Minutes - 2021 - City Council - 06/08/2021 - Regular EAGLE CITY COUNCIL MEETING MINUTES June 8,2021 1. CALL TO ORDER: Mayor Pierce calls the meeting to order at 5:30 p.m. 2. ROLL CALL: Present: GINDLESPERGER, PITTMAN, BAUN, PIKE. All present. A quorum is present. 3. PLEDGE OF ALLEGIANCE: 4. ADDITIONS,DELETIONS OR MODIFICATIONS TO THE AGENDA: A. City Staff requests. B. Mayor or City Council requests. 5. RECOGNITION: 6. REPORTS: A. Mayor and Council Reports: Gindlesberger reports on the Arts Commission, Friday Night Flicks, new traffic box art, and the underpass artwork project that is in progress. They also conducted the Art That's Small Exhibit and presented awards to the artists. Pittman reports on the Community Infrastructure District(CID)meeting and the upcoming selection of District Manager, Engineer and Attorney. He attended the Senior Center Board meeting, and it was reported that there were 700 (vehicle) boardings in April, and 900 in May, as drastic increase associated with the state easing COVID restrictions and vaccine availability. They have also asked that the Valley Regional Transit attend a meeting so that they may better understand the distribution of funds to the Senior Center. Baun reports on the Bureau of Land Management Work Group and public comment compilation. There will be one more survey distributed prior to the adoption and presentation to Council. Mayor reports that the West Park property sold for$9.1 million dollars today. The dog park is partially open now and a Yappy Hour has been held there. Once the sod has taken root,the park will be fully open for use. B. City Hall Department Supervisor Reports: Director of Long-Range Planning and Projects, Nichoel Baird-Spencer reports on the Balancing Act tool results. She will be conducting workshops to analyze the report and seek Council direction on the Capital Improvement and Maintenance Plan. Public Works Director, Eric Ziegenfuss states that the street flower pots have been installed, along with the banners for Eagle Fun Days and Idaho Wine month. They are making progress on the landscaping for the museum. With summer upon us there has been a significant increase in park usage and the enjoyment of the splash pads. Eagle Police Chief Matt Clifford provides information regarding average response times and provides a comparison between north and south county and City of Eagle police response times for the year 2020. Development Agreement Associated with RZ-13-20—Treasure Valley Chevron: Staff is requesting approval of the development agreement associated with the rezone from RUT (Rural Urban Transition — Ada County Designation) to C-1-DA (Neighborhood Business District with a development agreement). The City Council approved the associated annexation and rezone applications on April 27, 2021 (A-10- 20 & RZ-13-20). (MJW) E. Findings of Fact and Conclusions of Law for the Approval of FPUD-03-21 & FP- 05-21—Final Development Plan and Final Plat for Snoqualmie Falls No. 15—Red Butte, LLC: Red Butte, LLC, represented by David Sterling with T-O Engineers, is requesting final development plan and final plat approvals for Snoqualmie Falls No. 15, a 52-lot(45-buildable, 7-common), residential subdivision. The 27.35-acre site is located at the southeast corner of West Floating Feather Road and North Palmer Lane. (DLM) F. Eagle Fun Days Live Performance Agreement: The Parks and Recreation Department is seeking Council approval for a Live Performance Agreement between the City of Eagle and Red Light Challenge in an amount not to exceed$525. Eagle Fun Days Live Performance Agreement: The Parks and Recreation Department is seeking Council approval for a Live Performance Agreement between the City of Eagle and Jeff Engelbert Band in an amount not to exceed $550. Eagle Fun Days Live Performance Agreement: The Parks and Recreation Department is seeking Council approval for a Live Performance Agreement between the City of Eagle and Generator Saints in an amount not to exceed $750. Museum Glass Repair for Display Case: The Museum Department is seeking Council approval for a Service Agreement between the City of Eagle and Fast Glass Company in an amount not to exceed $1109. (AD) Mayor Pierce notes that there was a request from the public to have item H removed and Council has comments on the same, it will be removed. DR-18-21 — Common Area Landscaping Within Stags Crossing Subdivision — Urban Solutions,LLC: Urban Solutions, LLC,represented by Steve