Minutes - 2021 - City Council - 04/27/2021 - Regular EAGLE CITY COUNCIL MEETING MINUTES April 27,2021 1. CALL TO ORDER: Mayor Pierce calls the meeting to order at 5:32 p.m. 2. ROLL CALL: Present: GINDLESPERGER, PITTMAN, BAUN, PIKE. All present. A quorum is present. 3. PLEDGE OF ALLEGIANCE: Mayor Pierce leads the public hearing. 4. ADDITIONS,DELETIONS OR MODIFICATIONS TO THE AGENDA: A. City Staff requests.None B. Mayor or City Council requests.None 5. PRESENTATION: A. Ada County Assessor's Office Presentation: Robert McQuade will present information regarding the new construction roll. Bob McQuade Ada County Assessor reviews information regarding the primary roll assessment, he notes that these are very preliminary numbers. Preliminary amount for total Eagle market value is 8.6 billion dollars up 34% from last year. The potential taxable value 7.7 billion dollars,which is a 38% increase from last year. Discusses the increase in commercial values. New construction value is $356 million dollars, an increase of 30% over last year. Tax burden 86.7% residential vs 13.3%commercial tax burden.Assessment notices will be mailed towards the end of May. B. Republic Services Report: Rachele Klein, Municipal Services Manager with Republic P P Services Idaho will present the Annual Report and provide updates on special programs and services. Rachele Klein 2130 W. Franklin RdMeridian, Idaho. Ms. Klein reviews the customer survey results. Provides an overview of the Education and Outreach programs they are currently implement or will be pursing as COVID restrictions ease. Discusses Commercial Recycling Contamination Fee, if there is<30%contamination rate of the bin,then a different truck has to be sent to empty the container. Customer Service representatives contact the commercial users and provide an educational information,but if after attempts to correct the usage of they would like the City to consider allowing the assessment of fees to send the non-recycling trucks out. Discusses grown in the number of customers, and participation in recycling, glass recycling and curbside composting.PowerPoint attached. 6. REPORTS: A. Mayor and Council Reports: Council member Baun reports on the BLM Work Group meetings. Parks Pathways Recreation Commission is working on bike lane standards for Eagle. Gindlesberger reports on the initial Animal Control meeting., as well as the Arts Commission meeting. The Commission has set dates for the Friday night flicks. Pittman states that he will be receiving a tour of the sewer facility expansion. B. City Hall Department Supervisor Reports: Director of Long-Range Planning and Projects, Nichoel Baird-Spencer reports on the Balancing Act program launch that was launched to facilitate public input on the Capital Plan. There have been changes to the Avimor meeting dates,that information will be forth coming. Planner III Mike Williams states that on the river bar project near the north channel bridge has been completed. This was done to address the sediment build up. FY2019-2020 Economic Development Report Presentation — Director of Economic Development Robin Collins reviews the annual report.Collins explains how the City had to develop a new approach to economic development due to the pandemic. Discusses public outreach via use of the City's website, the development of a mobile app, issuance of$450,000 of small business apps utilizing federal CARES Act funds. 2. City Treasurer,Financial Reports for March 2021 and quarter ending March 31,2021 C. City Attorney Report:Re ort: None 7. Gazebo Concert Series Live Performance Agreements: The Special Events/Saturday Market Coordinator is seeking Council approval of the Live Performance Agreements for artists performing at this seasons Gazebo Concert Series taking place the last Thursday of the month May through September.(PT) O. Mace Trail Underpass Mural Artist Agreements: The Special Events/Saturday Market Coordinator is seeing Council approval of the Mace Trail Underpass Mural Agreement. The project will be completed by two teams and the murals will be placed at the Eastern and Western entrances of the Mace Trail Underpass. Artist agreements will be entered into with Team Lead Traci Adams and Team Lead Jessie Nilo. The agreements will not exceed$7,500 each.(PT) P. Mr. Mihan will be serving a vacated term that will end in June 2023. *R.DR-09-21 — Common Area Landscaping and Building Architecture within Dovetail Condos — Guy Jones: Guy Jones, represented by Jessica Petty with 12.15 Design LLC,is requesting design review approval of the common area landscaping and building architecture within Dovetail Condos. The 1.58-acre site consisting of two lots (Lots 6&7,Block 2,Randall Acres Subdivision No. 15), is located on the north side of East Dunyon Street approximately 300-feet east of the intersection of East Dunyon Street and South Conover Street at 2056 and 2078 East Dunyon Street. Council is not inclined to remove item F, as it is not an item where public testimony is allowed, and Council has no edits to the findings as presented. ACTION ITEM: RZ-01-14 MOD — Modification to the Development Agreement associated with the Foxtail Senior Living Center—Foxtail Senior Living Center,LLC:Foxtail Senior Living Center, LLC, is requesting a rezone (development agreement modification and development agreement in lieu of a conditional use permit) to increase the number of residential assisted living units from 78 to 100 total units and to include a revised concept plan. The 4.64-acre site is located on the north side of West Chinden Boulevard approximately 1,300-feet west of the intersection of North Meridian Ro ad and West Chinden Boulevard at 2559 and 3600 West Bavaria Street.(MJW) Mayor introduces the item. Tom Lemon, Thurstead Architects 310 N. 5th St. Boise, Idaho representing Foxtail Senior Living Center. They are seeking an amendment to the development agreement to increase the allowed units to the 100 units. Planner III,Mike Williams reviews the staff report and reviews the staff proposed additions to the development agreement as well as the additions recommended by the Planning and Zoning Commission. Mayor opens the public hearing. William Hines,owner of Foxtail,he notes that the lights installed were what was approved by Eagle City Code. After testimony at the Planning and Zoning Commission one of the exterior lights has been modified to aim the light directly down to address testimony given. Mr.Hines displays photos of the modifications. NEW BUSINESS: * A.ACTION ITEM: Change Order No.2 Baer Design for State& Eagle Intersection Design: Greg Baer with Baer Design Group is requesting approval of Change Order No.2 to Task Order 19-03 in the amount not to exceed$1,600 to complete electrical engineering work to Provide Low- Voltage conduits to light pole bases for future utility by others(fiber). I would like to make sure the Foxtail Living Center provide shields for outdoor lighting so there is no direct light shining into adjacent properties and to minimize light overflow. It appears they have modified existing lighting so that the property to the west doesn't have direct light shining into the property. Last time I checked, I don't think they have addressed the light in the parking area. Please provide additional shielding to prevent direct light into the neighboring properties. They were also going to eliminate the noise caused by the door alarms. I am not sure if they have done that or not because I haven't been outside recently. Please make sure door alarms cannot be heard by neighboring properties. I am also concerned that they provide the proper landscaping care on the new development. I think they are doing a good job with what they have, I want to make sure they continue doing so. We would also like to make sure the north pathway is gated to public traffic (automobiles and motorcycles)and do not have access to park on the northern border.
