Minutes - 2021 - City Council - 06/22/2021 - Regular EAGLE CITY COUNCIL MEETING MINUTES June 22,2021 1. CALL TO ORDER: Mayor Pierce calls the meeting to order at 5:30 p.m. 2. ROLL CALL: Present: GINDLESPERGER,PITTMAN, BAUN,PIKE. All present. A quorum is present. 3. PLEDGE OF ALLEGIANCE: 4. ADDITIONS,DELETIONS OR MODIFICATIONS TO THE AGENDA: A. City Staff requests. B. Mayor or City Council requests. 5. PRESENTATION: A. Idahoans For Safe Technology, Inc.: Hank Allen, with Idahoans for Safe Technology, Inc.,will discuss ideas for an updated wireless ordinance in the City of Eagle. Mayor introduces the item. Hank Allen, 687 W.Rush Ct. Eagle,Idaho. The Idahoans for Safe Technology Inc, are advocates of local control for broadband infrastructure. He discusses radio frequencies and how they are harmful to human health. Mr. Allen details the health challenges his daughter and he have encountered since the ratio towers have been activated. He has invested in items to mitigate the hazards he has experienced including specialized interior paint to shield electromagnetic fields,and silver lined clothing to shield from EMF radiation when outside. After reaching out on NextDoor, several others have experienced health issues. Mr. Allen reviews a current federal laws and requests local government move forward enact ordinances to address their concerns to protect the health of Eagle residents. 6. REPORTS: A. Mayor and Council Reports: Gindlesperger reports on an Animal Control Committee they are looking at the fee structure and possibly limiting the number of cats and dogs allowed. Library Board they currently are offering several programs and encourage people to visit their website for offerings. Pittman reports on the Sewer District activities. The Spring Valley Community Infrastructure District has selected a District Manager Launch, a District Engineer TO Engineers and a District Attorney MSBT law. They are moving forward with the transition of duties currently being handled by City Staff. The Senior Board is meeting with the Valley Regional Transit to get a better understanding of the services that are provided. Pittman congratulates Chief Clifford on his nomination to fill the Sheriffs vacancy. Pike reports on the drafting of an economic development district. Baun reports on the Bureau of Land Management meeting that was held last night regarding the concept plan. B. City Hall Department Supervisor Reports:None C. City Attorney Report: None 7. At times, the City Council may seek comments/opinions regarding specific City matters during this allotted time.This is not the time slot to give formal testimony on a public hearing matter,land use application,or comment on a pending application or proposal. Out of courtesy for all who wish to speak, the City Council requests each speaker limit their comments to three (3) minutes. Bob Van Arnem 3049 S.Whitepost Eagle,Idaho. He has been interested in jurisdiction for traffic patrol on Chinden Road and reports his findings. He feels there needs to be clarification and cooperation on enforcement of traffic laws. The Joint Powers Agreement states that monthly reports shall be given,and who is responsible for overseeing the agreement. He would like directed patrols on Chinden Blvd. Mayor Pierce states that he had asked for monthly reports addressing response times as opposed to tickets/enforcement focus. In addition he acknowledges that enforcement numbers from 2020 would be skewed due to the pandemic. Chief Clifford states that resources are placed where it statistically shows they are needed. Directed patrols are generally focused on Highway 44 vs Chinden because that is where the evidenced need has presented itself. Chief acknowledges the challenging location due to the multijurisdictional local. Sgt Wilke has met with Mr. Van Arnem. To distribute the resources to meet the variety of needs is always something being considered and reviewed. The coordination of directed patrol, school zones and"hot spots"is something that is a continual challenge for law enforcement. Ada County Sheriff does meet with other law enforcement jurisdictions to try and coordinate responses in a variety of locals and are they are trying to address Mr.Van Arnem's concerns as well as others. 