Hart, is requesting design review approval of the common area landscaping within Stags Crossing Subdivision. The 68.4-acre site is located on the south side of West Beacon Light Road approximately 1,970-feet west of North Lanewood Road at 6391 West Beacon Light Road. (BAW) Page 3 K:\COUNCIL\MINUTES\Temporary Minutes Work Area\CC-06-08-21min.docx Zoning Administrator Bill Vaughan states that the preliminary plat and development plan for Stags Crossing was approved with a condition that required the submittal of a construction access and control plan. While this plan was construction timeline and traffic plan were submitted along with the Design Review application,but it is also included in the final plat application that was provided to the City. The condition of approval for construction access plan states that it will be reviewed and approved at submittal of the first final plat application, so the appropriate time for action will be at the final plat. However, if Council would like to hear from the neighbor tonight, as they are in attendance tonight,then that is appropriate. The action of the Design Review application and the time to address the traffic plan would be at the final plat. However, as a resident has requested the removal from the Consent Agenda the Council may wish to hear from them tonight. The applicant is also in attendance to address concerns that may be presented. Roger Foster, 1864 N. Heirloom Place Eagle, Idaho, President of the Syringa Homeowners Association. He represents 128 households in Syringa. There is a concern that the completion of the bridge may drag into 2022, due to weather and soil conditions thus construction traffic would have to continue to use Syringa and Lilac Springs to access the site. In order to address traffic,dust pollution and safety issues, the residents of Syringa and Liliac Springs would like the bridge installed prior to the completion of phase 1 at day 120. And lastly, the approved irrigation plans that were required to be submitted to be provided to the Syringa Homeowners Association and have not been received to date. Larry Givens,236 N. Heirloom Place Eagle,Idaho.They do not feel that it is fair that 120 residents should have to put up with construction traffic when there is another construction access available. Council Member Pittman reiterates that the traffic plan will be addressed when action is considered for the final plat for Stags Crossing. Steve Hart, Urban Solutions P.O. 1304 Eagle, Idaho. He also would like to discuss the pathway and fence requirements from Eagle Parks Pathways and Recreation Commission. He is seeking clarification on the height of the metal fence required along the canal. Also wishes to discuss the recommendation by the Parks Pathways and Recreation Commission of utilizing concrete materials for the pathway. The cost of replacement of concrete to the HOA is excessive. Discussion regarding fence height, pathway materials and maintenance and possibly moving towards the City maintaining regional trails in order to provide a consistent level of service. Pittman moves to approve consent agenda item 8H DR-18-21 —Common Area Landscaping Within Stags Crossing Subdivision — Urban Solutions, LLC: to include removal of the timeline and traffic plan to be discussed during the final plat application in front of City Council. Seconded by Pike. Discussion.Pittman amends to requesting concrete pathway for the trail,installation of an iron 3' fence. Second concurs. ALL AYE...MOTION CARRIES. 9. UNFINISHED BUSINESS: A. ACTION ITEM: Receive the Impact Fee Analysis and Capital Improvement Plans for Star Fire Protection District and Provide Direction to City Staff. This item was continued from the May 25, 2021 meeting. Mayor Pierce introduces the item. Gindlesberger feels this should be addressed at a later date,so that the Star Fire, Eagle Fire,Council President and Commissioners for each district can meet and discuss. Discussion. ALL AYE...MOTION CARRIES. 