CALL TO ORDER: Meeting called to order at 6:00 P.M.
2. ROLL CALL: Present: WRIGHT, GUERBER, MCLAUGHLIN, SMITH, MCCAULEY. A
quorum is present.
3. CONSENT AGENDA:
♦ Consent Agenda items are considered to be routine and are acted on with one motion. There will
be no separate discussion on these items unless the Chairman, a Commissioner, member of City
Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items
removed from the Consent Agenda will be placed on the Regular Agenda in a sequence
determined by the Rules of Order.
♦ Any item on the Consent Agenda that contains written recommendations from the City of Eagle
shall be adopted as part of the Planning & Zoning Commission's Consent Agenda approval
motion unless specifically stated otherwise.
A. Minutes of June 21, 2021.
B. Findings of Fact and Conclusions of Law for the Approval of CU-07-20 — Innovate
Academy — Megan Stephens: Megan Stephens, represented by Brittnee Elliott, is requesting
conditional use permit approval for a school (private). The 1.81-acre site is located at the
southeast corner of North Eagle Road and East Mission Drive at 175 East Mission Drive. (DLM)
C. Findings of Fact and Conclusions of Law for the Approval of RZ-06-14 MOD/RZ-14-20 &
PP-07-20 — Kingfisher Cove Townhomes - Don Newell: Don Newell, represented by Doug
Russell with The Land Group, is requesting development agreement modification, rezone from
MU-DA (Mixed Use with a development agreement) to R-9-DA (Residential with a
development agreement [in lieu of a PUD]), and preliminary plat approvals for Kingfisher Cove
Townhomes, a 73-lot (63-buildable, 10-common) residential subdivision. The 10.68-acre site is
generally located on the northeast corner of West State Street and SH-44. (MJW)
Guerber moves to removed item 3B from the Consent Agenda for further discussion.
Seconded by Smith. ALL AYES... MOTION CARRIES.
City Planner, Daniel Miller stands for questions from the Commission. Miller informs the
Commission that within the Conclusions of Law, staff has added a Conclusion of Law that would
exempt the applicant from being required to complete the site improvements for the span of one year
while the conditional permit remains active.
General discussion amongst the Commission.
Guerber makes a motion to approve item 5B with the rest of the Consent Agenda. Seconded
by McLaughlin. ALL AYES... MOTION CARRIES.
UNFINISHED BUSINESS: NONE.
PUBLIC HEARINGS:
A. ACTION ITEM. RZ-04-21 & PP/FP-01-21 — Middlefork Estates Subdivision — Mike and
Julie Harrison: Mike and Julie Harrison, represented by Eagle Land Surveying, is requesting a
rezone from R-E-DA (Residential -Estates with a development agreement) to R-1-DA
(Residential with a development agreement) and combined preliminary and final plat approvals

for Middlefork Estates Subdivision, a 3-lot residential subdivision. The 3.15-acre site is located
on the west side of North Meridian Road approximately 1,725-feet north of West Floating Feather
Road at 1655 North Meridian Road. (DLM)

Harrison responds to questions from the Commission.
City Planner, Daniel Miller, provides a detailed overview of the application.
Miller responds to questions from the Commission.
City Planner, Mike Williams, adds clarification on Eagle's Comprehensive Plan and
recommendations to the Commission.
Chairman Wright opens the Public Hearing.
David Baily, 1119 East State Street. Baily is the applicant's engineer and provides testimony about
the project and the conditions that the City is asking for in terms of maintenance and landscaping
agreement.
Mike Harrison provides rebuttal and responds to concerns raised during the Public Hearing.
Chairman Wright closes the Public Hearing.
Discussion amongst the Commission.
McCauley moves to recommend for approval item 5A, RZ-04-21 & PP/FP-01-21—Rezone from
R-E-DA to R-1-DA and combined preliminary and final plat approvals — Mike and Julie
Harrison with the staff recommended guidelines. Seconded by McLaughlin. ALL AYES ...
MOTION CARRIES.
6. NEW BUSINESS: NONE.
