November 17, 2015
PRE COUNCIL AGENDA:
Ada County Sheriff's Office Monthly Report: Chief Calley reviews the monthly report and
introduces Kristen Sapada and Deputy Amanda Wentz, two new additions to the Eagle Police
Department.
Mayor and Council Reports: No reports given
City Hall Department Supervisor Reports:
Park/Rec- Facilities Director Aho: Director Aho states the items discussed at the last meeting
regarding the Master Plan are being incorporated into the plan by The Land Group and hopes to
bring it back to Council for action in December. Discussion regarding the draft survey regarding
the market, and how to proceed with identifying the desire of Eagle's residents. Council
President Ridgeway will work with Director Aho to compose questions pertaining to an Eagle
Market. After discussion amongst the Council, it is decided that Director Aho and Council
President Ridgeway will work to include the survey in the December edition of the Eagle
Informer Magazine mailed to each household in Eagle. A separate survey will be composed and
sent to the vendors. Discussion.
Planning & Zoning Administrator Vaughan: No report
City Attorney Report: No report
Sr. Deputy Clerk/Treasurer Osborn: Ms. Osborn reminds Council there is only one meeting in
December that will be held on the 15th.

Butler would like to move item 8A to the consent agenda, if the applicant doesn't have any
problem with the conditions. A member from the public wishes to speak, so the agenda remains
as published.
6. PUBLIC COMMENT:
This time is reserved for the public to address their elected officials regarding concerns or comments
they would like to provide to the City Council regarding subjects not on the agenda. At times, the City
Council may seek comments /opinions regarding specific City matters during this allotted time. This is
not the time slot to give formal testimony on a public hearing matter, or comment on a pending
application or proposal. Out of courtesy for all who wish to speak, the City Council requests each
speaker limit their comments to three (3) minutes.

Mace River Ranch Subdivision No. 5, a 63 -lot (52- buildable, 11- common)

A. RZ -01 -15 MOD & PP -01 -15 MOD — Liberty Park Subdivision (aka Warrior Park
Subdivision) — Liberty Park, LLC: Liberty Park, LLC, represented by Nancy Merrill, is
requesting a development agreement modification and preliminary plat modification to the
previously approved Liberty Park Subdivision to account for a one lot reduction. The modified
plat includes 21 -lots (14- residential, 2- commercial, and 5- common). The 3.79 -acre site is
generally located on W. Flint Drive at the southeast corner of W. Flint Drive and N. Park Lane.

Mayor Reynolds introduces the item.
Nancy Merrill, 690 N. Opuntia Way Eagle, Idaho representing Greg Hall with Liberty Park
Subdivision. Ms. Merrill reviews the application and notes that previously the developer had
intended to stub in water and sewer to a one acre parcel to the east, and install a sidewalk on the
outside of the trees and clean up some property lines. However, the owner of the one acre parcel
has since decided they do not want to be part of the development, or the development agreement,
and thus that one acre parcel has been removed completely from this application. The one parcel
referred to above has been removed from Mr. Hall's application, leaving that acre in its original
condition, as a single family dwelling in a Mixed Use zone.
City Planner III Mike Williams reviews the staff report and recommended conditions of approval.
The applicant is requesting to modify the development agreement and preliminary plat by
reducing by the one acre referenced by Ms. Merrill. The result of the applicant's request is a
slight increase in density, conditions previously referencing the one acre parcel have been
removed, and one condition of approval pertaining to storm water drainage has been clarified.
Mayor opens the public hearing.
Kim Washburn 3855 Flint Dr. Eagle, ID. Mr. Washburn states he did not receive notices for the
two previous hearings as the address listed was incorrect. He is he concerned with the process
and how it will affect his property, and he is concerned about his property rights. Mr. Washburn
states that mailings were sent to 3555 Flint Dr., rather than his correct address at 3855 Flint
Drive. He did receive the notice for tonight's meeting, after he contacted Mr. Hall and the
Planning and Zoning Department. Council can vote however they want and then he will proceed
however they wish.
City Attorney McLain speaks to property notification.
Brian Napp (no address provided) is concerned with the lack of notice by the previous speaker.
The only reason they knew of the meeting was because of the public hearing sign and
communication with Mr. Hall. Mr. Napp is concerned with property owner rights.
Zoning Administrator Vaughan states that this application pertains only to the 3.79 acre site on
Flint Drive. An affidavit of legal interest was received from the applicant authorizing this
application to be brought before the City for consideration. It does not pertain to Mr. Washburn's
property. Vaughan confirms that staff provided legal notice in accordance with Idaho State Code
for the public hearing tonight.
City Attorney McLain confirms procedure in regard to mailings and notice on this application,
and notes that the concerned party is in attendance and has been afforded the opportunity to speak
to the item.
Sherry Washburn provides a document to the Council.
Mayor closes the public hearing.
Council member Butler states that it is understandable that the gentleman had concerns with the
previous application, but notes that they are in attendance today to address this amended
application. The application being considered today before Council does not include, nor will it
affect, Mr. Washburn's property.

