CALL TO ORDER: Mayor Reynolds calls the meeting to order at 5:00 p.m. 2. ROLL CALL: MCFARLAND, BUTLER, KUNZ, RIDGEWAY. All present. A quorum is present. 3. PLEDGE OF ALLEGIANCE: Mayor Reynolds leads the Pledge of Allegiance. 4. ADDITIONS. DELETIONS OR MODIFICATIONS TO THE AGENDA: McFarland moves to change the order of the Consent Agenda with the Executive Session. Seconded by Butler. Discussion. ALL AYES: MOTION CARRIES........... PUBLIC COMMENT: This time is reserved for the public to address their elected officials regarding concerns or comments they would like to provide to the City Council regarding subjects not on the agenda. At times, the City Council may seek comments /opinions regarding specific City matters during this allotted time. This is not the time slot to give formal testimony on a public hearing matter, or comment on a pending application or proposal. (1) An executive session at which members of the public are excluded may be held, but only for the purposes and only in the manner set forth in this section. The motion to go into executive session shall identify the specific subsections of this section that authorize the executive session. The mere presence of legal counsel at an executive session does not satisfy this requirement; Mayor introduces the issue. UNFINISHED BUSINESS: A. Review and Action on Eagle Master Park and Pathway Plan with requested changes: (MA) Mayor introduces the issue. Park/Rec Director Aho: This is coming before you again as there were a couple of changes that you asked for in the previous meeting. I'm going to invite Bob Shaffer up to point those out to you. Bob Shaffer, the Land Group, we are following up from the last meeting on the plan and we took note as to your concerns. Displays a power point and discusses the proposed revisions concerning the budget and costs. General discussion. Kunz: I have not had time to review these sections in detail so my personal preference would be to table action until the Unfinished Business at the next Council meeting in hopes of being able to review this in a little more detail. Resolution 15 -27 — One Year Moratorium on Business License Requirement: A resolution of the City of Eagle, Idaho, declaring Title 3, Chapter 1 of the Eagle City Code to be in a moratorium for a period not to exceed 365 days; and providing for effective date. Volunteer of the Month — December: The City of Eagle recognizes the importance of volunteerism and is taking a moment to thank those who selflessly give of themselves to the community. A plaque will be displayed in the lobby recognizing these outstanding volunteers. 1. Pam Kelch: Pam Kelch has been a volunteer for the Eagle Historical Museum for 6 years and has been an integral part of the volunteer staff. Pam has put in countless hours over the years, helping with archives, displays, and museum - sponsored events. Pam and her husband, Steve, moved to Eagle from California after they both retired from their careers as police officers. Pam is also an active member of the Assistance League of Boise and enjoys volunteering her time to help others in need. The City of Eagle in indebted to Pam for her dedication and service. As a volunteer she does this from her heart, expecting nothing in return. Her tireless spirit and giving attitude are what helps our City grow. Mayor introduces Pam Kelch, thanks her for her service to the City of Eagle and presents her with a plaque and a Proclamation declaring December 16, 2015 as Pamela Kelch Day in the City of Eagle, Idaho. B. 1" Annual Shining Star Award 2015: This award honors an individual or group who have made in- depth, long -term volunteer contributions to the City of Eagle over the years and are active, involved, interested and enthusiastic about making the City a nice place to live and work. 1. Don Stockton: The inaugural presentation of this award is given to Don Stockton. Don has been involved in the enhancement and expansion of the Eagle Park and Pathway system for over twenty years. Prior to his retirement, Don worked for the Idaho Department of Lands and was able to translate his professional expertise into an invaluable asset to the people of Eagle. From his participation in the initial design of Reid W. Merrill, Sr. Park to pathway easement identification - Don has volunteered hundreds of hours to the community he calls home. Thank you for helping make Eagle a great place to live— you are truly a Shining Star to us! Mayor introduces Don Stockton, congratulates him on receiving the City of Eagle's Shining Star award and presents him with the Shining Star. C. BAMBA would like to recognize the City for its support of biking in Eagle. (MM) Mayor introduces the issue. Reid Peterman and Bill Reed, we are both part of BAMBA and we like to specialize in the Bike Park at the Sports Complex. Mike Aho and Steve Noyes have worked tirelessly out there. We would like to recognize the outgoing City Council Members, Mark Butler and Mary McFarland, and Mayor Reynolds with a plaque. Reid Peterman presents the City with the Golden Sprocket Award. Canvas Votes for 2015 General Election: Acceptance of November 3, 2015 election results as canvassed by the Ada County Commissioners: [I.C. §50 -412] Mayor introduces the issue. Kunz moves that the City of Eagle approve the November 3, 2015 election results as canvassed by the Ada County Commissioners. Seconded by Butler. ALL AYES: MOTION CARRIES .................... Ridgeway: With the election results the public probably realizes that that there were only 21 votes between the #2 and #3 top vote getters. When I am sworn in as Mayor there will be a vacancy on the Council and when I am sworn in it is my plan to recommend to the City Council at that time Craig Soleberg who was 21 votes behind Naomi Preston. I think that the citizens of Eagle made that decision and I am going to push that forward. 