10. PUBLIC HEARINGS: NONE 11. NEW BUSINESS: A. Discussion of construction bids for City Hall expansion —Wright Brothers, The Building Company—Robert Grubb. (EZ) Mayor Pierce introduces the item. Public Works Director, Eric Ziegenfuss introduces Robert Grubb with Wright Brothers, The Building Company. Rob Grubb with Wright Brothers is in attendance telephonically. After the public competitive bid opening on May 26th the total $3,446,000. This is considerably higher than anticipated a year ago when the project began,however considering the current competitive market and the activity in the Valley today, he feels that it is a reasonable result. This is approximately 40% higher than anticipated,and is being seen throughout projects they are involved in. The original estimated price was $2.1 million. Discussion regarding the timeline and costs. B. ACTION ITEM: Amendment to Construction Management Service Agreement between the City of Eagle and Wright Brothers,the Building Company. Mayor Pierce introduces the item. Baun moves to approve action item 11B Amendment to Construction Management Service Agreement between the City of Eagle and Wright Brothers,the Building Company in the new estimated amount of $3.4 million plus change. The motion to go into executive session shall identify the specific subsections of this section that authorize the executive session. There shall be a roll call vote on the motion and the vote shall be recorded in the minutes. An executive session shall be authorized by a two-thirds(2/3)vote of the governing body. Ada County Highway District planners were consulted as to what is permissible within the scope of work in regards to traffic routing,signage and access to public roads. CONSTRUCTION TIMELINE AND TRAFFIC ROUTING DAY 1-Phase 1, Excavation equipment is delivered;Ada County Highway District will determine traffic pattern and routing for ail heavy haul equipment due to size and weight of vehicles. Signage will be placed on the exit of Stags Crossing site stub streets at Arena Avenue/Venetian and Estuary stub roads; noting all traffic must comply with posted speed limit, per Developer. ACHD will not allow signage in their public right-of-way. • All construction work hours will comply with Eagle City code 4-9-3. • The public notification process will be as follows; Syringa, Lilac Springs and Eagle Mountain HOAs will be sent a copy of this letter, through certified mail giving the estimated timeline of construction and traffic routing. The HOAs are then able to notify residents in their routine form of communication. • 5-7 personal vehicles will enter and exit the site daily through the Arena Ave./Venetian Dr. and the Estuary access points. • Please note these are public roads owned and maintained by ACHD. DAY 90-120 Phase 1, Paving is complete and final plat to be recorded with the City of Eagle and ACHD. DAY 121-Phase 1, Builder team ACC Design Review for home submissions begins and Eagle City building permits may be submitted at this time. Consider a RSVP program for some items like vacation home checks and traffic coordinators for large events • Help people faster....Drowning,elderly...Not that expensive and shared with Fire. • Put a branch library in this also, instead of s bookmobile! • Do what is necessary if it makes fiscal sense as we grow. Bookmobile: • Better to add a branch library on the west side of Eagle. Children's programs;don't need to pay a driver or upkeep on a vehicle or place to store it. • I really love books and that we need to read-My mother(City Council of S.Diego)was a huge proponent of Libraries,however, I think times have changed and with limited budget... :-( City Shop: • Let's stay able to do work for ourselves...this would pay for itself over time. Library Book Drop: • Make it more convenient for us.. Only if you can drive up and get your holds from your car. Otherwise put the holds back in the building. It's a hassle to have to call,email or text to tell staff WHEN we want to pick up the holds. One click from hold notification...list 7 days to choose when you want to get it...no times. • What you currently have is fine. Add a coffee area or more rental space City Hall Safety Measures: • Is this like Camera systems and motion detection lasers inside the building? I don't like this because I feel REALLY Safe here,and putting up alarms and cameras indicates that we aren't safe. I HATED that every CA(I'm one,but glad I'm out)store, intersection,the whole state (minus the farming valleys)was covered in cameras. It screams legal action is waiting. I'd love to feel safe and that we don't need to monitor...if data backs up that crime is up, Let's NOT put cameras everywhere... Senior Center Remodel: • Senior center needs to raise it membership fee and raise awareness through social media of its existence and programs. Perhaps do fundraisers or something to generate income to be more self sustaining. Our seniors in Eagle deserve a space that