B. CPA- 01- 15/A- 01- 15/RZ -04 -15 — Linder Crossing — LR5, LLC: LR5, LLC represented by
Shawn Nickel of SLN Planning, is requesting a Comprehensive Plan Text Amendment to amend
the density language for the "Rim View Planning Area ", and a Comprehensive Plan Map
Amendment to change the future land use map designation from Transitional Residential to
Mixed Use, and annexation and rezone from RUT (Residential Urban Transition — Ada County
Designation) to MU -DA (Mixed Use with a development agreement [in lieu of a conditional use
permit]). The applicant is proposing two (2) development options for the project. Option
#1:Multi- family development consisting of 10- buildings (nine [9]- multi - family buildings
containing 100 -units and one [1] club house), 10- single - family homes, and two (2)- commercial
buildings, including a height exception to thirty-nine feet, two inches (39'2 "). Option #2:Multi-
family development consisting of 11- buildings (10- multi - family buildings containing 148 -units
and one [1] club house) including a height exception to thirty-nine feet, two inches (39'2 "). The
11.13 -acre site is located on the east side of N. Linder Road approximately 1,300 feet north of the
intersection of Chinden Road and Linder Road at 6940 & 6910 N. Linder Road. (WEV)

City Attorney McLain reviews the mediation process in accordance with Idaho State Law.
Mediation was conducted on two separate occasions on October 21s` and 28`h, 2015. McLain
reviews the mediation summary. The applicant tonight has another alternative with a lower
density if Council wishes to have the applicant present it. Staff has not had the opportunity to
review this new proposal.
Discussion amongst the Council. It is Council's desire to hear the new proposal at this time.
Shawn Nickel, 1589 N. Estancia Place Eagle, Idaho representing Linder Crossing. Mr. Nickel
briefly reviews the two alternatives that were presented during mediation, as well as the third
option that Council has not seen prior to tonight, with a density of 8.54 units per acre.
Zoning Administrator Vaughan addresses questions regarding ACHD authority on the
application.
Planner III Baird - Spencer discusses density calculations on the three options.
Mayor opens the public hearing.
David Bensinger 7258 N. Springcrest Place Meridian, ID. Mr. Bensinger states that the
neighbors were reluctant to increase density from the current 4 units per acre, and have been
opposed to apartments from the beginning. He has a hard time believing that these will be upper
end people, a lot of high -end projects starting out, end up with low -end actual tenants. Mr.
Bensinger is personally opposed to any apartments at all; however, acquiescing a little to his
neighbors, he would not want to see density any higher than 8 units per acre, with the types of
buildings to be no higher than two (2) stories. The third option with storage spaces along Linder
are not attractive and would also draw in individuals outside of our community to use them. He
is concerned with property values, the safety of children, the increase of traffic and the type of
people that will be moving into the apartments. Mr. Bensinger is opposed to all of the options.
Jeremiah Williamson 2181 W. Ribier Drive Meridian, ID. Their home was purchased based on
the existing Comprehensive Plan and he opposed to the changes. He is adamantly opposed to the
options presented tonight. There is no transition and the development options do not fit in the
neighborhood.

opposition to application.

of application.