6. CONSENT AGENDA: ♦ Consent Agenda items are considered to be routine and are acted on with one motion. Butler: Item #A on Public Hearings which is a Conditional Use Permit — CU -11 -15 for Coleman Homes, is there anybody here to testify on the first public hearing other than the applicant? Seeing none, if the applicant is okay with the Site Specific and Standard Conditions of Approval as recommended by the Planning and Zoning Commission, I will probably make a motion to move this to the Consent Agenda. Becky McKay, representing the Applicant, I do,have a problem with one of the conditions, just a minor issue. Butler: Okay we will leave it on the Agenda. Butler: the other one that could possibly be moved to the Consent Agenda is Item #F which is a Rezone, RZ -14 -06 Modification of a Development Agreement for Riverside Drive Eagle and this is in Eagle Lots Subdivision which is approximately 300' east of East Shore Drive at 827 East Riverside Drive. Is there anybody here in the audience other than the applicant to speak in favor or against this application? Seeing none, if the Applicant is here and if they would identify themselves and let us know if they are okay with the Site Specific and Standard Conditions of Approval as recommended by the Planning and Zoning Commission. Butler: Becky and I have been talking because I am working on a project in Star on my personal business but this does not have anything to do with application and there is no basis. Kunz: the other thing I would note for the Public Record regarding Agenda Item #9E, the East End Marketplace Comprehensive Plan Amendment, that the Applicant has also approached the Eagle Urban Renewal Agency with a proposal for reimbursement from tax increment revenues. So the Urban Renewal Agency members have had some interactions with the applicant in that regard. Mayor: Does anyone on Council have any potential or actual conflict of interest? None A. My problem with this is that I can only have 3 lots and he can have 8 buildable lots on the same amount of property. I can go to the County or annex into the city. Discusses the traffic. Butler moves to approve A- 04- 15/RZ -09 -15 & PP/FP -01 -15 — Garrigan Estates Subdivision No. 2 for George and Leigh Brecht with the following amendments to the Conditions of Approval recommended by the Planning and Zoning Commission: the second 3.3 in the Development Agreement be modified so that Item A in that sentence states solely this "a maintenance manual for the private street requiring the Associations shall have the duty to maintain and operate the private street including repair as is necessary in perpetuity ", B be stricken, C remain, that the Development Agreement be modified so instead of saying 3.3 twice the second 3.3 is labeled 3.4, that on the Standard Conditions of Approval Item #2 which says comply with all requirements of the City Engineer say "except as provided for herein" in these Site Conditions of Approval, that Item #12 regarding street lights be stricken, Item #14 regarding street trees be stricken, Item # 15 regarding Design Review review be stricken, a new Item #18 be added that says "the note on the Plat that refers to Lot #6 instead of saying "it shall be maintained by George and Leigh Brecht, it shall be maintained by the owner of said Lot #6 ", that new #19 be provided saying the utility easements shall be 10' and not 12', a new #20 be added: the applicant Page 7 KACOUNCIUMWUTEMTemporary Minutes Work Area \CC- 12- 15- 15spmtgmin.doe shall comply with all requirements of the Star Fire Protection Department and the applicant shall submit a letter of approval from the Star Fire Protection Department before the City Clerk signs the final plat, a new #21 that soils and geology and grading plan shall not be required for the entire subdivision but those necessary soils, geology and grading plans as determined by staff for each pad site shall be provided to the City for review at the time of building permit submittal for each home site. The 7.74 -acre site is located on the west side of South Edgewood Lane approximately 1,290 -feet north of East State Street at 103 South Edgewood Lane. C.1 RZ -03 -15 MOD — Modification to Development Agreement associated with the 43 -unit residential development (aka Crestpoint Place Subdivision PP- 09 -15) — JLG- 5, LLLP.: JLG -5, LLP, represented by Scott Noriyuki with Northside Management, is requesting a development agreement modification (development agreement in lieu of a PUD) to modify Condition of Development #3.8 to permit the applicant to file an alternative method of compliance application to seek a reduction in the required landscape buffer area width from 35 -feet to 20 -feet. The buffer area is located within the common lot adjacent to Edgewood Lane. The 7.74 -acre site is located on the west side of S. Edgewood Lane approximately 1,290 -feet north of E. State Street at 103 S. Edgewood Lane. This development agreement modification application (rezone) is associated with the preliminary plat for Crestpoint Place Subdivision, a 43 -unit (42 -new and 1- existing, 5.42 unit per acre) residential development. The rezone and development agreement application (in lieu of PUD) was approved by the City Council in advance of the subdivision preliminary plat. (WEV) Mayor introduces the issues. Kunz moves to approve PP -09 -15 — the preliminary plat for Crestpoint Place Subdivision - Northside Management with all of the Site Specific Conditions of Approval as stipulated by the Planning and Zoning Commission with the following correction: on Site Specific Condition of Approval #10 the entirety of it is to be stricken and replaced with the following language "Tree root barriers shall be required for all street trees located within the 6' wide planter strip ". CPA- 04- 15/RZ- 07- 15/PP -04 -15 — Stillwater Subdivision — Next Level Development, LLC: Next Level Development, LLC, represented by Kevin McCarthy, is requesting a Comprehensive Plan text amendment, rezone from BP -DA (Business Park with a development agreement) to MU -DA (Mixed Use with a development agreement in lieu of a PUD) and preliminary plat approvals for Stillwater Subdivision, a 94 -lot (60- residential, 12- live /work, 11- commercial, 1 -flex, 10- common) subdivision. The 39.7 - acre site is located on the south side of State Highway 44 at the southwest corner of West State Street and State Highway 44. Mayor introduces the issue. Corey Elitharp, representing the applicant, distributes a letter to the Council and provides Council an overview of the application. General discussion. Planner Baird- Spencer displays site plans and discusses the history of the property and the comp plan designation change. General discussion. Discusses the concerns the applicant has handed out to Council tonight in his letter. General discussion. Mayor opens the Public Hearing Patricia Kub, 2603 W. State Street, I live right next door to this property. The actual situation is that I have had water from the spring runoff and its winter and it is under water right now. The island that they are talking about is under water right now. Ben Kneadler, 6020 Shandee Drive, Meridian, I am a commercial real estate broker and I live on the edge of Eagle. Discusses market perspective demand. I believe a mixed use project fits in this area. We are having a hard time in Eagle delivering large office space. I support this project. Ed Priddy, 2475 W Brockton Ct., I want to say something about your staff; through all the projects that we have worked through, your staff is excellent and offers expertise. We are the current landowners, not the developers. This project offers a reasonable priced home on the river. There is an interest in live, work and play. I encourage you to vote yes tonight. Jared Luke, 125 N Stierman Way, when I was introduced to this project the live, work and play it fits right along with my business model. As a small business owner I have been looking for a new location and this project will provide me the opportunity to relocate and expand my business. Tyler Johnson, 3597 E. Monarch Sky Lane, I am a broker who brings buyers and sellers together. For the commercial to be viable you need residents. If you are going to create density it would be in this location. I think this project brings the right balance. I am in favor of this development and would encourage you to vote in favor of it. Theresa Johnson, 3417 N. Croft Way, the map that I saw showed one way in and one way out. This is a lot of residential to be served this way. We seem to be over burdened with residential. Jim McCulley, 3611 W. State Street, this is the first time I have seen the proposal and I am excited about the project. Comp Plan & Text Amendments We worked extensively with City Staff to produce appropriate text modifications to the Comprehensive Plan that would allow for our project as proposed. In light of this, we are in agreement with the recommended text changes delineated in the staff report and findings of the P&Z Commission. Rezone Conditions of Approval We are in agreement with the recommended conditions of approval and P&Z findings for the Rezone with the exception of the following: Condition 3.5: The P&Z Commission decision outlined in the staff report accurately captures the setbacks discussed at the hearing with the exception of those for the townhome product. As a part of the discussion to widen the common lots and pathway between the townhome and live/work buildings in Blocks 4 & 5, the commission agreed to grant 0' interior setbacks on the common lots. We would like to request that this setback be included for approval. Conditions 3.8 & 3.9: You have indicated that a fuel station and restaurant with drive-thru shall be permitted with an approval of a Conditional Use Permit. We would like to request that those uses be permitted as part of this approval and that a separate Conditional Use Permit not be required. Further, we would like to iterate that the site plan presently reflects 2 drive-thru facilities. We are requesting approval for both locations as a part of this application. Preliminary Plat Conditions of Approval We are in agreement with the recommended conditions of approval and P&Z findings for the Preliminary Plat with the exception of the following: Condition 8: You have recommended that we construct detached sidewalks for the street sections internal to the subdivision. Attached sidewalks have many benefits, which we will discuss further at the hearing. Some of these include keeping cars parked in driveways from encroaching into the sidewalk area and promoting continuity in design between commercial and residential areas. Further, detached sidewalks would significantly impact the buildable area of our lots. As we will demonstrate at the hearing, attached sidewalks can be designed in such a way to be aesthetically pleasing and functional. Therefore, we are requesting approval of attached sidewalks as delineated on the preliminary plat. 4 Condition 14: The P&Z Commission decision outlined in the staff report missed one of the lots that is proposed to take access via the common drive identified as Lot 14, Block 1. The discussion at the hearing was that 4 lots (Lot 13 and Lots 15-17, Block 1) will take access via the common drive. While the written findings captured 3 of those lots, the 4th was omitted. We would like to request that the 4th lot (Lot 13) be included in the approval language so that all 4 can access via the common drive. A number of conditions of approval require a revised preliminary plat, which has already been submitted to City staff.
