Minutes - 2021 - City Council - 03/23/2021 - Regular EAGLE CITY COUNCIL MEETING MINUTES March 23,2021 1. CALL TO ORDER: Mayor Pierce calls the meeting to order at 5:30 p.m. 2. ROLL CALL: Present: GINDLESPERGER, BAUN, PITTMAN,PIKE. All present. A quorum is present. 3. PLEDGE OF ALLEGIANCE: 4. ADDITIONS,DELETIONS OR MODIFICATIONS TO THE AGENDA: A. City Staff requests.None B. RECOGNITION: The Mayor recognizes Talena Baer, Vice Chair of the Design Review Board for seven years of outstanding service and presents her with a token of appreciation. The Mayor recognizes Helen Carter of the Eagle Arts Commission for three years of outstanding service and presents her with a token of appreciation. The Mayor recognizes Sgt. Alan Olsen of the Ada County Sherriff s Office for 16 years of outstanding and honorable service to the Eagle community and presents him with a token of appreciation and wishes him well in his retirement. 6. DR-02-21—Common Area Landscaping within Brush Creek Subdivision—Tyler Frazier: Tyler Frazier with Altitude Development is requesting design review approval of the common area landscaping within Brush Creek Subdivision. The 10- acre site is located on the west side of North Park Lane approximately 2,221-feet south of West Beacon Light Road at 2055 North Park Lane. (BAW) G. Reimbursement Agreement with Avimor Development,LLC for City Review of Avimor Planning Documents.(VV) F.Reimbursement Agreement with GWC Capital for City Review of Spring Valley Planning Documents.(NBS) Pittman asks for the particulars on both reimbursement agreements as to funding and financial impact to the city. Director of Long-Range Planner& Projects,Nichoel Baird-Spencer describes the funds that will be submitted to the City and drawn down against staff time utilized, it also addresses the funds for outsourcing the fiscal impact tool analysis costs due to the complexities of the project and provides compensation for pre-submittal review of their application. ACTION ITEM:RZ-11-20&PP-06-20—Rezone from A-R to R-7-DA and Preliminary Plat for Eastfield Subdivision — Erika and Dylan Schneider: Erika and Dylan Schneider, represented by Mark Butler with Land Consultants, Inc., is requesting a rezone from A-R (Agricultural-Residential) to R-7-DA (Residential with a development agreement [in lieu of a PUD])and preliminary plat approvals for Eastfield Subdivision,a 35-lot(30-buildable,5-common) residential subdivision.The 4.58-acre site is located on the northwest corner of East Hill Road and North Edgewood Lane at 200 North Edgewood Lane. (MJW) This item was continued from the March 9, 2021 cancelled City Council meeting. Mayor Pierce introduces the item. Gindlesperger states that she has property within 300' and will step down and not act on this item. Mark Butler 1675 E.Bishop Way Eagle, Idaho with Land Consulting Inc.,representing Erika and Dylan Schneider. Mr.Butler reviews the application. Powerpoint attached. Council member Pittman poses questions regarding the septic drainage field and location, as well as accessibility of emergency response vehicles on the proposed street. Discussion regarding private streets vs.public. Council member Baun asks if the applicant would be willing to participate in the Conservation and Education Program that the City is being developed. Pike states that the Fire District will review the access and planting of the landscape trees. Discussion. Planner III,Mike Williams reviews the staff report and site-specific conditions of approval.Due to the revised preliminary plat items 4-16 may be stricken from the stie specific conditions of approval. Suggests 3.12 as a new condition of development agreement. The existing home locate within the property may continue the use of the existing septic,however owner shall provide a stub- out for central sewer to the existing home prior to issuance of any building permits for the subdivision. Upon failure of the septic system owner shall be required to connect to central sewer service. Discusses setbacks. Discussion for clarification between regarding the berm in relation with the existing residence, removal of existing trees. Discussion Mayor opens the public hearing. Craig Soelberg 2546 W. Timber Drive Eagle, Idaho. Mr. Soelberg is in favor of the application. He is familiar with Mr. Schneiders construction business and feels that an excellent product will be produced. Steve Bender 1235 N. Seven Oaks Place Eagle Idaho. Mr. Bender is in favor of the application. The fence that is being removed is a benefit as it is horrible. He comments on the berm placement and feels it will be appropriate. The lot and home size meets a need in the community. Karen Towne 1544 W. Hampton Bay Drive Eagle,Idaho. They own property on the east and the west of this application. Ms. Towne reads a statement into the record regarding the history of her property and her family. The Towne Family has a long history in the Eagle Community. Her daughter and her son-in-law are developing this property and they are in favor of it. Butler clarifies that there is not a berm in question,but a buffer area. Discusses the tree removal and the sewer stub. Williams suggests adding site specific