shows them we as a community care about and value them. Something with natural light,comfortable spaces to be together,and a functional kitchen that can be used for senior events. • get a better location and building for seniors in Eagle • It needs a remodel • Rent it out in Non-Peak times to generate money to cover maintenance costs. There are many groups looking for meeting space that could use local restaurants or food truck thus generating more income. Why let public buildings with large spaces go empty? Downtown: 1st Street Festival Street: • goes hand in hand with improvements in "transportation" section. • This will be a great draw for Eagle,and I came from Campbell, CA. Perhaps the best overall redevelopment of a downtown I've ever seen over the last 15 years. This will provide a place for culture events(Basque, Bicycling Festival-LIVE MUSIC- like a gathering for an annual 10K- 50K 100K events-Halloween-Christmas in Eagle)that will drive business in downtown. HUGE Fan of this. If done right...Painted street, Square-water-outdoor dining along the edge. (Like Caldwell square-river walk/lights,music...) • I'm not sure this is a necessity. Downtown Facade Program: • Anything to beautify downtown! Make grants for non-historical buildings also, such as the car repair shop. Add planters. Unify signage type and theme for all businesses. Use the Eagle. Make it more cohesive to become a destination, and attract high end business. • Make matching funds available for non-historic buildings. A plan.And marketing campaign to make downtown Eagle signs,murals, awnings and landscape have a similar look/feel to blend the existing old and new styles • we need to maintain the unique characteristics of the historic Eagle,not allow it to become just like any town USA. Downtown Public Parking • Parking is not a concern in downtown Eagle. • Make it part of a mixed use project • This one I'll leave to the mayor and council to choose to fund. I'm unsure if the study produced the best results. • If we want the downtown to attract more businesses and people,we need more and better parking. Eagle Road Arch Sign • we already have one • It looks fine as is. Traffic needs to be funneled away from this portion of Eagle rd.towards the other"village" areas of Eagle. Entry Sign Placement • Please put one at Eagle and Chinden where Eagle begins,not at Eagle and 44.Add more of them at all entry points. • let developers move that sign, since they are surely looking to use that land. Idaho Street Streetscape Improvements • Fix State Street first. Unify the look with State Street and Aikens, so it's all one area. • Will need this, but wait until later. After 5 year plan • Have a consistent look from State St to Idaho St. To help establish the boundaries of downtown Sidewalk Repairs Downtown • Beautify Downtown • I few of the downtown sidewalks are in bad shape.It would be a shame to get sued for twice(or more)the amount to repair them Parks&Recreation All Weather Trail • Pretty please! I'll donate more! • Volunteer-Trail maintenance crew could tackle this.There are plenty of bikers to do this. https://santacrurtrails.org/about-Non-profit group that did AMAZING work • I'm more inclined to advocate keeping the trails in this park"natural"without concrete deposits. People need to appreciate the cycle of seasons and stay off trails when muddy. I could envision more trail stewards out educating people about trail respect and low impact. Bike Skills Park Expansion • it seems to be adequate for the demand right now. Charlie Wood Park • no new parks on the east side of Eagle Rd until one or more neighborhood placed parks are installed on the west side of Eagle Rd. you have stripped the west side park and replaced it with future parks all the way over at hwy 16, not acceptable to me as a taxpayer who funds local recreation with HOA dues and no public parks. • Would be great to have food trucks and'area' for people on greenbelt. Will bring$$up to Eagle business-when people say "hey, let's ride the greenbelt to get Tacos and a beer at the Eagle Ancona Food Truck park"but maybe private industry can do that. OR Eagle,just gets the land prepped-grating and paving or planting a low maintenance grass... and the food/retail shack business kick in the rest. $100K sounds better. Capital Plan Balancing Tool Comments by Project 6-8-2021 Pamela Baker Park • east of Eagle Rd should have no more parks until west side parks are built. • This would be a great