Minutes - 1993 - City Council - 12/28/1993 - RegularEAGLE CITY COUNCIL ~ETING Dec~er 28, 1993 Pre Council: The Planning and Zoning report was given by Mary Berent. Jim Murray presented some concepts to the new city hall project. He will chair a committee to study the needs. He asked for committee volunteers. Mary Berent volunteered. Other suggestions were members from Eagle Quest and Eagle Chamber of Commerce. The Sewer District report was given by BASTIAN. The Eagle City Council met in regular session on December 28, 1993. Mayor GUERBER presiding. The following members were present: RICK YZAGUIRRE, THOMAS EASON, STAN BASTIAN. Absent: KELLI BLAIR. Moved by YZAGUIRRE and seconded by EASON to approve the minutes of the December 7, 1993 meeting as presented. ALL AYE: MOTION CARRIED. Moved by BASTIAN and seconded by YZAGUIRRE to approve the minutes of the December 14, 1993 meeting as presented. ALL AYE: MOTION CARRIED. PUBLIC HEARING/RICKS RIVER RIDGE ESTATES SUBDIVISION: Mayor GUERBER announced that this was the time and place set for a public hearing on Ricks River Ridge Estates Subdivision, a preliminary plat. Applicant: Craig VanEngelen Location: 747 W. State St, Eagle SW1/4 SE 1/4, S8, T4N, RIE BM. Proposal: R5 zoning, 15.6 Acres, 53 building lots, 3 common lots, gross density 3.4 units per acre. Rick Roe and Craig VanEngelen outlined the project to the Council. The property will be fenced with a 6 ft. cedar fence. There will be berms and curbs, gutters and meandering sidewalks at the State St. side, including park benches. The pathways will be paved with black top or concrete. The sidewalks on the State St. side will be concrete. Public Testimony: Helen House Concerns of the public: safety of children Public hearing closed at 7:40 p.m. Moved by YZAGUIRRE and seconded by EASON to approve the preliminary plat as presented with the following conditions: 1. The City of Eagle Standard Subdivision Conditions of Approval and the recon~nendations of the City Engineer 2. Installation of meandering sidewalks, street lights, curbs, gutters, sidewalks, trees and irrigation designed to the downtown street standards 3. A buffer on the south side of the subdivision as a barrier to the alternate route, noise, etc. 4. Installation of a pressurized irrigation system ALL AYE: MOTION CARRIED. PUBLIC HEARING/Curlew Subdivision Mayor GUERBER announced that this was the time and place set for a public hearing on Curlew Subdivision preliminary plat. Applicant: Location: Proposal: Monte Silliman, Walnut Creek Partnership SE of intersection of N. Edgewood lane and Hill Rd R4, 7.0 acres, 27 buildable lots 1 common lot, gross density 4.0. Public Testimony: none Public hearing closed at 7:50 p.m. Moved by BASTIAN and seconded by YZAGUIRRE to deny the preliminary plat based on a lack of amenities, the layout of the plat is not acceptable and not in harmony with the character of the City of Eagle as far as esthetics. AYE: BASTIAN, YZAGUIRRE. NAY EASON, MOTION CARRIED. PUBLIC HEARING/Meridian School District - CUP Application Mayor GUERBER announced that this was the time and place set for a public hearing on the Meridian School District #2 application for construction of a middle school in Eagle. Applicant: Location: Proposal: Meridian School District #2 N side of Floating Feather Rd, between Eagle Rd and Ballantyne Middle School - 1,000-1,100 students, 130,000 Sf. lighted parking lot for 225, bus drop off/fire truck Rd, 6 tennis courts, 2 football fields, 4 soccer fields, 3 softball fields and 1 baseball field. Farmers Union Canal will be used for irrigation, but may be supplemented by domestic water. 2 Public Testimony: Christine Donnell, Jim Murray, Terry Scanlan, Dan Mabe, Eleanor Chase, Jack Peterson, Sandy Smith, Carol Compe, Floyd Calhoun, Bill Cohen. Concerns of the public: Public testimony included inquiries regarding portable classrooms, water source, traffic light, availability of the outdoor recreation facilities to the public. Public hearing closed at 8:35 p.m. Moved by EAS0N and seconded by YZAGUIRRE to approve the Conditional Use Permit application by Meridian School District #2 subject to the following conditions: 1. The right of way of the Road will be 45 ft. to the N. and all other ACHD requirements 2. An application for the portable classrooms will be brought before the City Council as a CUP application prior to erection at the site. 3. This application is subject to the approval of the Design Review and Landscaping Committee. ALL AYE: MOTION CARRIED. The City Clerk was asked to write ACHD regarding investigation the possibility of placing a traffic light at the intersection of Eagle Rd and Floating Feather Rd. PUBLIC HEARING/LID-(Local Improvement District 91-1) Mayor GUERBER announced that this was the time and place set for a public hearing on the Notice of Hearing on Assessment Roll for the LID. Public Testimony: Lyons Elaine Jensen, Don Crawford, Sandy Smith, Joan Written testimony received from: Rick & Sandy Smith, Joan Lyons, Virgil Anderson. Concerns of the public: a drain guard filled with gravel was promised in front of Lyons Plumbing, delays in the project, no lights or trees in front of Crawfords Auto. The City Engineer agreed to meet with Lyons Plumbing on the drain guard prior to the next Council meeting. Moved by YZAGUIRRE and seconded by EASON to continue the until the January 11, 1994 meeting to deliberate on the testimony given. ALL AYE: MOTION CARRIED. hearing public 3 APPOINT~ENTS: Mayor GUERBER presented the appointment of Nancy Merrill to the Planning and Zoning Commission formerly held by Pauline Hinman for Council consideration. Moved by EASON and seconded by BASTIAN that approval be given to the appointment. ALL AYE: MOTION CARRIED. UNFINISHED BUSINESS: RECREATION CONTRACT ARD POLICY Moved by BASTIAN and seconded by YZAGUIRRE to continue the item to the January 11, 1994 Council meeting. ALL AYE: MOTION CARRIED. OLD BUSINESS: Lexington Water System: Lexington developers, Dwayne Stickle and Bert Bradley asked the Council to expedite the transfer of ownership of the Lexington Water System from the City of Eagle to Lexington. The developers advised the Council that the Eagle Sewer District informed them the District was not interested in purchasing the water system. The developers agreed to provide the City with the same warranty coverage with any claims against the City, and, will provide insurance coverage for at least a 2 year "named insured" on the transfer documents. Moved by YZAGUIRRE and seconded by EASON to continue the discussion until the January 4, 1994 Council meeting. ALL AYE: MOTION CARRIED. CLAIMS AGAINST THE CITY: Moved by BASTIAN and seconded by EASON to approve the claims as presented. The line item on Capital Expenses-Equipment was increased from $5000.00 to $5700.00, the additional $700.00 will be used to upgrade the one remaining computer in the office. ALL AYE: MOTION CARRIED. The City Engineer asked approval to amend the Subdivision Standard Conditions of Approval to include a condition of a plat regarding the curb, gutters and sidewalks. The Council agreed to the change.
