CALL TO ORDER: Meeting called to order at 6:03 P.M.
ROLL CALL: Present: WRIGHT, GUERBER, MCLAUGHLIN, SMITH. Absent:
MCCAULEY. A quorum is present.
CONSENT AGENDA:
♦ Consent Agenda items are considered to be routine and are acted on with one motion. There
will be no separate discussion on these items unless the Chairman, a Commissioner, member
of City Staff, or a citizen requests an item to be removed from the Consent Agenda for
discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in
a sequence determined by the Rules of Order.
♦ Any item on the Consent Agenda that contains written recommendations from the City of Eagle
shall be adopted as part of the Planning & Zoning Commission's Consent Agenda approval
motion unless specifically stated otherwise.
A. Minutes of June 7, 2021.
B. Findings of Fact and Conclusions of Law for the Approval of A-12-20/RZ-16-20 &
PP/FP-01-20 — Spartan Estates Subdivision — Clark Mahv: Clark Mahy, represented by
Stephanie Leonard with KM Engineering, LLP, is requesting an annexation, rezone from RUT
(Rural -Urban Transition — Ada County designation) to R-E-DA (Residential Estates with a
development agreement) and combined preliminary and final plat approvals for Spartan
Estates Subdivision, a 2-lot residential subdivision. The 4.69-acre site is located on the west
side of North Meridian Road approximately 1,500-feet south of the intersection of North
Meridian Road and West Beacon Light Road at 2635 North Meridian Road.
C. Findings of Fact and Conclusions of Law for the Approval of A-03-21/RZ-03-21/CU-03-
21/PPUD-03-21/PP-05-21 — Carrara Estates Subdivision — CC Chase, LLC: CC Chase
LLC, represented by Becky McKay with Engineering Solutions, LLP, is requesting
annexation, rezone from RUT (Rural -Urban Transition — Ada County designation) to R-1-
DA-P and R-3-DA-P (Residential with a development agreement — PUD), conditional use
permit, preliminary development plan, and preliminary plat approvals for Carrara Estates
Subdivision, a 103-lot (85-buildable, 18-common) residential planned unit development. The
66-acre site is located on the north side of West Floating Feather Road approximately 2,280-
feet west of North Eagle Road.
Smith moves to approve the consent agenda. Seconded by Guerber. ALL AYES... MOTION
CARRIES.
McCauley arrives and joins the Commission.

PUBLIC HEARINGS:
A. ACTION ITEM. A-05-19/RZ-11-19/RZ-06-04 MOD4/CU-10-19/PPUD-07-19 & PP-07-19
- Route 44 Crossing Subdivision — Jay Walker: Jay Walker is requesting annexation, rezone
from R1 and C2 (Estate Residential and Community Commercial — Ada County designations)
to C-1-DA-P (Neighborhood Business District with a development agreement — PUD),
development agreement modification, and conditional use permit, preliminary development
plan, and preliminary plat approvals for Route 44 Crossing Subdivision, a 71-lot (41-single-

family [inclusive of 9-live/work lots], 10-commercial [inclusive of 2-storage unit lots], 20-
common) residential/commercial planned unit development. The 15.68-acre site is located at
the northeast corner of State Highway 44 and North Linder Road at 410 North Linder Road and
4400 West State Street.
City Planner, Mike Williams, informs the Commission that the applicant has requested to continue
the item to the July 19, 2021, Commission meeting.
Smith makes a motion to postpone item 5A — A-05-19/RZ-11-19/RZ-06-04 MOD4/CU-10-
19/PPUD-07-19 & PP-07-19 — Route 44 Crossing Subdivision — Jay Walker with a renotice
and have it continued to the next meeting, July 19, 2021. Seconded by Guerber. ALL AYES...

B. ACTION ITEM. RZ-06-14 MOD/RZ-14-20 & PP-07-20 — Kingfisher Cove Townhomes —
Don Newell: Don Newell, represented by Doug Russell with The Land Group, is requesting
development agreement modification, rezone from MU-DA (Mixed Use with a development
agreement) to R-9-DA (Residential with a development agreement [in lieu of a PUD]), and
preliminary plat approvals for Kingfisher Cove Townhomes, a 73-lot (63-buildable, 10-
common) residential subdivision. The 10.68-acre site is generally located on the northeast
corner of West State Street and SH-44. (MJW)

application.

Chairman Wright opens the Public Hearing.
Juli Moore, 2150 West Southfork Drive. Moore states that the density and the increased traffic will
negatively impact this area. Although not entirely against the development of parcel, she would
like to see the property developed in a way that will complement the neighborhood.
Matt Drown, 2150 West Pacific Ridge Street. City Planner, Williams notes to the record that Drown
is one of the applicants. Drown states that this current application is 20% less dense than the
original approved application and it includes owner occupied townhomes versus the approved
rental apartments. Drown believes this project is much improved that what has already been
approved.
Adam Eckhardt, 1802 North Emerald Bay Avenue. Eckhardt is opposed to the high density of this
project and would like to see something similar to the townhomes along Plaza and 2nd Street.
Michael Colby, 1951 North Estancia Place. Colby is opposed to the development stating that there
is enough high -density housing in Eagle and that the city needs to keep the best interest of the
residents in mind for any future development.
Doug Russell, the applicant's representative, provides rebuttal and responds to concerns raised
during the Public Hearing.

Smith moves to recommend for approval item 5B Kingfisher Cove Townhomes Subdivision
RZ-14-20 & PP-07-20 Kingfisher Cove Townhomes — Don Newell, with the following
amendments: On item 3.5, will be struck and add a condition that the owner shall construct
the berms adjacent to State Highway 44 and West State Street in conformance with Eagle
City Code. Seconded by Guerber. FOUR AYES, ONE NAY (MCLAUGHLIN)... MOTION
CARRIES.

C. ACTION ITEM. CU-07-20 — Innovate Academy — Megan Stephens: Megan Stephens,
represented by Brittnee Elliott, is requesting conditional use permit approval for a school
(private). The 1.81-acre site is located at the southeast corner of North Eagle Road and East
Mission Drive at 175 East Mission Drive. (DLM)
Brittnee Elliott, 2224 West Hill Terrace Lane, Boise, ID 83702. Elliot provides a detailed overview
of the application.

Chairman Wright opens the Public Hearing.
Bo Schmelling, 13069 North Town Ridge Road, Boise, ID 83714. Schmelling has four children
attending the school with great success. The school's small class sizes allow for his children's
growth and success. He loves this school and the involvement of all the parents. He does not see
any traffic issues with the drop off and pick up procedures.
Susan Henningsen, 11723 West Pinewood River Lane, Star, ID 83669. Henningsen states her
support for the application, believes it is an exceptional school allowing for the growth and
community stewardship of its students.
Tessa Osborne, 2115 East Autumn Way, Meridian, ID 83642. Osborne is one of the founders of
Innovate Academy and is in favor of the application. She feels that the school has been able to
operate in a manner that works with the community and that the students attending Innovate
Academy are the future leaders of the community. Osborne provides information about Innovate
relocating to Idaho Performing Arts Center in the Spring 2022.
Brittnee Elliott, the applicant's representative, provides rebuttal and responds to concerns raised
during the Public Hearing.

Guerber amends the motion for Action Item CU-07-20 with the conditional use granted
waiving conditions 16 and 18 and adding condition 19 which allows the applicant one (1) year
in which to bring the subject property into compliance with the requirements and conditions
of approval set forth by the Ada County Highway District. Seconded by McLaughlin. ALL
AYES... MOTION CARRIES.