support of application.
Jennifer Zissou 2181 W. Ribier Dr. Meridian, ID. Does not choose to speak, but has indicated
opposition to application.
Jule Eberle 7100 N. Rhine Avenue Meridian, ID. Ms. Eberle is against any change to the current
Comprehensive Plan, and is against all of the options offered by the developer. The process has
been chaotic and confusing. She would like to see small light office that would provide
numerous benefits to the community. Open road access through the middle would be of benefit
to ambulances and EMT services. Ms. Eberle does not feel that an apartment complex would be
beneficial to the surrounding area.
Evelyn Petty 2101 W. Alamden Drive Meridian, ID. They have lived here for 23 years. This is
not compatible with the area and the busy road. The apartments in this area are not needed, as
others are proposed in this area. She hopes the Council will deny this application.
Dick Cooke 1376 W. Sandy Ct. Does not choose to speak, but has indicated opposition to
application.
Caroline Montierth 7175 N. Spring Crest Place Meridian, ID. Ms. Montierth was involved in
both of the mediation sessions. The new plan tonight is still too dense. A continuation of the
Gated Garden subdivision would be a better option than apartments, or even light business for
this area. The Comprehensive Plan has changed 6 times in the last 10 years, and as recent as one
year ago the comprehensive plan was changed to 4 units per acre. They would love to have the
current 4 acres per unit remain unchanged. Ms. Montierth is concerned with the impact to traffic
if the density is increased.
Marrilee Morton 7305 W. Ribier Drive Meridian, ID. Ms. Morton is opposed to this application.
There have been so many changes to the Comprehensive plan. What is to prevent that from
happening again and increasing the density even more? When their home was purchased, it was
based on the existing comprehensive plan, and now changes are being proposed. The increase in
traffic will create a problem that hasn't been addressed. She would like the current
Comprehensive Plan to remain unchanged.
Tom Gibson 2074 W. Ribier Dr. Meridian, ID. Does not choose to speak, but has indicated
opposition to application.
Linda Epperly 2180 W. Ribier Dr. Meridian, ID. Does not choose to speak, but has indicated
opposition to application.
Ted Epperly, 2180 W. Ribier Drive Meridian, ID. Mr. Eberley is adamantly opposed to the
application. Twice, Eagle Planning and Zoning staff recommended to not rezone and alter the
Comprehensive Plan. The reasons were clear: density, parking, traffic, sewer, visual and not
walkable. He feels it is unacceptable, as a tax paying citizen, to see the continuing efforts being
spent on this application when it should be denied. He is wondering why this application is still
being considered. Mr. Epperly is against anything that increases the density greater than eight (8)
units per acre, would be in favor of light office and residential single homes that keep the density
at between 4 -7.
D. Bensinger 7258 N. Springcrest Meridian, ID. Does not choose to speak, but has indicated
opposition to application.
Dave Cantwell 1202 W. Sandy Court Meridian, ID. Mr. Cantwell feels the application is too
dense, and does not comply with the Comprehensive Plan. There have been so many changes to

the Comprehensive Plan and this proposal just doesn't fit. As the neighbors, they are more
invested than the developers in preserving the area.
Malcolm Copple 6849 N. Waterlilly Way Boise, Idaho representing Eagle Island Market Place
and Fred Meyers. He is here to speak to the public road through the middle of this property that
ACHD is adamant be put through this property. Eisenberg Company and Eagle Island Market
Place are against putting the road through the property. It would cause a shift in delivery traffic
that they do not want for their business.
Ken Mallea 2241 W. Almaden Dr. Meridian, ID. He concurs with the opposition previously
stated. Mr. Mallea was involved in both mediations. He compliments City Staff, City Attorney
and even Mr. Nickel for their courtesy and professionalism throughout this process. However,
this project is too dense and in the wrong place. City Staff recommended denial of this
application, without being able to suggest ways for it to be approved. The Planning and Zoning
Commission also recommended denial. He asks that Council do the same thing.
Foad Roghani 2273 W. Ribier Dr. Meridian, ID. He is opposed to this project, and reviews the
density of the surrounding properties, the project is too dense, it is not transitional at all. He has
problems with the impact to traffic, safety and property values, as well as the density increase.
The developer says it is higher -end apartments but, an apartment is an apartment, and unless it is
built next to the ghettos, it may increase the value of the ghettos, then he doesn't know how it
would increase or not affect current neighboring property values. If Council were aware of what
the neighboring property values are, they would better understand the concerns being stated. Mr.
Roghani is in favor of light offices and single family houses.
Avery Epperly 12349 W. Murchinson Street Boise, ID. He would like to preserve this south
western entrance of the City, it is an opportunity to make a statement. It is not a bad project, just
not for this location. Perhaps the developer could sell the land and place this proposed design at
another location and still walk away with a slight profit. Staff recommended denial, as did
Planning and Zoning Commission and he asks that Council does the same.
Scott Trosper 7110 N. Springcrest Place Meridian, ID. This is not the place for high density
apartments. Mr. Trosper was involved in both mediations. The developer has a business plan
wrapped around high density apartments, and that is the aspect that is not appropriate for this
area. The neighbors did make a significant concession to a much higher density, twice the current
density. He hopes that Council rejects this application and sticks with the Comprehensive Plan.
Hal Bunderson 582 River Heights Drive Meridian, ID. Mr. Bunderson owns the Gated Gardens
Subdivision. He is opposed to the proposals before them tonight. He is, however, in favor of a
higher density than is currently in the Comprehensive Plan. He likes the reduction in the
elevation of the project, and the berming. There have been significant improvements; however, it
is lacking. He asks that Council give direction on what they want, and what you can live with.
The applicant can then address that at another meeting.
Shah Afshar 1336 W. Sandy Ct. Meridian, ID. Does not choose to speak, but has indicated
opposition to application.
Naomi Preston, 380 E. Trailside Drive Eagle, ID. Ms. Preston believes the Comprehensive Plan
should be complied with and not altered.
Shawn Nickel rebuts testimony and notes that it was at Council direction that mediation be
entered into between the developer and the neighbors. Mr. Nickel states that this area of Eagle
has changed and is a transitional area. There was comment on changing density if this
application goes through, but there would be a development agreement in place with the land
which is a binding project that would prevent further change. Discussion.

