Rich 2016- 012899 BOISE IDAHO Pgs =2 BONNIE 02/16/2016 03:44 PM EAGLE CITY NO FEE IIIIIIIIII I III 'IIIIIIIIIIIIIIIIIIIIIIIIIIIIII � III 00194189201800128990020024 RESOLUTION No. 16 -11 A RESOLUTION OF THE EAGLE CITY COUNCIL TO VACATE A PORTION OF THE PUBLIC UTILITY, DRAINAGE, AND IRRIGATION EASEMENTS FROM LOT 20, BLOCK 1 (RENOVARE SUBDIVISION PHASE 1) AS SHOWN ON THE ATTACHMENTS HERETO; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, MDG, LLC, represented by Kirsti Allphin with KM Engineering, requested a vacation to the final plat of Renovare Subdivision Phase 1 to vacate a portion of the public utility, drainage, and irrigation easements from Lot 20, Block 1 ( Renovare Subdivision Phase 1); and WHEREAS, On January 4, 2016, the Planning and Zoning Commission recommended approval of the vacation (VAC- 03 -15), with conditions, to the City Council; and WHEREAS, Legal notice of the City Council hearing on the vacation was published in the Valley Times on January 11, 2016, and January 18, 2016; and WHEREAS, On January 26, 2016, the City Council held a public hearing on the proposed vacation (VAC- 03 -15), and voted to approve the vacation with conditions; and WHEREAS, The City Council hereby finds that the proposed vacation complies with the provisions of Section 50 -1306A of the Idaho Code, "Vacation of Plats - Procedure ", and Section 9 -6 -2 of Eagle City Code, "Vacations and Dedications." NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF EAGLE, IDAHO. The Eagle City Council hereby vacates a portion of the public utility, drainage, and irrigation easements from Lot 20, Block 1, of the final plat of Renovare Subdivision Phase 1, as considered, heard, and approved by the Council at its January 26, 2016, public hearing for application number VAC- 03 -15, and as shown on the attachments hereto (Exhibit A). This Resolution shall be in full force and effect immediately upon its adoption and approval. ADOPTED by the Council of the City of Eagle, Idaho, this 9th day of February, 2016.