8. ALL CONSENT ITEMS ARE CONSIDERED ACTION ITEMS: CONSENT AGENDA: • Consent Agenda items are considered to be routine and are acted on with one motion. There will be no separate discussion on these items unless the Mayor, a Councilmember, member of City Staff,or a citizen requests an item to be removed from the Consent Agenda for discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in a sequence determined by the City Council. • Any item on the Consent Agenda which contains written Conditions of Approval from the City of Eagle City Staff, Planning&Zoning Commission, or Design Review Board shall be adopted as part of the City Council's Consent Agenda approval motion unless specifically stated otherwise. DR-22-21 — Personal Service Building for Renu Medispa — Alexander Properties, LLC: Alexander Properties,LLC,represented by Mysti Stelluto with Dave Evans Construction,is requesting design review approval for a 6,782-square foot, two-story (1st Floor—4,780-SF, 2nd Floor—2,002-SF)personal services building for Renu Medispa. The 0.69-acre site is located on the north side of East Riverside Drive approximately 375-feet west of East Shore Drive at 600 East Riverside Drive within Eagle River Development(Lot 18,Block 3,Mixed Use Subdivision No. 5). (BAW) C. DR-26-21 — Three Building Wall Signs for Renu Medispa — Tawni Weaver: Tawni Weaver,represented by Virginia Cunningham with Golden West Signs,is requesting design review approval for three building wall signs for Renu Medispa. The 0.69-acre site is located on the north side of East Riverside Drive approximately 375-feet west of East Shore Drive at 600 East Riverside Drive within Eagle River Development(Lot 18,Block 3,Mixed Use Subdivision No. 5). (BAW) D. Resolution 21-11: Merrill No.2 VAC: A Resolution of the Eagle City Council to vacate the existing easement for Drain No. 15 in favor of Drainage District No. 2 located within Lot 17, Page 2 K:\COUNCIL\MINUTES\Temporary Minutes Work Area\CC-06-22-21min.docx Block 3,Merrill Subdivision No.2 as shown on the attachments hereto;and providing an effective date. Resolution 21-12: Shreeve VAC: A Resolution of the Eagle City Council to vacate plat notes specifying additional setback requirements for Lot 43, Block 1, Streamside Subdivision as shown on the attachments hereto;and providing an effective date. Development Agreement Associated with RZ-10-20 — Brookwav North: Staff is requesting approval of the development agreement associated with the rezone from RUT (Rural Urban Transition — Ada County Designation) to R-2-DA-P (Residential with a development agreement—PUD). The City Council approved the associated annexation and rezone applications on February 18,2021 (A-08-20&RZ-10-20). (MJW) G. Development Agreement Associated with RZ-12-20 — J&M Land, LLC and Cabra Creek,LLC: Staff is requesting approval of the development agreement associated with the rezone from RR(Rural Residential—Ada County Designation) and RUT(Rural Urban Transition—Ada County Designation) to R-E-DA (Residential Estates with a development agreement). The City Council approved the associated annexation and rezone applications on April 27, 2021 (A-09-20 &RZ-12-20). (MJW) H. Development Agreement Associated with RZ-01-04-14 MOD—Foxtail Senior Living Center, LLC — William Hines: Staff is requesting approval of a development agreement modification to increase the number of residential assisted living units from 77 to 100 total units. The City Council approved the associated rezone applications on May 11,2021 (RZ-01-14 MOD). (MJW) I. Independent Contractor Agreement with Cornhole Idaho: Parks and Recreation Director is requesting approval for an independent contract agreement with Cornhole Idaho and the 2021 Eagle Fun Days Cornhole tournament and not to exceed$1,000. (BJ) J. Minutes of June 8,2021.(TEO) K. GWC Impact Fee Reimbursement Agreement: Reimbursement Agreement with GWC for the preliminary engineering and sites evaluation study of a Regional Sports Park site located at SH-16 and Equest Lane in an amount not to exceed$48,000.