ROLL CALL: Present: WRIGHT, GUERBER, MCCAULEY, MCLAUGHLIN, SMITH (via WebEx). A quorum is present. 3. CONSENT AGENDA: ♦ Consent Agenda items are considered to be routine and are acted on with one motion. There will be no separate discussion on these items unless the Chairman, a Commissioner, member of City Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in a sequence determined by the Rules of Order. ♦ Any item on the Consent Agenda that contains written recommendations from the City of Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda approval motion unless specifically stated otherwise. A. Minutes of March 1, 2021. Discussion about the March 1 st meeting minutes. Guerber moves to approve the consent agenda as presented. Seconded by McCauley. ALL AYES... MOTION CARRIES. 4. UNFINISHED BUSINESS: NONE. 5. PUBLIC HEARINGS: A. ACTIONITEM.• RZ-01-14 MOD — Modification to the Development Agreement associated with the Foxtail Senior Living Center — Foxtail Senior Living Center, LLC: Foxtail Senior Living Center, LLC, is requesting a development agreement modification to increase the number of residential assisted living units from 78 to 100 total units and to include a revised concept plan in the development agreement. The 4.64-acre site is located on the north side of West Chinden Boulevard approximately 1,300-feet west of the intersection of North Meridian Road and West Chinden Boulevard at 2559 and 3600 West Bavaria Street. (MJW) Tom Lennon, Erstad Architects, 310 North 511 Street, Boise, ID. Lennon provides a brief overview of the application. Lennon responds to questions from the Commission. William Hines, the applicant and property owner, responds to questions from the Commission. City Planner, Mike Williams, provides a detailed overview of the application. Williams responds to questions from the Commission. Chairman Wright opens the Public Hearing. Daniel Rozsa, 593 West Gray Fox Court. Rozsa states opposition to the application, and expresses concerns related to light intrusion and audible alarms. Rozsa responds to questions from the Commission. Tom Lennon, the applicant's representative, provides rebuttal and addresses concerns raised during the Public Hearing. McLaughlin moves to recommend for approval RZ-01-14 MOD — Modification to the development agreement associated with the Foxtail Senior Living Center — Foxtail Senior Living Center, LLC, with the following additions: to include the concept plan "Exhibit B" as recommended by staff; also, to include staff recommendation 3.1— the assisted living facility shall be limited to single -story, not to exceed 29-feet in height; condition 3.10 — the assisted living facility shall not exceed a total of 100-units; condition 3.11 — that the facility shall comply with all requirements of the Meridian Fire Department, and 3.12 — that it shall comply with Eagle City Code regarding lighting and dark sky lighting requirements. Seconded by McCauley. ALL AYES... MOTION CARRIES. 6. NEW BUSINESS: NONE. 7. REPORTS: A. Commission: Commissioner Smith discusses comments made during the public hearing about development standard and discusses work being performed at Molinari Park. Commissioner McLaughlin informs the Commission and staff that she will be absent on April 5, 2021. B. City Attorney: None. C. Staff.
