AN ORDINANCE OF THE CITY OF EAGLE,ADA COUNTY IDAHO AMENDING TITLE
1, CHAPTER 11, MISCELLANEOUS PROVISIONS; ADDING SECTION 3
AUTHORIZATION OF FBI NATIONAL CRIMINAL HISTORY RECORDS CHECK;
PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS,the City of Eagle, Idaho is a municipal corporation organized and operating
under the laws of the State of Idaho; and
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF
THE CITY OF EAGLE, Ada County, Idaho;
Section 1: That Title 1, Chapter 11, be and is hereby amended, in part,to read as follows with
underline text to be added and strike-through text to be deleted:
1-11-1 : CORPORATE SEAL:
A. Design: The corporate seal of the city shall be circular in form with inner and outer circles of
a regular bead border design. The outer circle shall be one and one-half inches (11/2") in
diameter and the inner circle shall be one inch(1") in diameter. It shall bear upon the upper
portion of space between the two (2) circles the words "City Of Eagle" in gothic style type,
and upon the lower portion of the space between the two (2) circles the words "State Of
Idaho" in gothic style type. Upon the space within the inner circle and upon the upper portion
of the space within the inner circle shall be the word "corporate" and upon the lower portion
of the space within the inner circle shall be the word "Incorporated 1971" in gothic style type.
Upon and across the center of the space within the inner circle shall be the word "Seal" in
roman style type.
B. Adoption Of Seal: The seal described in subsection A of this section is hereby adopted as the
corporate seal of the city.
C. Custodian Of Seal: The city clerk shall be the custodian of the corporate seal of the city and
shall affix said seal imprint upon all official city documents,records and licenses.

Pursuant to the provisions of section 50-213, Idaho Code,the "Valley Times" and the "Idaho
Statesman" are hereby designated the official newspapers of the city and such ordinances,
notices and publications as are required by law to be given publication in the newspaper shall be
published in said "Valley Times" or "Idaho Statesman".
1-11-3 : AUTHORATION OF FBI NATIONAL CRIMINAL HISTORY RECORDS CHECKS:
A. Definition Of Applicant: The term "applicant", for purposes of this section, shall include
applicants for city employment, continued city employment or contractors with the City of
Eagle. All applicants offered a position with the City of Eagle shall be required to obtain a
national criminal history records check prior to their first day. Determine Suitability Of
Applicant: In order to evaluate the suitability of an applicant,the City Clerk or Deputy Clerk
shall require the applicant to provide information and fingerprints necessary to obtain

criminal history information from the Idaho State Police and the Federal Bureau of
Investigation, and shall have the Idaho State Police or the Federal Bureau of Investigation
perform a criminal background investigation.
B. Applicant Consent Required: The City Clerk or Deputy Clerk, shall obtain the written
consent of the applicant for the criminal background investigation and if the applicant does
not execute the consent, the application shall be denied.
C. Authorization Of FBI National Criminal History Records Checks: Pursuant to section 67-
3008, Idaho Code, and congressional enactment Public Law 92-544,the City Clerk or
Deputy Clerk shall submit a set of fingerprints obtained from the applicant and the required
fees to the Idaho State Police and Federal Bureau of Investigation, for a criminal records
check of state and national databases. The submission of fingerprints and information
required by this section shall be on forms prescribed by the Idaho State Police. The City of
Eagle Police Department, specifically the Chief of Police is authorized to receive criminal
history information from the Idaho State Police and from the Federal Bureau of Investigation
for the purpose of evaluating the suitability of applicants and the Chief of Police shall
recommend approval and/or denial of the application based on this information and relay that
recommendation to the City Clerk or Deputy Clerk. As required by state and federal law,
further dissemination or other use of the criminal history information is prohibited.
D. No Amendment Without FBI Approval: This section shall not be amended without
prior written approval from the Federal Bureau of Investigation.
Section 2: If any part of this ordinance shall be held unconstitutional or void, such part shall be
deemed separable and its invalidity shall not affect the remaining parts of the ordinance.
Section 3: The City Clerk is instructed to immediately forward this ordinance to the codifier of the
official municipal code for proper revision of the code.
Section 4: This ordinance, or a summary thereof in compliance with Idaho Code §50-901A, shall
be published once in the official newspaper of the City, and shall be in full force and take effect
immediately upon its passage, approval, and publication. / J
