to take 6 feet of his property.
URBAN STAGES TASK FORCE: Moved by MASNER and seconded by BASTIAN
to appoint Zeke Belanger, Carl Hiaring and Carl Wonacott to the
Urban Stages Task Force Committee. ALL AYE: MOTION CARRIED.
(TUSTOM MASONRY: Stanley Crowe, the attorney for Steve and Linda
Hiatt, dba Custom Masonry, was asked to address council regarding
the concern of the zoning decision made by Council at the September
27, 1994. After considerable discussion by Council, Mr. Crowe and
the City Attorney, a decision was made to return Custom Masonry
back to Planning & Zoning for public hearing.
Moved by BASTIAN and seconded by MASNER to reconsider Custom
Masonry. ALL AYE: MOTION CARRIED.
Moved by BASTIAN and seconded by MASNER to send Custom Masonry back
to Planning & Zoning for consideration of a rezone request, in view
of the newly proposed development agreement. ALL AYE: MOTION
CARRIED.
AIR QUALITY: Moved by YZAGUIRRE and seconded by MASNER to adopt
the Amendment to Agreement #1291 - Automotive Inspection &
Readjustment Program Joint Power Agreement. ALL AYE: MOTION
CARRIED
ECHOHAWK ESTATES - FINAL PLAT APPROVAL PHASE 1
Moved by MASNER and seconded by BASTIAN to approve the final plat
as presented with two additional items of approval:
1. Bonding to deal with Idaho Department of Transportation
needs
2. Bonding for pressurized irrigation.
ALL AYE: MOTION CARRIED.
EAGLE WATER UTILITY FRANCHISE: Moved by MASNER and seconded by
YZAGUIRRE to continue the matter to the next council meeting on
October 25, 1994. This will allow staff time to locate letter
written to Mr. DeShazo regarding additional information and
consents requested by Mayor and Council. ALL AYE: MOTION
CARRIED.
REPORTS~ Mayor~ The property owned by Safeway Stores is ready to
consider an offer from the City to buy land for a new City Hall.
it would be necessary to have an appraisal. Moved by MASNER and
seconded by BASTIAN to obtain bids for a commercial appraisal on
the site. ALL AYE: MOTION CARRIED.
Council reports: The library report, sewer report, arboretum and
Senior Citizen grant were given.
Engineer Report: Idaho Power will be preparing a work order to put
two street lights on existing poles in Evans Acres #4. The
Homeowners Association in the area of Harvey Street will not allow
the school buses on private streets. The children will have to
catch the bus at the corner of Harvey & Hill Road. Homeowners in
Evans Acre would like the to City to put in a street light on that
corner. Stan advised council it would cost $800.00 for the pole
and an additional $200 - $300 to get power at that location.
Council asked the Engineer to check with Idaho Power to see if the
they can install the pole on a lease basis.
Attorney Report: Mona advised council she will be getting
confirmation this week on meeting date with Brighton Corporation.
Eagle Design Review Ordinance: Proposal was submitted by The Land
Group in the amount of $4,475.00 to revise the Design Review
Ordinance. Mona advised the council when the City Planner was
hired this was part of the planners job description. Council asked
Mary Berent to look into revising the Design Review Ordinance.
CLAIMS AGAINST THE CITY: Moved by YZAGUIRRE and seconded by MASNER
to pay the claims as presented. ALL AYE: MOTION CARRIED.
There being no further business the meeting adjourned at
10:00 p.m.