Ridgeway states that he would be in favor of not changing the current Comprehensive Plan.
Kunz is struggling with the high density aspect of this. He would be inclined if it was single
family residential with not much more than 4 units per acre as with the current comprehensive
plan. McFarland states that Linder is planned to be 7 lanes. To build single family homes next to
a seven lane road is not feasible. It will need to be either apartments or light business. Butler
does not believe that single family homes makes sense for this area. Discusses the plans for
Chinden Boulevard, and Linder Road and the increase in size for those roadways. Mayor
Reynolds would like the Comprehensive Plan to be more closely adhered to.
Mayor closes the public hearing.
Butler moves to approve Option 1 with 100 apartments and 10 single family dwellings, as
submitted with a development agreement with a condition that says our standard language with
regard to a concept plan and that the concept plan be identified. That the development agreement
include language that says comply with all applicable codes, that the dwelling units per acre be
calculated by staff and actually be put into that development agreement, the applicant testified it
was around 11.4 dwelling units per acre. That the gates be approved by the Fire Department and
the Police Department. That the buffer as shown be provided with review and approval by the
Design Review Board. That the construction of the pool house /club house and play area be
required and approved by the Design Review Board. Seconded by McFarland. Discussion.

C. Public Hearing for Land Use fees & deposit requirement Legal notice is hereby given that
the Eagle City Council will hold a public hearing on November 17, 2015, at 6:30 P.M. at Eagle
City Hall, 660 E. Civic Lane, Eagle, ID. The purpose of the hearing is to consider changes to
Eagle City Code 1 -7 -4: Fee Schedule for Land Use Planning Actions and proposed Planning,
Engineer and Attorney fees and deposits, which may exceed 105% of the prior fees, and explain
reasons for such fees.
Mayor Reynolds introduces the item
Planner III Baird - Spencer reviews the item. Per Council direction, staff formulated a process by
which land use development costs would rest solely on the developer and not on Eagle taxpayers.
Review of Resolution 15 -28, 15 -29 and Ordinance 747.
Zoning Administrator Vaughan provides comment on the proposed attorney fee deposits and
provides comment to Council questions.
Mayor opens the public hearing.
Dave Yorgesson 14254 W. Battenburg Dr. Boise, Idaho. Mr. Yorgesson is representing both
himself as a Developer and also on behalf of the Building Contractor Association of Southwest
Idaho. The BCA had not had enough time to thoroughly review the proposed changes and would
like more time. He notes that this Council will only be seated for one more meeting. The
timeliness of the refund of the deposit is of concern. BCA would like to do a comparative
analysis of the fees to see what the impact would be with current costs vs the proposed fees. He

would be willing to help conduct the analysis. Depending on when staff could provide data to the
BCA, they should be able to provide analysis as to the proposal.
Butler asks if the BCA would be willing to review the language and provide a strike- through and
underline of the language being considered tonight. McFarland believes staff should work with
the BCA and then bring it back to Council for consideration. General Discussion.
City Attorney McLain states that the City Clerks should notice this for the next meeting as a
public hearing.
Butler moves to continue this to the December 15`h agenda. Seconded by Ridgeway.

