CALL TO ORDER: Meeting called to order at 6:02 P.M.
2. ROLL CALL: Present: WRIGHT, GUERBER, MCCAULEY. Absent: MCLAUGHMN &
SMITH. A quorum is present.
CONSENT AGENDA:
♦ Consent Agenda items are considered to be routine and are acted on with one motion. There will
be no separate discussion on these items unless the Chairman, a Commissioner, member of City
Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items
removed from the Consent Agenda will be placed on the Regular Agenda in a sequence
determined by the Rules of Order.
♦ Any item on the Consent Agenda that contains written recommendations from the City of Eagle
shall be adopted as part of the Planning & Zoning Commission's Consent Agenda approval
motion unless specifically stated otherwise.
A. Minutes of August 2, 2021.
Guerber makes a motion to approve the Consent Agenda as presented. Seconded by
McCauley. ALL AYES... MOTION CARRIES.
4. UNFINISHED BUSINESS: NONE.
PUBLIC HEARINGS:
A. ACTION ITEM: CPA-01-21/A-04-21/RZ-05-21 — Comprehensive Plan Future Land Use
Map Amendment, Annexation, and Rezone for a portion of Pamela Baker Park — City
Of Eagle: City initiated Comprehensive Plan Future Land Use Map Amendment from
Public/Quasi-Public (Boise City designation) to Public/Semi-Public (City of Eagle
designation)/Annexation and Rezone from A-1 to PS to include a recently transferred
property (from Boise City to City of Eagle) into Pamela Baker Park. The 6.22-acre site is
located on the northern portion of the existing Pamela Baker Park, approximately 1/3-mile
east of Eagle Road and 1/2-mile north of Chinden Boulevard.
City Planner, Morgan Bessaw, provides a detailed overview of the application.
Bessaw responds to questions from the Commission.
City Planner, Morgan Bessaw, adds clarification on Eagle's Comprehensive Plan and
recommendations to the Commission.
Chairman Wright opens the Public Hearing.
Justin Baily, 2834 South Lake Vista Lane. Baily asked that it be reflected on the record that there
has been an ongoing dispute between fellow neighbors who have taken it upon themselves to do
extensive work on city property by planting several trees, installing landscape lighting, and removing
certain grass on city property. Baily is in favor of the annexation and rezone and has seen the plans
for the park which he thinks will be a great addition to the development and the City of Eagle.
Edward D. Ahrens, 766 East Lakebrook Lane. Ahrens lives along the lake and is in support of project
and would like to know what the future use of the lake will be once it is considered public property.
Commissioner Guerber volunteered information gained from the public meeting that was held at the
lake and informed Ahrens and the room that there will be no boating allowed on the pond and there

has been discussion of installing a small fishing dock for children. Guerber recommended that Ahrens
contact the Eagle Parks & Recreation department for more information.
Ben Karpinski, 774 East Lake Briar Lane. Karpinski is one of five "premier property owners" along
the west side of the pond. Karpinski is one of the residents who has worked on maintaining the area
by installing sprinklers, removing, and installing trees and shrubs, trash removal and fence repair,
algae control and weed removal. Karpinski listed the problems of the pond being trespassing, use of
live bait, littering of trash, and improper behavior. Karpinski proposed a solution being the sale of the
parcels to the homeowners and designating a no trespassing area. Karpinski is in favor of the
annexation and rezone.
Tom Wojak, 2852 South Lake Vista Lane. Wojak is in favor of the annexation and rezone. As an
avid fisherman he walks around the lake regularly and has seen the barbed wire fence that was
installed by other residents and feels that it's a hazard and that the area around the lake should be
open for everyone to enjoy. Wojak has not seen any disregard for the property or improper behavior.
Wayne Newton, 606 East Eaglewoods Lane. Newton understands the concern of some residents not
wanting public access so close to their property. Newton has personally witnessed teenage boys who
are fishing near said property owners, being verbally abusive to the residents after being confronted.
James Shepard, 2868 South Lake Vista Lane. Shepard supports the annexation and sees it as a benefit
to the Lakemoor community. Shepard has never witnessed the fishermen who are primarily teenage
boys showing any disrespect to the other residents and he has found them to be polite. Shepard hopes
that access to the park is open to everyone and that there are no restricted areas.
Andrea Baily, 2834 South Lake Vista Lane. Baily encourages anyone who does not want there to be
full public access to the parcel to put up a fence. She fully supports the annexation wants it to be
fully accessible to the public.
Morgan Bessaw provides rebuttal and responds to concerns raised during the Public Hearing.
Chairman Wright closes the Public Hearing.
Discussion amongst the Commission.
McCauley moves to recommend for approval item 5A, CPA-01-21/A-04-21/RZ-05-21 —
Comprehensive Plan Land Use Map Amendment, Annexation, and Rezone for a portion of
Pamela Baker Park — City of Eagle. Seconded by Guerber. ALL AYES ... MOTION
CARRIES.
6. NEW BUSINESS: NONE.
7. REPORTS:
A. Commission: Guerber encouraged the public to visit the time capsule at the museum.
B. City Attorney: None
C. Staff: Next meeting will be held Tuesday, September 7 due to the Labor Day holiday.

Lakemoor Residence and the City of Eagle Park land
Fa cts
There are five La,kemoo,r residences directly bordering the property deeded to the city of Boise.
The views and tranquility of these premier Lakemoor homeowners has been diminished.
The back yards of these five Lakemoor residents are not covered under the Lakemoor HOA CCR's.
These residents have maintained the lake property for several years at their own expense, which has
included:
• Sprinkler maintenance, repairs, and timers
• Sprinkler blowdown and start-up
• Tree removal and planting of replacement trees and shrubs
• Trash removal and fence repairs
• Beaver control and mitigation
• Water algae control and weed removal
Problems
There has been a tremendous increase of trespassing on the property of these residences.
Kids are fishing around the entire lake with total disregard for the homeowners 'privacy.
Once confronted, many of these kids are hostile and verbally abusive.
Some individuals have been using live bate and are not following "catch and release" restrictions.
Although it is a non -contact lake, we have seen wading and swimming in the water.
Many of the kids have destroyed beautiful lake foliage and have damaged sprinklers, often leaving trash
in the area, including beer bottles and soda cans
Residents have seen urination, defecation, and fornication from their properties.
Bonfires have been set and partying into the night has been common.
Proposed Solution
Sell these five lake parcels to the homeowners.
Set-up a licensing agreement for these properties under the control of the homeowner.
Bring the five properties on the Lake under the purview of the Lakemoor Homeowners Association.
Designate a no trespassing area with a fence or prohibitive landscape.