(JP/VV) L. Noise Waiver Request from Eagle Chamber of Commerce: Eagle Chamber of Commerce Vice-Chairman, Shawn Nickle is requesting a noise waiver for the date of July 9, 2021 for the Friday Fun Night event being held between 5:30 pm to 11:00 pm. (TEO) M. Memorial Bench for Carole Brawley Green: Request for Council approval of a memorial bench to be located at the Eagle Public Library grounds. (HC) N. Service Proposal Between the City of Eagle and The Painting Pro: A service proposal between the City of Eagle and The Painting Pro to provide painting services for the Historical Museum. An amount not to exceed$3,690. (EZ) O. Eagle Arts Commission Grant Funding Approval: The Eagle Arts Commission is seeking Council approval to award the Boise Baroque Orchestra a grant not to exceed$5,000. This is a budgeted item. (PT) P. Eagle Arts Commission Grant Funding Approval: The Eagle Arts Commission is seeking Council approval to award the project: The Klezmer Story: Teaching Cultural Diversity through Folk Music a grant not to exceed$2,000. Development Agreement Associated with RZ-12-20 — J&M Land, LLC and Cabra Creek,LLC: Staff is requesting approval of the development agreement associated with the rezone from RR(Rural Residential—Ada County Designation) and RUT(Rural Urban Transition—Ada County Designation) to R-E-DA (Residential Estates with a development agreement). The City Council approved the associated annexation and rezone applications on April 27, 2021 (A-09-20 &RZ-12-20). (MJW) Pittman states as a liaison for the Eagle Sewer District that the installation of the Palmer lift station was to service this area. He is opposed to the approval of an additional septic systems. Planner III,Mike Williams reads the condition of approval associated with this development agreement,3.7. Discussion. Pittman moves to approve Development Agreement Associated with RZ-12-20—J&M Land,LLC and Cabra Creek,LLC. Seconded by Gindlesperger. ALL AYE...MOTION CARRIES. K. GWC Impact Fee Reimbursement Agreement: Reimbursement Agreement with GWC for the preliminary engineering and sites evaluation study of a Regional Sports Park site located at SH-16 and Equest Lane in an amount not to exceed$48,000. (JP/VV) Pittman asks for an overview of the reimbursement agreement. City Attorney Villegas gives a brief overview of the agreement. The City will agree to reimburse GWC up to$48,000 for engineering and site evaluation for a regional sports park. These monies would come from development impact fees,which is an allowed use for these funds per the Capital Improvement Plan. Construction Access Control Plan associated with Whitehurst Subdivision No. 1: Evans Development LLC,represented by Sophia Durham with Conger Group, is seeking City Council approval of a construction access control plan associated with Whitehurst Subdivision No. 1. (MJW) Mayor Pierce introduces the item. Planner III, reviews the required construction access control plan that was required with the approval of Subdivision No. 1. Discussion for clarification. Pittman moves to approve item 11A Construction Access Control Plan associated with Whitehurst Subdivision No. 1. Seconded by Gindlesberger. ALL AYE...MOTION CARRIES. B. ACTION ITEM Discussion and Potential Action Regarding Altering Mayor and Council Salaries. (TEO) Mayor Pierce introduces the item. Council would like to have staff bring back what comparable municipal Mayor and Council salaries are,the number of regular meetings and special meetings over the last three years, and information of staff salary increases in relation to increases to Mayor and Council compensation. Pittman moves to direct staff to bring back the items. Seconded by Gindlesberger. Pittman amends to state at the next regular meeting. ALL AYE...MOTION CARRIES. C. ACTION ITEM: Acceptance of Donation of 6.22 Acres of Property from Boise City Associated with the Pamela Baker Park Site.: City Council will take action regarding the conveyance of property. The City of Boise is conveying 6.22 acres to the City of Eagle. The land is restricted as follows:the property shall be used as a non-residential,non-commercial,public park site and shall remain as a buffer to the Boise water renewal facility and any use which is incompatible with such water renewal facility or expansion there of shall not be permitted. (EZ) Mayor Pierce introduces the item. Pittman extends his gratitude to the City of Boise for the donation. City Attorney Victor Villegas requests the motion include the requirement of resolution to formalize the acceptance of the donation of land. Eric Ziegenfuss,Public Works Director displays an overhead of the location of Pamela Baker Park and the land in question which is the most northern portion of the park. Baun moves to direct staff to prepare a resolution for the acceptance of the 6.22 acres property from Boise City. Seconded by Pittman. ALL AYE...MOTION CARRIES. Have you or do you know someone in and/ or around Eagle that has started experiencing