addition to the City of Eagle. The location of the park provides a clear view of the foothills and easy access to the green belt. • We have more parks,parks and more parks. Unless the city council and mayor think we need to include this, let's pass for now. Regional Sports Park • keep it on the outer fringe of the city to minimize traffic,noise and light pollution. • We need a baseball/softball facility for our youth!! • Pocket parks are good,but there is a need to secure large spaces to provide green areas before the developers build more houses • This is desperately needed. This should be a priority. • Would be a NICE thing. Family- sports-community-memory maker. Being that 5-year old who grows up riding their bike and all the memories they make when they look back at 18 holding hands with the boyfriend/GF. NEEDS to be shared cost-and well lit-with a good sales shack to drive revenue or food/beer/merch. And a PA system that works-HELLO and Welcome to the Eagle's Nest sports center! ....The pirates vs the Eagles on Field 2 -also see your favorite 5-year old on the jungle gym! Our kids are scattered all over for sports in Meridian or Star. They need their own facilities. • We should develop smaller parks throughout the city instead of this huge one. So the kids can have parks in their neighborhoods. It would also eliminate the need for large parking lots at the huge park. Trailhead Amenities • This is the best outdoor/bike/rec facility-Institute volunteer work days for trail maintenance/creation if necessary. But no need to spend so much fixing a parking lot. I've been to most'bike'parks,and they are dirt. save the$$ • Bathroom? • there is already a parking lot and other facilities. Velodrome • Too much for too little • There was one in San Jose. Great for a Small group,hardly used. Would be nice East of Beacon Light and Eagle, or on 55 near Golf Course-one day...visible from Highway to attract a Biking community. Seems like a Corporate Park with a name-paid for by Corp. (if ever) • Absolutely not, it is not practical and is on the East side of Eagle Rd. West Side Park • Eagle's population is growing to the North West and parks with Ballfields need to be planned so citizens can recreate on this side of the City without traveling into the interior of the City. a Recreation facility in this area will also lessen the crowds and the now overused Parks. Eagle Road Ped/Bike Bridge • Very Needed! • a Must! • Shouldn't the$600k the city would have to reimburse COMPASS be subtracted from your$10 million budget if you vote "No"? Also, since the city's share of the total project cost is only a small percentage of the overall cost, subtracting$1.8 million when you vote "Yes"doesn't seem correct. • Finish the project. It looks great, is partially funded and will make the bikers happy • I would rather see a ped/bike bridge OVER Eagle road, so those living north of 44 could access the greenbelt in a safe manner. Channel Center Trail • So, if Dennis gave it to Eagle,and we pay for maintenance...is this $315K annual maintenance? or what is the cost for this? Plans& Studies Community&Performing Arts Center • Why take business from existing small business and location? Rent space as needed and collaborate with existing locations • Our community needs a performing arts center. I have children who have to travel all over the treasure valley for performing arts. We have enough interest in our community to complete this project. Local businesses in the arts would also benefit. To have a performing arts facility nearby would also benefit our local schools, strengthen and create a sense of community for locals. Please,please,please consider adding a performing arts center before all the land gets bought out by storage unit facilities and apartment complexes! Finally looking at equestrian access along the Greenbelt/river is long overdue. Excess Right of Way on State Street • Anything to beautify downtown. Floating Feather Ped/Bike Gap Study • All of our roads in Eagle should have appropriate bike lanes,because of the accessibility we have to Eagle Bike Park and the foothills. If we want to promote outdoor living,clean energy, and a healthy lifestyle we must improve our roads and bike lanes. Grade Separated Crossing of SH-44 • This would be amazing! Motocross Study-Foothills • Is there anything I can follow on this issue? S.Channel Boise River Bridge(Eagle Road) • We need one at this end of town also. Lots of bike riders here.
