Minutes
1. CALL TO ORDER: Meeting called to order at 6:03 P.M.
2. ROLL CALL: Present: WRIGHT, GUERBER, MCCAULEY, SMITH. Absent:
MCLAUGHLIN. A quorum is present.
3. CONSENT AGENDA:
♦ Consent Agenda items are considered to be routine and are acted on with one motion. There
will be no separate discussion on these items unless the Chairman, a Commissioner, member
of City Staff, or a citizen requests an item to be removed from the Consent Agenda for
discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in
a sequence determined by the Rules of Order.
♦ Any item on the Consent Agenda that contains written recommendations from the City of Eagle
shall be adopted as part of the Planning & Zoning Commission's Consent Agenda approval
motion unless specifically stated otherwise.
A. Minutes of May 3, 2021.
Smith moves to approve the consent agenda as written. Seconded by McCauley. ALL
AYES... MOTION CARRIES.
4. UNFINISHED BUSINESS: NONE.
PUBLIC HEARINGS:
A. ACTIONITEM: A-12-20/RZ-16-20 & PP/FP-01-20 — Spartan Estates Subdivision — Clark
Mahy: Clark Mahy, represented by Stephanie Leonard with KM Engineering, LLP, is
requesting an annexation, rezone from RUT (Rural -Urban Transition — Ada County
designation) to R-E-DA (Residential Estates with a development agreement) and combined
preliminary and final plat approvals for Spartan Estates Subdivision, a 2-lot residential
subdivision. The 4.69-acre site is located at 2635 North Meridian Road. (DLM)
Stephanie Hopkins, KM Engineering, 5725 North Discovery Way, Boise, ID 83713. Hopkins
provides a detailed overview of the application.
Hopkins responds to questions from the Commission.
City Planner, Daniel Miller, provides a detailed overview of the application.
Miller responds to questions from the Commission.
Chairman Wright opens the Public Hearing.
Clark Mahy, 2635 North Meridian Road. Mahy, the property owner and applicant, explains his
vision for the property and explains his background.
Steve Walther, 2650 North Meridian Road. Walther explains the history of his property, describes
the existing sidewalk on his property, describes fencing in the area, and states his support for the
application.
Commissioner Smith states that Mr. Walther is his former neighbor, and that will not influence his
ability to make a fair decision.
Walther responds to questions from the Commission.
Stephanie Hopkins, the applicant's representative, responds to topics discussed during the Public

Hearing and provides rebuttal.
Hopkins responds to questions from the Commission.
Clark Mahy, the applicant, responds to questions from the Commission.
Chairman Wright closes the Public Hearing.
Discussion amongst the Commission.
City Attorney, Victor Villegas, provides input regarding the options for waiving the requirement
for sidewalks.
City Planner, Mike Williams, provides input regarding possible options for a motion based upon
the Commission's deliberation and the City Attorney's input.
Discussion amongst the Commission.
McCauley moves to recommend for approval item 5A A-12-20/RZ-16-20 & PP/FP-01-20 —
Spartan Estates Subdivision — Clark Mahy with the following exceptions: that site specific
condition of approval #9 not be included if the applicant can provide an alternative method
of compliance, same with site specific condition of approval #10 that the applicant provide an
alternative method of compliance, that site specific condition of approval #14 be stricken all
together, that site specific condition of approval #17 be revised so that the landscape buffer
is included in an easement, and that site specific condition of approval #18 be stricken if the
applicant can provide an alternative method of compliance, and that we waive the
requirement for pressurized irrigation.
Seconded by Guerber.
City Planner, Mike Williams, requests clarification regarding the motion.
Discussion amongst the Commission.
McCauley amends the motion as follows: "Strike site specific conditions of approval #9, #10,
and #18 altogether from the conditions required for approval. The rest of the motion would
include the fact that site specific condition of approval #14 is also stricken from the
requirement and that site specific condition of approval #17 provides an alternative method
of compliance and that alternative method would be that the landscaping buffer be included
as an easement instead of as a common lot. It would be a landscape buffer in an easement."
Seconded by Guerber. ALL AYES... MOTION CARRIES.
6. NEW BUSINESS: NONE.
7. REPORTS:
A. Commission: Commissioner Smith thanks City Attorney, Victor Villegas, for allowing the
Commission to have a complete discussion regarding the motion prior to the City Attorney
providing input.
B. City Attorney: City Attorney, Victor Villegas, provides an overview of the Conservation
Education Program (CEP).
C. Staff- City Planner, Mike Williams, informs the Commission that there will be a number of
public hearings on the June 7`h agenda.
8. ADJOURNMENT:
Smith moves to adjourn. Seconded by Wright. ALL AYES... MOTION CARRIES.
