Minutes - 2021 - City Council - 03/18/2021 - Special EAGLE CITY COUNCIL SPECIAL MEETING MINUTES March 18,2021 1. CALL TO ORDER: Mayor Pierce calls the meeting to order at 3:00 p.m. 2. ROLL CALL: Present: GINDLESPERGER, PITTMAN, (via WebEx), PIKE. Absent: BAUN All present. A quorum is present. 3. PLEDGE OF ALLEGIANCE: 4. ADDITIONS,DELETIONS OR MODIFICATIONS TO THE AGENDA: A. City Staff requests.None B. Mayor or City Council requests.None 5. PRESENTATION: A.Presentation by Idaho Transportation Department regarding continuous flow intersection at Ea le g Road and State Highway 44. (JP) Mayor Pierce introduces the item. Vincent Trimboli, 1978 N. Trail Creek Way Eagle, Idaho, representing Idaho Transportation Department(ITD). Mr.Trimboli is the Communication Manager for the Department.On behalf of ITD he apologizes for the way Mayor and Council heard of the change from a continuous flow intersection to a wider signalized traditional intersection. This decision was made based on public comment received. This decision has been finalized and ITD is moving forward on the new design. The construction timeline remains the same for the new plan as the old.ITD will be communicating the change to the public via a variety of avenues. PowerPoint attached to minutes. Council Member Pike appreciates Mr.Trimboli attending today. He emphasizes the importance of communicating the change to the public and is encouraged with the efforts that are proposed to be made. Gindlesberger inquires if COMPASS is aware of the change, and if other proposed continuous flow intersection designs are being altered. Trimboli confirms that COMPASS has been made aware of the change and that other proposed CFI's in the Valley have not been addressed at this time. Pittman seeks confirmation that the construction timeline will not be impacted. Trimboli confirms that the change will not impact the timeline and does not feel that this change will impact the proposed construction by ACHD in 2023. Discussion regarding traffic impact and number of lanes. Matt Stall with COMPASS. They are working with ITD on the changes to the public transportation program. They will address the funding distribution during that time. He discusses public outreach, and timeline for changes. Discussion regarding signal synchronization and construction schedule. Tom Firch 577 W. Rush Ct. Eagle, Idaho representing ACHD in attendance to be available to answer any questions. Baun arrives via WebEx at 3:29 p.m. He inquires about long term and budgetary impacts for the change. Trimboli states that the budget should be between 5-10 +/- for the overall construction, and they believe it will meet similar long-term needs. There are a few questions that he will e-mail responses to after he consults his colleagues at ITD and will keep the partner agencies in the loop as well. Mayor and Council Reports: Pike states that he attended the Urban Renewal Agency meeting this week.Baun reports on the BLM meeting and PPRC will be meeting tonight. B. City Hall Department Supervisor Reports:None C. City Attorney Report: None 7. PUBLIC COMMENT 1: The Eagle City Council is taking remote public comment via Webex. Meeting login instructions are posted on https://www.citvofeagle.org/1698Nirtual-Meetings. If you just want to watch the meeting,without giving comment,please watch our livestream at https://www.cityofeagle.org/305/City-Agendas- Videos. This time is reserved for the public to address their elected officials regarding concerns or comments they would like to provide to the City Council regarding subjects not on the agenda. At times, the City Council may seek comments/opinions regarding specific City matters during this allotted time.This is not the time slot to give formal testimony on a public hearing matter,land use application,or comment on a pending application or proposal. Out of courtesy for all who wish to speak, the City Council requests each speaker limit their comments to three (3) minutes. Nate Garm President of West Valley Little League. West Valley would like to contribute to upgrade the features at Guerber Park but are unable to financially at this time.They would be more than willing to contribute in the form of volunteer labor and subject matter expertise. Discussion. 