Minutes - 1993 - City Council - 11/09/1993 - RegularEAGLE CI~f COUNCILMEETING Minutes Nove~nber 9, 1993 Pre-Council: The law enforcement report was given by Lt. Dale Woodcook, Ada County Sheriff's Office. The Senior report and Parks report was given by BLAIR. The park playground equipment should arrive in approximately 4 weeks. The City Clerk asked consideration be given to reviewing the ACHD Impact Fee Agreement and implementing the collection of fees through the City. The Eagle City Council met in regular session on November 9, 1993. Mayor GUERBER presiding. The following members were present: STAN BASTIAN, KELLI BLAIR. RICK YZAGUIRRE, THOMAS EASON, Moved by YZAGUIRRE and seconded by BASTIAN to approve the minutes of the October 26, 1993 meeting as presented. ALL AYE: MOTION CARRIED. PUBLIC HEARING/FALL CREEK SUBDIVISION (continued) Mayor GUERBER announced that this was the time and place set to continue the hearing for Fall Creek Subdivision. He closed the public portion of the hearing and provide rebuttal time for the developer to speak to this issue. Dennis Baker asked for an extension of time in order work on a plan for expansion of lot lines, making the subdivision less dense. Discussion by Council regarding air quality, pressurized irrigation and density resulted in a motion by EASON and seconded by YZAGUIRRE to continue the matter for 30 days from November 9 in order to work out some compromise on the Fall Creek development. ALL AYE: MOTION CARRIED. The special meeting was scheduled for December 7, 1993, 7:30 p.m. Discussion took place regarding consideration of a moratorium on new development in order to take the time to review the Subdivision Title for amendments. The issue would need to be scheduled for an action item on a future agenda and should be accompanied by a Resolution declaring a moratorium and clarification of the intent of a moratorium. A workshop to discuss the need of a moratorium should be held prior to scheduling the matter on an agenda as an action item. Pathways, open space, and a definition of ,,rural" needs to be defined in ordinance form. Moved by E~ON and seconded by BASTIAN to establish a workshop on this matter for Tuesday, November 16, 1993, at 7:30 p.m. ALL AYE: MOTION CARRIED. PUBLIC HEARING: BOSANKA SUBDIVISION PRELIMINARY PLAT: Mayor GUERBER announced that this was the time and place set for a public hearing on Bosanka Subdivision Applicant: Location: Proposal: Mark and Nick Guho 385 W. State St (approx 1200 ft W of Eagle Rd. Subdivision preliminary plat 7.37 acres, 30 single family dwelling lots, density 3.76 lots per acre Public Testimony: no opposing testimony. Testimony in favor received from Bill Cohen and Francis Transtrum. Public hearing closed at 8:05 p.m. Moved by EASON and seconded by BLAIR to approve the preliminary plat for Bosanka Subdivision conditioned on the standard conditions, plus additional landscaping, and installation of curb, ~utter and street lights in like manner as the downtown construction and to grant a waiver on the length of the culdesac. AYE: BLAIR, EASON. NAY: YZAGUIRRE, BASTIAN. MAYOR GUERBER: AYE. MOTION CARRIED. ORDINANCES-RESOLUTIONS: Moved by YZAGUIRRE and seconded by BASTIAN to dispense with the three day ruling and to consider Ordinance 230 at this time. ALL AYE: MOTION CARRIED. Moved by YZAGUIRRE and seconded by BASTIAN to adopt Ordinance 230 an Ordinance relating to street improvements; enacting new section 8-3-6, Eagle City Code, to establish performance standards for improvement of curbs, gutters, sidewalks, pavement match, lights and trees along State Street and Eagle Road within the Eagle City limits. ALL AYE: MOTION CARRIED. EDGEWOOD SUBDIVISION-FINAL PLAT PHASE 2 AND 3 Moved by EASON and seconded by BASTIAN to approve the final plat for phase 2 and 3 with the standard conditions and previous conditions imposed on Phase 2. ALL AYE: MOTION CARRIED. ANIMAL SERVICE AGREEMENT, ORDINANCE AND RESOLUTION: Moved by EASON and seconded by BLAIR to continue to the next scheduled Council meeting in order to give the City Attorney time to meet with the representatives of the Idaho Humane Society and agree to terms of the agreement. ALL AYE: MOTION CARRIED. LID: This is the companion resolution to the LID, the 3 Disperent properties not on the LID Assessment role that will be assessed. This needs to be continued until we get that matter resolved. We can proceed with the assessment role public hearing on the LID. After receiving a certified report from the Engineer detailing all costs. Following the hearing we will finalize the assessments which will bring it to a closure. We need the authorization to proceed with the hearing on the LID assessment. Moved by BASTIAN and seconded YZAGUIRRE to proceed with the hearing. ALL AYE: MOTION CARRIED. Moved by BASTIAN and seconded by YZAGUIRRE to proceed to hearing for assessment role. ALL AYE: MOTION CARRIED. ATTORNEY'S REPORT: The street lights insurance coverage was continued until the next Council meeting. CLAIMS AGAINST THE CITY: Moved by YZAGUIRRE and seconded by BLAIR to approve the claims as presented. ALL AYE: MOTION CARRIED. Moved by YZAGUIRRE and seconded by EASON to authorize the Mayor to execute the Sheriff's contract, on a 40 hour a week basis for a specific deputy for Eagle, for the upcoming year. ALL AYE: MOTION CARRIED. The City Engineer requested a letter to the State of Idaho Dept. of Transportation, that he will write, regarding a ITD right of way on the Bosanka property. The developers of Bosanka would like to landscape that area. ITD has no objections, but the developer would like a letter from the City granting permission to abandon the right of way.
