April 12, 1994
Pre-Council: Jim Murray gave the Council an update on the new City
Hall complex study. He will return with additional information
within a couple of weeks. He hopes to have the square footage and
possible construction and lease costs.
Recreation~ The Council discussed the upcoming recreation summer
propgrams. The discussion focused on offering horse back riding
camps and rafting in the recreation program. The City was notified
by Stein McMurray, the City insurance carrier that the high risk
activities would require additional insurance and contracts with
the individual companies in order for the City to provide the
services. The Council will take the matter under advisement and
discuss it further in regular session.
The Fall Creek land exchange was discussed. Water and sewer were
discussed, but the focus was the road through the park. The Mayor
will contact Sara Baker and Mona in order to move the process along
and will bring the results back to Council. ACHD needs to clarify
the prospect of a through road, using Joplin, vs no through road.
City Attorney needs clarification on the issue from Boise.
The Eagle City Council met in regular session on April 12, 1994.

Moved by YZAGUIRRE and seconded by BASTIAN to approve the minutes
of the March 22, 1993 meeting as presented. ALL AYE~ MOTION
CARRIED.
PUBLIC HEARING/Amending the Budget
Mayor GUERBER announced that this was the time and place set for a
public hearing on the amendments to the 1993-94 Budget.
There was no public testimony.
Public hearing closed at 7:40 p.m.
Moved by MASNER and seconded by YZAGUIRRE to approve the amendment
to the budget as presented. ALL AYE~ MOTION CARRIED.
PUBLIC HEARING/GRAHAM - CUP
Mayor GUERBER announced that this was the time and place set for a
public hearing on the Graham application for a Conditional Use
Permit for placing a mobile home on the Graham property for a
hardship use.
Applicant: Gary and Sue Graham
Location: 525 Parkinson Rd., Eagle (Randall Acres Sub)
Proposal: to place a mobile home on the property where a
dwelling exists for Sue Graham's parents.
Public Testimony: none
Public hearing closed at 7:45 p.m.
Moved by MASNER and seconded by BASTIAN to approve the Conditional
u~e Permit until there is no further need by the parents. There
wall be a yearly review. ALL AYE: MOTION CARRIED.
ORDINANCES:
Moved by YZAGUIRRE and seconded by EASON to dispense with the three
day ruling and to consider Ordinance ~241 at this time. ALL AYE:
MOTION CARRIED.
Moved by YZAGUIRRE and seconded by EASON to adopt Ordinance #241,
the amendments to the 1993-94 Appropriation Ordinance as presented.
ALL AYE: MOTION CARRIED.
Moved by BASTIAN and seconded by EASON to dispense with the three
day ruling and to consider Ordinance #243 at this time. ALL AYE:
MOTION CARRIED.
Moved by BASTIAN and seconded by EASON to adopt Ordinance #243
annexing and zoning (R4) the Patterson property.
CARRIED.

MELVIN'S EAGLE POINT:
Appeal: Richard Boesiger appealed the Zoning Administrator's
decision to continue with the name "Melvin's Eagle Point #7", phase
2. He asked for consideration of re-naming this phase of the
development to "Melvin's Eagle Point #8".
The final plat was presented to Council.
John Priester spoke to Council regarding the benefits of re-naming
the subdivision. Moved by BASTIAN and seconded by YZAGUIRRE to
accept the final plat for ~Melvin's Eagle Point #8~ with the name
change with the standard conditions of approval. ALL AYE: MOTION
CARRIED.
BOSANKA SUBDIVISION - FINAL PLAT:
Two issues were discussed on the final plat, the irrigation water
and development of the curbs, gutter and sidewalks on State St.
Moved by MASNER and seconded by BASTIAN to approve the final plat
on Bosanka Subdivision as presented with the following:
1. The Standard Subdivision Conditions
2. The developer will be required to begin construction of curbs,
gutters, sidewalks, trees and street lights on State St. within
90 days.
The City Council authorized the Clerk and City Engineer to sign the
plat.
ALL AYE: MOTION CARRIED.
Ada County Transmittal 94-110ZC\94-06-PR - Band
The proposal was presented to the Council by Jim Band. Moved by
YZAGUIRRE and seconded by EASON to accept the transmittal as
presented. ALL AYE: MOTION CARRIED.
Ada County Amendment to the Meridian/Ada County Area of City Impact
Agreement. Moved by MASNER and seconded by YZAGUIRRE "God's speed
and congratulations to Boise and Meridian". ALL AYE: MOTION
CARRIED.
LOT SPLITS:
The Kioukis lot split was presented by Ron Marshall. Moved by
YZAGUIRRE and seconded by BASTIAN to accept the lot split presented
tonight conditioned on the City receiving the recorded survey. ALL
AYE= MOTION CARRIED.
The Courtial lot split was presented by Ron Marshall. Moved by
BASTIAN and seconded by MASNER to accept the lot split presented
tonight conditioned on the City receiving the recorded survey. ALL
AYE~ MOTION CARRIED.
RECREATION REPORT: Moved by EASON and seconded by YZAGUIRRE to
eliminate any hazardous programs such as rafting, horseback riding,
whitewater activities and skydiving from any City of Eagle
sponsored programs. ALL AYE: MOTION CARRIED.
PARKS AND ARBORETUM: Moved by MASNER and seconded by EASON to
notify Tal Trautman, parks maintenance, when any projects are
proposed in the parks, arboretum or City Hall grounds. Also, to

approve the proposal for a 3 ft. pole fence to be erected along the
Stierman side of Orval Krason Park and to begin receiving bids.
The Arboretum will be sprayed for weeds and hand watered until mid
May when the City is notified regarding the grant for the
Arboretum. ALL AYE: MOTION CARRIED.
ENGINEER REPORT:
Kestral Cove Irrigation pipes: The developer is installing Orchard
Valves, but did not contact ditch users. Stan McHutchinson will
verify compliance with conditions and report back to Council.
Kings: Stan will check with the home owners on Eagle Glen road
regarding the patch job on Eagle Glen Road. There were a number of
complaints on the condition of the road due to Kings construction
of the project.
The Sewer District and Library reports were given. The Library is
still working on a 20 year plan. They expect to have it ready in
5 to 6 weeks.
The Eagle Quest will apply for a Gem Community Grant for curbs,
gutters and sidewalks along State St. The grant will cover those
areas already developed without them. Moved by BASTIAN and
seconded by MASNER to authorize YZAGUIRRE to submit a proposal for
other projects that may included in the grant application. ALL
AYE: MOTION CARRIED.
EASON reported on the recycling programs in the Eagle area.
Moved by BASTIAN and seconded by MASNER to accept the line item
changes presented by Liz Horn, Eagle Public Library President
tonight. ALL AYE: MOTION CARRIED.
CLAIMS AGAINST THE CITY: Moved by YZAGUIRRE and seconded by MASNER
to approve the claims as presented. ALL AYE~ MOTION CARRIED.
There being no further business the meeting adjourned at 9:55 p.m.