condition 26 comply with Parks Pathways and Recreation Commission recommendations dated 11-24-20,and strike condition of the development agreement 3.10 if you accept the revised plat. Mayor closes the public hearing. Discussion. Pittman moves to approve the application with the Planning and Zoning Commission recommendations with the following changes. Planner Williams suggests the following: The changes that have been discussed tonight are: Item 3.5 of conditions of development, to remove lots 33,34 and 35,remove that language. Strike item number 3.10 of the conditions of development and that would take care of the rezone. Council will need to debate the matter of septic on the rezone. For the preliminary plat approval strike conditions 4-16. Adding a new site-specific condition #25 which states the preliminary plat date stamped by the City February 25, 2021 is approved with the conditions herein. Add new site-specific condition #26 that states that the applicant shall be required to comply with the Parks Pathways and Recreation Commission recommendation contained within the memo dated November 24, 2020.#27 Pittman would like an updated approval from the Eagle Fire Department regarding the new change.Williams states the requirement of PPRC of a pathway within the canal 20' wide easement from the south top of the canal bank for future pathway that would be developed at the time the remainder of the pathway would be developed. Bann comments the pathway installation and maintenance. Discussion regarding pathway and easement. Pittman site specific condition#28 to vacate the current septic and hook up to Eagle Sewer. Strike staffs recommendation site specific condition #28 addressing the timing of the sewer hook up and the timing would be at the time of the acceptance of the infrastructure of the Eagle Sewer District.Seconded by Pike. ACTION ITEM: VAC-01-21 —Vacation to the final plat of Streamside Subdivision — Todd and Kristy Shreeve: Todd and Kristy Shreeve are requesting to vacate the plat notes specifying additional setback requirements for Lot 43, Block 1, Streamside Subdivision. The .76- acre site is located on the southeast corner of South Marypost Avenue and West Bogus View Drive at 452 West Bogus View Drive.(MJW)This item was continued from the March 9, 2021 cancelled City Council meeting. Mayor Pierce introduces the item. Ladd Cluff, 2471 S. Titanium Place Meridian, Idaho with T.O Engineers representing Todd and Kristy Shreeve. Mr. Cluff review the application and addresses concerns expressed by the HOA. There will be no impact to the conservation, sewer and emergency easements. The purpose for seeking the vacation is that the lot owners wish to build an addition to their home. Powerpoint attached. Pike moves to approve action item 10B VAC-01-21—Vacation to the final plat of Streamside Subdivision — Todd and Kristy Shreeve to strike note #5, is that correct Mike (Williams)? Planner Williams the recommendation that came down from the Commission had 2 conditions:#1 Pay all engineering and legal fees.#2:The row specifying building setbacks for lot 43 block 1 within the setback table and footnote #5 show on page 2 of final plat of Streamside subdivision shall be vacated prior to issuance of a building permit. Pike: I will include that comment in my motion. Seconded by Pittman. Discussion. Pittman asks about leave a portion of#5.Planner Williams: If you leave all plat notes in place with the exception to address to leave#5 just remove the first portion that talks about where you have to move the easement from,that still requires a 30' street side setback which is 10' wide that what is typically required by code. It doesn't affect anything adjacent to the street which may be a concern of the HOA.And would still allow the Shreeves do what they need to do. Pike concurs with the amendment.Second concurs. ACTION ITEM Resolution No.21-08—Fee Schedule Update for the Building,Planning and Zoning and Parks and Recreation Departments: A resolution amending Fee and Deposit Schedules for the Building, Planning and Zoning, and Parks and Recreation Departments in accordance with Eagle City Code Section 1-7-4 to update and establish new fees charged for services; and providing an effective date. ACTION ITEM?A-10-20&RZ-13-20—Annexation and Rezone from RUT to C-1-DA for a Convenience Store with Fuel Service—Treasure Valley Chevron,Inc.: Treasure Valley Chevron, Inc., represented by Stephanie Leonard with KM Engineering, is requesting annexation and rezone from RUT (Residential-Urban Transition — Ada County designation) to C-1-DA (Neighborhood Business District with a development agreement [in lieu of a conditional use permit])for a mixed used commercial development,which includes a convenience store with fuel service.The 10.01-acre site is located at the southeast corner of West Beacon Light Road and State Highway 16. State Street Boise,Idaho with KM Engineering representing Treasure Valley Chevron Inc., reviews the application. Ms. Leonard states that owners Treasure Valley Chevron Inc. has owned and operated the Chevron at Beacon Light and Highway 16, they are members of the community and excited to bring this proposal forward.The applicant is seeking are seeking modifications to condition 3.7.2 pertaining to color to open up more modifications to final design criteria. 