schedule pursuant to section 1 -7 -4 of the Eagle City Code, to provide for the establishment by

City Attorney McLain reviews the changes requested by Council that she has incorporated into
the ordinance before them tonight. She also discusses the drafted resolution that would establish
a moratorium on the issuance of business licenses for a period of one year, so that further
direction can be received from Council pertaining to business licenses.
Kunz moves, pursuant to Idaho Code, Section 50 -902, that the rule requiring Ordinances to
be read on three different days with one reading to be in full be dispensed with, and that
Ordinance #743 be considered after being read once by title only. Ordinance 743 An
ordinance of the City of Eagle, Ada County, Idaho, amending or repealing Title 4, Chapters

10. EXECUTIVE SESSION:
A. When authorized an executive session at which members of the public are excluded may be
held, but only for the purposes and only in the manner set forth in this section. The motion to go
into executive session shall identify the specific subsections of this section that authorize the
executive session. There shall be a roll call vote on the motion and the vote shall be recorded in

the minutes. An executive session shall be authorized by a two- thirds (2113) vote of the governing
body. An executive session may be held:
1. Idaho Code §74 -206 (1) (c) To conduct deliberations concerning labor negotiations or to
acquire an interest in real property which is not owned by a public agency;
2. Idaho Code §74 -206 (1) (f) To communicate with legal counsel for the public agency to
discuss the legal ramifications of and legal options for pending litigation, or controversies
not yet being litigated but imminently likely to be litigated. The mere presence of legal
counsel at an executive session does not satisfy this requirement;
Mayor introduces the issue.

Good morning
Since we, Ralph and Laverne Kimmel, are unable to attend tonight's meeting we would like to voice are concern with the
proposed planning of apartments at Linder and Almaden. We have lived here 3 years and we purchased because of the
rural area. If we had known this was in the process, we would have looked elsewhere. The traffic is already heavy and

Re: New Planning Fee and Deposit Schedule
To Mayor Reynolds, Eagle City Council, and Planning and Zoning Commission:
The Building Contractors Association of Southwestern Idaho (BCASWI) represents hundreds of
Treasure Valley businesses including homebuilders, contractors and trades -people. These
member businesses employ thousands of people, many of whom live and work in Eagle. The
BCA is dedicated to promoting the responsible development of our community while also
keeping housing within reach of all Idaho citizens.
It has come to our attention that the City is considering a change in the fees charged for new
development and that the item will be discussed by the Planning and Zoning Commission at their
next meeting on November 171h
As the BCA represents many individuals and business that do business in Eagle City, it is critical
that we are involved in the process. As the fee payer, it is important that our members understand
why the fees are changing and where the new funds will be spent. Unfortunately, we just recently
received notice of the proposed change for the first time. We have not been included in the
process and we have several questions surrounding these new fees. We hope the City is not
trying to quickly implement new fees without proper vetting.
Respectfully, we request the City defer any adoption of these new fees until after a reasonable
analysis has been performed and we have had the opportunity to review these changes with your
staff. We reached out to your planning staff to attend our most recent Builder and Developer
Council meeting earlier this week for this purpose, but he was unavailable to meet this request.
We hope a City representative can attend our next meeting.
We believe it is extremely important to have a good working relationship between the City of
Eagle and the building contractors. Collaboration on issues is vital to a healthy and vibrant
community. We respectfully request the City remand this item back to staff until such time the
staff has met with the BCA to sufficiently review this proposal.
Lastly, our invitation still stands for a member of the City Planning and Zoning Department to
periodically attend our monthly meetings. This has proven to be a positive with other cities as it
improves the communication and working relationship between the BCA, its members and the
City.
We thank you again for your service and look forward to your assistance as we work together
with the current and future elected officials in a positive manner on all our common interests.

I have lived on this property for 22 years.
I am opposed to the proposal to build multi -family developments
on Linder Road at this location. I believe the original zoning
designation for the subject property was correct...i.e. single
family units. I do not see that the arbitration alternatives
achieved much towards maintaining the original zoning proposal.
