December 22, 1992
Pre Council~ Discussion regarding water in Island Woods Subdivision
took place. Island Woods attorney Steve Bradbury and City
Attorney, Mona Mack will need to negotiate a contract. Discussion
took place about a City of Eagle Flag, the color of sky blue was
thought to be best, with the seal of the City.
The Eagle City Council met in regular session on December 22, 1992.
Mayor GUERBER presiding.
The following members were present= RICK YZAGUIRRE, THOMAS EASON,
STAN BASTIAN, KELLI BLAIR.
Moved by YZAGUIRRE and seconded by BLAIR to approve the minutes of
the December 8, 1992 meeting as presented. ALL AYE~ MOTION
CARRIED.
UNFINISHED BUSINESS~
1992 Eagle Comprehensive Plan: Mayor GUERBER presented revisions
to the plan, discussion regarding the revisions resulted in the
following motion,
Moved by BASTIAN and seconded by EASON to vote to deny the
recommendations of Eagle Planning and Zoning Commission, and the
subsequent amendments proposed tonight to the 1992 Comprehensive
Plan, but to send the proposed plan for 1992, along with the
proposed amendments received tonight, to Ada County for review
prior to final action. ALL AYE: MOTION CARRIED. When we receive
an answer from Ada County the public hearing process will begin at
the Eagle Planning and Zoning Commission. (amendments attached)
WATER BOND REPORT: The bond election will probably be scheduled
for mid march in the amount of 2.2 million dollars. The issue may
have to return to Council to further define. The City Clerk was
instructed to put the issue on the next agenda.
CITY OF EAGLE FLAG: Moved by BASTIAN and seconded by YZAGUIRRE to
authorize the City Clerk to purchase 6 flags in the amount of
$1,071. for the flag plaza at Circle K.
ORDINANCES-RESOLUTIONS:
Moved by EASON and seconded by BLAIR to dispense with the three day
ruling and to consider Ordinance 216 at this time. ALL AYE~
MOTION CARRIED.
Moved by EASON and seconded by YZAGUIRRE to adopt Ordinance 216,
Enacting a new Section 6, Chapter 2, Title 5, Eagle City Code,
prohibiting camping or sleeping overnight on public property
located within the City Limits except as specifically posted
ALL AYE~ MOTION CARRIED.
MAYOR'S REPORT~ The Mayor called the Council's attention to the
new chairs in the Council Room. He advised the Council the
Affordable Housing grant application had been turned down.
ATTORNEY'S REPORTs The attorney reviewed the AAtronics contract and
reported it was well written. She called the Council's attention
to the Holland & Hart letter dated Dec. 15, 1992. Holland & Hart
Law Firm will be representing the City in the dispute over real
estate transactions with Phil Criswell, Louis Mendiola and coverage
issues with National Casualty Company.
COMMITTEE REPORTS~ YZAGUIRRE~ Greenbelt~ the committee has been
negotiating with Island Woods for pathways. The ITD pathway funds
may be available for the 3 projects identified by Council in 1994,
but not in 1993. Eagle Quest: will be ready for certification to
the Dept. of Commerce within a month.
BASTIAN~ Library: The Library Board received the contract from
Aha County Free Library Dist. it will be submitted for Council
approval at the next meeting. Sewer~ They are arranging a meeting
scheduled for Jan. 6 on a new development (Aguila Lakes) bordering
on the E side of the city boundary. The discussion will be Boise
sewer or Eagle sewer serving the site.
CLAIMS AGAINST THE CITY: Moved by YZAGUIRRE and seconded by EASON
to approve the claims as presented with the exception of the bill
from Eagle Water Company. Mr. DeShazo will need to itemize the
charges on the repair of the water lines in the back lot. ALL AYE:
