Minutes - 1993 - City Council - 05/25/1993 - RegularCITY COUNCIL 1993 Pre Councils A report was given on Planning and Zoning by Mary Berent. Ross Dodge, an APA Planner reported on the Ridge to Rivers Pathway Plan for ~laCounty, and asked for its adoption by Council in regular session. Barbara Montgomery, City Clerkreported on the inspection of the City Hall, Senior/Cr~lnity Center, Library and Parks by the Dept. of Industrial Labor. The department asks for a report from City Hall on inspection requests within 20 days. Barbara will approach Tal Trau~mAn on the fencing or tiling of the ditch in the OK park. The Eagle City Council met in regular session on May 25, 1993. Mayor GUERBER presiding. The following members were present: STAN BASTIAN, KELLI BLAIR. RICK YZAGUIRRE, THOMAS EASON, Moved by BASTIA/~ and seconded by YZAGUIRRE to approve the minutes of the May 11, 1993 meeting as presented. ALL AYE: MOTION CARRIED. UNFINISHED BUSINESS: Findings of Fact and Conclusions of Law/Ashland Acres, Rezone and Preliminary Subdivision Plat. Moved by YZAGUIRRE and seconded by BLAIR to approve the findings and conclusions as presented. ALL AYE: MOTION CARRIED. CRANDLEMIRE- REZONE FROM A-R TO R3 (continued) Applicant: Location: Roger Crandlemire N side of Floating Feather Rd., Ballantyne between Eagle Rd. and Ed Thomas, representative for Roger Crandlemire, asked for consideration of approval of a R2 zoning designation. He presented a conceptual subdivision plan to the Council, included in the plan was a school site, common area and larger lots to the N of the subdivision. Susan Wiebe, attorney for the City, in Mona Mack's absence, was asked to give an opinion on the 1990 Eagle Comprehensive Plan compared to the 1993 Eagle Comprehensive Plan, in relationship to this application. Which plan should apply? The opinion was that the 1990 Plan applies but to address the new plan as well. Moved by BASTIAN and seconded by YZAGUIRRE to accept the rezone as R1, gross acres, but to require a Development Agreement for a preliminary plat, to be executed upon a granted rezone. MOTION FAILED. After Council deliberation it was moved by BASTIAN and seconded by YZAGUIRRE to continue the matter until the June 8, 1993 meeting for decision in order to receive a legal opinion on the matter. ALL AYE: MOTION CARRIED. Moved by YZAGUIRRE and seconded by BLAIR to move item 5C, the municipal water bond election matter to item 10A in order to go into executive session regarding acquisition. ALL AYE: MOTION CARRIED. Moved by YZAGUIRRE and seconded by BASTIAN to continue the Idaho Humane Society proposal until the June 8 agenda. ALL AYE: MOTION CARRIED. Ada County Transmittal: 93-22-PDR/Baxterville Subdivision. Moved by BASTIAN and seconded by BLAIR to approve the Ada County Transmittal as presented with staff recommendations. ALL AYE: MOTION CARRIED. ISLAND WOODS FINAL PLAT, PHASE 2: Presentation was made by Steve Bradbury, Island Woods attorney and Dennis Baker, developer. Mr. Baker indicated that all permits for phase 2 would need floodplain permits just as phase 1 did. Moved by EASON and seconded by BLAIR to approve phase 2 as presented with Eagle City Subdivision Standards. ALL AYE: MOTION CARRIED. DESIGN REVIEW-BENNETT (GOLF MAGIC) Moved by YZAGUIRRE and seconded by BLAIR to approve the project, building, grounds and sign subject to the conditions recommended by staff. ALL AYE: MOTION CARRIED. ARBOR DAY PROCLAMATION: Moved by EASON and seconded by BLAIR to adopt the proclamation as presented. ALL AYE: MOTION CARRIED. Moved by YZAGUIRRE and seconded by EASON to adopt the Ridge to Rivers Pathway Plan for Ada County as presented in pre-council. ALL AYE: MOTION CARRIED. ORDINANCES-RESOLUTIONS: Moved by YZAGUIRRE and seconded by BASTIAN to dispense with the three day ruling and to consider Ordinance #219 at this time. ALL AYE: MOTION CARRIED. Moved by YZAGUIRRE and seconded by BASTIAN to adopt Ordinance #219 a rezone ordinance changing the zoning classification of the real property described herein from the R-1 (RESIDENTIAL DISTRICT) CLASSIFICATION to the R-4 (RESIDENTIAL DISTRICT) CLASSIFICATION; amending the zoning map of the City of Eagle to reflect said change (Ashland Acres Sub). ALL AYE: MOTION CARRIED. MAYOR'S REPORT: Mayor GUERBER reported on the proposed Albertsons news release to build a complex, and accompanying shops in the CBD District of Eagle. The developer intends to hold town meetings in order to get public input. ENGINEER'S REPORT-DOWNTOWN REDEVELOPMENT: The Eagle will be moved to the Flag Plaza soon. All of the streets need to be cleaned prior to Eagle Fun Days. COMMITTEE REPORTS: P&Z: BLAIR will introduce a public hearing policy at the next meeting. Parks: BLAIR is working on the playground equipment in order to replace or repair what is located there now. BLAIR will contact homeowners association in Eagle Ranch Subdivision regarding the subdivision sign and also the fencing problem in O.K. Park. Schools: BASTIAN reported the district is still checking on school sites. Library: BASTIAN reported the Library would be interested in moving into the Albertsons complex, the dream wish would be for 20,000 sq. ft. 10,000 ft would be acceptable. APA: YZAGUIRRE reported that the Alternate 55 route is in the 1994 planning year, not 1993. Eagle Quest: YZAGUIRRE said the Eagle Quest group is working with medical representatives on locating in the Eagle area. CLAIMS AGAINST THE CITY: Moved by BASTIAN and seconded by BLAIR to approve the claims as presented. ALL AYE: MOTION CARRIED. CLAIMS AGAINST THE CITY: Moved by YZAGUIRRE and seconded by EASON to approve the drawdown for funds for grant payment in the amount of $25,678. ALL AYE: MOTION CARRIED. Moved by YZAGUIRRE and seconded by EASON to adjourn to executive session to discuss acquisition of property. The City Council reconvened at 9:40 p.m. Moved by EASON and seconded by BASTIAN Attorney to negotiate with Eagle Water Co. company. ALL AYE: MOTION CARRIED. to authorize the City for the purchase of the An Ordinance will be introduced at the next Council meeting outlining the date of the election for a municipal water system. The City Clerk asked the Council to reconsider the motion regarding the Idaho Humane Society. The letter from them requests an answer prior to the next Council meeting. Moved by YZAGUIRRE and seconded by BLAIR to authorize the Mayor to sign the letter introduced tonight in answer to their request for the 1993-94 budget year. ALL AYE: MOTION CARRIED.