3.4.5 They are asking that the monument signs be allowed to be installed with the first building permit. Leonard addresses the concerns expressed by the neighbors at the last hearing. They are requesting changes to condition 3.15. Powerpoint attached. The sign representative(not identified by name)discusses monument sign lighting and additional details regarding colors. Planner III,Mike Williams reviews the staff report and site-specific conditions of approval. Mayor opens the public hearing. Mark Van Able 2994 N. Merlot Star Idaho. Mr. Able lives approximately 500' feet from the proposed Chevron in the Trellis Subdivision. He appreciates the efforts of the City and the standards they uphold. Their concerns are with the façade of the proposed building,and monument sign size. They would prefer an 8'tall sign and are adamantly against the blue canopy. JR Warila 1100 S. Renovare Lane Eagle, Idaho. Owner of Treasure Valley Chevron he describes the history of his business,they have operated the Chevron in Eagle at Beacon Light and Highway since 55. He is looking forward to expanding his business in the Eagle Community. WebEx testimony: Joann Butler 967 E. Park Center Blvd representing the applicant. Ms. Butler thanks Staff and the City for their efforts in She speaks to condition of approval 3.15. ITD has removed their objection from the application. They would however like clarification provided in 3.15. The applicant would just like confirmation that the City will not condition the application on any proportionate share payment to ITD for state highway improvements. Suzan Giudi 3486 N.Rose Ave Star,Idaho. She defers her comments to her neighbor. Dean Bunnell, 3003 N. Merlot Place Star Idaho. There has been an increase in noise with the installation of Beacon Light and Highway 16. If the proposal is approved, he is concerned with a further increase in noise. He does not feel that a 3' berm would be sufficient to mitigate noise and would like additional signage regarding the prohibition of"fake brakes". Laurence Woodbury 8585 W. Rioja Star Idaho. He lives directly across from the site. He is prairie concerned that the architecture and designmatch the rural feel. Mr.Woodburydoes like the ra e P stye architecture and the wood look, however they would like a smaller monument sign of approximately 8'. He does not feel that a 3' berm is not high enough to mitigate sound. A neighboring site has a berm that is of a more acceptable height and they are requesting one on this site of similar size. Jan Combe 6440 W. Beacon Light Rd. Eagle, Idaho. Ms. Combe ask about ingress and egress to the site and if ITD had provided comment and a plan. She is concerned with the bottleneck that will be created with the increase of traffic. Melonie Clark 8535 W.Rioja Star Idaho. Ms. Clark lives very close to the proposed site. She and her neighbors are concerned with the noise, the lights, traffic and impact to their view shed. She suggests a rotation of the building to provide more of a buffer and be less of a visual impact to them.With the rotation of the site,the relocation of the trash enclosure would be necessitated. Gayle Sullivan 8781 W. Rioja Star Idaho. She feels this proposal will set the tone for other future developments that will surround it. The height of the sign is of concern. Stephanie Leonard reads comments into the record from. Warren Johns a real estate agent with Mountain Realty. He is HOA president at Bogus Ridge and is also a realtor near Beacon Light and Highway 55. The Chevron at Beacon Light and Highway 55 has not attracted undue noise, the owners keep the property clean and well kept, home sales nearby have been at top dollar. Wanda and Doug Crandall and Mariah and Mark Rodeghiero. Homeowners in the Trellis Subdivision. They state that the Chevron at 55 is clean and the addition of another station in Eagle will be a benefit to Eagle and those traveling from Emmett. The owners live and have operated a business in Eagle for several years and the addition of another would be an asset to the community. Stephanie Leonard rebuts testimony. It is their intent to bring forward the Prairie Style architecture to the City's Design Review Board. They continue to seek the 2 allowed 15' signs as allowed by code for a multi-tenant building. As to the re-orientation of the building as suggested by Ms.Clark, is not conducive to the vision of the owner for the site. Ms.Leonard states that there will not be be a substantial increase in traffic as this is not a destination stop but capturing trips by people are already traveling to other destinations. The increase in berm size beyond 3' would be detrimental to the success of the building and the business.Discussion. Mayor closes the public hearing. Mayor calls a 5 minute recess. Baun would like the color condition to remain,as to the sign request,he would the 8' sign,discusses sign lighting,the 3'berm to remain. Pittman states his concerns with sewer and water are a concern, but the condition of approval was written