heart flutters or developed Afib with in the last couple of months? My doctor thinks there is a possible environmental link to my recent Afib episodes and I'm attempting to identify the triggers. I have gone into Afib 5 times in the last 2 months between 4 & 5pm. I had a heart Ablation 3 weeks ago and I am on 2 heart drugs and blood thinner. I have low blood pressure and no stenosis of valves and arteries&veins are great. I had Covid-19 at end of July 2020. My first AFIB was in conjunction with a chest cold in February. I did have 2 episodes that happened at home after dinner. I still feel slight arythmias but si much better. I am 53 and a 10 yr breast cancer survivor. My doctor said that menopause &stress could be culprits. Working on reducing stress. In the meantime, my friend who I hadn't spoken with said he's been having AFIB and has had 2 Ablations during Covid. And his brother just started having it a few weeks ago. Are you living or working close to a cell tower or 5-G antenna? They are everywhere and look very much like a newfangled street light(photo attached). I've had personal experience with this and it can be quite frightening because most doctors don't know much about it and because they can't find a culprit,they treat the symptoms with heavy-duty drugs. I was sent to the hospital with symptoms of experiencing a heart attack. There,after a full examination and x-rays I was put on drugs for high blood pressure and anxiety and released.I was told to follow-up with my primary care doctor who referred me to a cardiologist that put me through several tests.When he could find nothing wrong with my heart,I was referred to a psychiatrist. When the doctors determined that I was healthy AND sane,the only thing they knew what to do was give me more drugs. It took more than 4 years,hundreds if not thousands of dollars,and massive research to get my body and life back to normal and off the horrible drugs. More and more people are becoming hypersensitive to EMFs. The symptoms most commonly reported include headaches,body pain, lethargy,tinnitus(ringing in the ear),nausea,burning sensation,heart arrhythmia and anxiety. 13 When the topic of Public Health and Safety arises at City of Cell Tower Contractors and Verizon attorneys all state that Boise and Ada County P&Z meetings and CUP Public Hearings. T-Mobile USA,Inc.v. City of Anacortes,572 F.3d 987, 995(9th Cir.2009). Under Anacortes,the provider must make a prima facie showing of CONSENT ORDER AND JUDGMENT-3 19 effective prohibition by demonstrating that alternatives were considered and that the proposed wireless facility is the least intrusive means of filling the significant gap. 572 Horizon has exceeded the least intrusive means F.3d at 997-98. to fill the gap in coverage. See RF report installed more antaines than required On or about October 11,2019,Horizon disclosed to the County an expert report drafted by Steven E.Kennedy,owner of Biwabkos Consultants.LI.0("Expert Report"). The Expert Report establishes that Plaintiffs have established that both Verizon Wireless and AT&T have a significant gap in their service in the vicinity of the Proposed Site. The Expert Report also establishes that Plaintiffs undertook a good faith and thorough investigation of potential alternative sites in and around the area of the Proposed Site. The Expert Report ruled out all existing towers in the vicinity as infeasible or unavailable for collocation. The Expert Report shows that Plaintiffs investigated several additional properties in the vicinity,but were unable to identify an available,technically feasible alternative to the Proposed Site. The Expert Report establishes that the Proposed Site is, therefore,the least intrusive location to remedy a significant gap in wireless service. 20 10 6/23/2021 No third parties have petitioned to intervene in this matter. Pursuant to the Communications Act and consistent with the parties'Settlement Agreement,the Court finds Plaintiffs'claims well-taken and specifically finds that the Proposed Facility at the Proposed Site is the least intrusive means of remedying a significant gap in personal wireless service of Verizon Wireless and AT&T. The Court further finds that the appropriate resolution is the issuance of an order requiring the Defendants to grant Plaintiffs' Application and to issue the conditional use permit to construct the Proposed Facility attached hereto as Exhibit A.
