WHEREAS,Term Investments,LLC,requested a vacation to the final plat of Merrill Subdivision No. 2 to vacate the existing easement for Drain No. 15 in favor of Drainage District No. 2 located within Lot 17,Block 3 (Merrill Subdivision No.2);and WHEREAS, On May 3,2021,the Planning and Zoning Commission recommended approval of the vacation(VAC-02-21),with conditions,to the Council and; WHEREAS;Legal notice of the City Council hearing on the vacation waS published in the Idaho Statesman on May 7 2021,and May 14,2024 and WHEREAS„On May.25, 2021, the City Council beid a public,hearing on the proposed vacation (VAC-02-21),and voted to approve the..vacation with conditions;and WHEREAS, The City Council. hereby finds that the proposed vacation :complies with the provisions of Section 50-1306A of the Idaho Code,"Vacation of Plats-Procedure",and Section 2 of Eagle City Code,"Vacations and Dedications;"and NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF EAGLE,IDAHO. The Eagle City Council hereby vacates the existing easement for Drain No. 15 in favor of Drainage District No. 2 located within Lot 17, Block 3,of the final plat of Merrill Subdivision No. 2,as considered, heard, and approved by the Council at its May 25, 2021, public hearing for application number VAC-02-2i,and as shown on the attachments hereto(Exhibit A).