in a way that he is agreeable to it. Discussion for clarification regarding the proportionate share condition. Pittman moves to approve action item A-10-20 & RZ-13-20—Annexation and Rezone from RUT to C-1-DA for a Convenience Store with Fuel Service — Treasure Valley Chevron approve this item as stated with the Planning and Zoning Commission. ACTION ITEMS A-09-20 & RZ-12-20—Annexation and Rersone from RR and RUT to R-E-DA—J&M Land,LLC,Cabra Creek LLC,&M2 Land LLC: J&M Land,LLC,Cabra Creek LLC, & M2 Land LLC, represented by Van Elg and Scott Wonders, P.E., with J-U-B Engineering, are requesting annexation and rezone from RR (Rural Residential — Ada County designation) and RUT (Residential-Urban Transition — Ada County designation) to R-E-DA (Residential-Estates with a development agreement). The 388.4-acre site, consisting of nine (9) parcels, is located on the north side of West Beacon Light Road and the east side of Hartley Road at 4012 North Hartley Road and 5802 West Beacon Light Road. (MJW) Mayor Pierce introduces the item. Scott Wonders with JUB Engineering 2760 W. Excursion Ln. Ste. 400 Meridian, Idaho representing Cabra Creek LLC & M2 Land LLC review the application. Discusses equestrian trails,proposed private roads and septic systems. Baun comments on the wildland urban interface, he feels like the development is presented as exclusive, comments on the removal of 400 acres agriculture and habitat out of production and other areas of concern. Gindlesperger inquires as to snow removal and something else. Mayor expresses his pleasure with the proposal with larger lots. Planner III,Mike Williams reviews the staff report and site-specific conditions of approval. Mayor opens the public hearing. Steve Bender 1235 N. Seven Oaks Place Eagle Idaho is not in favor of private streets. He strongly encourages Council to require public roads. He has concerns about the BLM land to the north, as people use it to shoot. Mayor Pierce states that the BLM property mentioned is withing Eagle City limits and it is currently against Eagle City Code to shoot within city limits. Baun states that a proposed plan for the BLM property is currently in the works. Mary Taylor 3410 Hartley Road Eagle, Idaho. Ms. Taylor lives right near the property. The property in question is some of the last ag land in the north. She feels the proposed septic systems will doom the areas aquifer. Individual septic systems are unacceptable and is concerned with the use of pavers especially in the sandy soil that is on site. Ms. Taylor states that flooding has been an issue in the vicinity. She is concerned with the funding of the infrastructure for these types of developments. On the south side of the property near Hartley Lane she would like a berm installed to provide buffering. Baun states that CEP program that the City is starting would be used for preservation for ag land. Jan Combe 6440 W. Beacon Light in Eagle, Idaho. Ms. Combe states that there is wildlife out there including coyotes and perhaps owners should be provided notice. She wonders if horses would be allowed on their 2-acre property and other farm animals, and also has questions about access from Beacon Light. Planner III, Williams clarifies that the application before them tonight does not address private roads,that will be part of the preliminary plat process. Scott Wonders JUB Engineers rebuts testimony.There have been initial discussions with a Wildlife Urban Interface (WUI) and the fire district. They will be addressing the BLM coordination, and consulting the something else. They will submit a flood plain development permit as they move forward. Discusses phasing of the development,proposed septic systems, ground water levels and the future traffic study. Mayor closes the public hearing. Discussion amongst the Council Baun moves to approve 10 E ACTION ITEM:A-09-20&RZ-12-20—Annexation and Rezone from RR and RUT to R-E-DA—J&M Land,LLC,Cabra Creek LLC,&M2 Land LLC:with the following adjustments add the following conditions of approval:3.13: No formalized trail or pathway to access BLM lands without written consent from BLM. 3.14 development of a wildlife fire management plan. ACTION ITEM:EXT-02-21 — Preliminary Plat Extension of Time for Whitehurst Subdivision — Evans Development, LLC: Evans Development, LLC, represented by Becky McKay with Engineering Solutions, is requesting a one (1) year extension of time for the preliminary plat for Whitehurst Subdivision,a 67-lot(60-buildable,7-common)residential planned unit development. The 30.06-acre site is located at the terminus of West Breanna Drive north of Flint Estates Subdivision. (MJW) Mayor Pierce introduces the item. Becky McKay representing Evans Development. Ms McKay reviews the request for extension of time. They are seeking a 6-month extension,although they have already submitted their final plat. Pike asks for justification of a 6 month ask. McKay states that 2 or 3 months would be sufficient. Planner II Williams discusses timeline. Baun moves to approve 11A action item EXT-02-21—Preliminary Plat Extension of Time for Whitehurst Subdivision — Evans Development, LLC to March 25, 2021. Seconded by Gindlesperger.