8. ALL CONSENT ITEMS ARE CONSIDERED ACTION ITEMS: CONSENT AGENDA: • Consent Agenda items are considered to be routine and are acted on with one motion. There will be no separate discussion on these items unless the Mayor,a Councilmember,member of City Staff,or a citizen requests an item to be removed from the Consent Agenda for discussion.Items removed from the Consent Agenda will be placed on the Regular Agenda in a sequence determined by the City Council. • Any item on the Consent Agenda which contains written Conditions of Approval from the City of Eagle City Staff;Planning&Zoning Commission,or Design Review Board shall be adopted as part of the City Council's Consent Agenda approval motion unless specifically stated otherwise. Resolution 21-09: A Resolution to create a new executive officer position who shall serve as the historian, to amend duties of the secretary and add duties, to amend eligibility requirements to join the Mayor's Youth Advisory Council(BJ) C. Re-appointment to the Parks, Pathways, and Recreation Commission: In accordance with Resolution 14-19, Mayor Pierce is requesting Council confirmation of the re-appointment of Steve Deckers to the Parks, Pathway, and Recreation Commission. Mr.Deckers will be serving a term that will end in March 2024. D. Arbor Day Proclamation: A proclamation of the City of Eagle declaring April 30, 2021 as Arbor Day. Multiple Sclerosis Awareness Month Proclamation: -A proclamation of the City of Eagle declaring March Multiple Sclerosis Awareness Month in the City of Eagle. (BP) Pike introduces Ashley Ferguson. Ashley Ferguson is the owner of The Griddle restaurant in Eagle,and lives with Multiple Sclerosis. Katie Martin is a member of the National MS Society provides information regarding MS statistics throughout the United States and the State of Idaho. She discusses the number of people in the nation,as well as Idaho that live with MS. She discusses fundraising efforts for the society. Pike moves to approve 8E. Seconded by Gindlesperger.THREE AYE.MOTION CARRIES. 9. NEW BUSINESS: A. ACTION ITEM: Restroom Facility at the Eagle Dog Park: A contract with All Phase Construction Company LLC for the construction of a restroom facility at the Eagle Dog Park. The contract amount shall not exceed$171,685. (EZ) Mayor Pierce introduces the item. Public Works Director, Ziegenfuss provides background on this item. The previous bid that was awarded to Wright Brothers for$176,000 however,that bid and all others were abandoned as they did not include construction plans. The City contacted each of the previous bidders and asked for updated bids that would include architectural blueprints and construction plans and no one responded. All Phase Construction Company, the same company working on the dog park, was contacted and returned the quote of before you today for consideration. The total is approximately $5,000 than the original bid awarded. Pittman inquires as to the timeline for completion date. Discussion. Pike moves to approve action item 9A to not exceed $171,685. Discussion regarding the allocation of liaison positions previously held by Council member Gold. C. ACTION ITEM: Establishment of minimum bid price for west park property: (JP) Mayor Pierce introduces the item and discusses the original purchase price and discusses potential minimum starting bid. He believes that the City should utilize a real estate agent to facilitate the bid process. City Attorney Villegas reviews the requirements established in Idaho State Code 50-1402 regarding conveyance of property. Discussion regarding statutory process and minimum bid process. Director of Long-Range Planner and Projects, Baird-Spencer states that if west park property is sold it will not reduce the minimum park land requirement required in the park capital impact plan. Pike moves to set the minimum bid of$5,000,000 and work through the process with staff.To offset and where it gives us the ability to purchase something in the future and as well as the plan to move forward with just the selling of it as a whole. D.ACTION ITEM: Conservation and Education Program Discussion: Discussion concerning the establishment of a Conservation and Education Program and Committee aspart of the City's g tY development process. (CB) Mayor introduces the item. Director of Long-Range Planner and Projects Baird-Spencer reviews the Local Land Use Planning Act that are pertinent to the proposed Conservation and Education Program. Pike would like to present this to the public for input and comment. Gindlesperger and Pittman also state their desire for public input. Pittman would like the City to retain control and have the City manage the program. Mayor Pierce states this type of program would potentially save some of the ag land and purchase it to preserve it as well as maintain it in Eagle. Discussion Pike approves action item 9A Conservation and Education Program with moving forward with staff with option A as part of our continuation. Seconded by Pittman.Discussion. Pike clarifies it is item 9D,not A. Second concurs.ALL AYE...MOTION CARRIES. Mayor asks to move the Executive Session ahead of unfinished business due to time constraints. 11. EXECUTIVE SESSION: I.C. §74-206 WHEN AUTHORIZED. The motion to go into executive session shall identify the specific subsections of this section that authorize the executive session. There shall be a roll call vote on the motion and the vote shall be recorded in the minutes. An executive session shall be authorized by a two-thirds(2/3)vote of the governing body. (k) Special Areas or Sites — An analysis of areas, sites, or structures of historical, archeological, architectural, ecological, wildlife, or scenic significance.
