We are losing our Admin Clerk so we will be filling that position. We have our fleet of cars up and going and I will introduce our new deputies at the next meeting. Provides an overview of the monthly report. 2. Discussion/workshop with Boise City Prosecutor's Office regarding city code amendments pertaining to code enforcement. Terry Derden displays a power pointe presentation on code amendments and provides Council an overview of suggested changes. General discussion. 3. Mayor and Council Reports: Mayor: Mayor distributes a report on the Eagle Road and Old State Street Intersection Proposal from Fulcrum Exp, LLC. City Hall Department Supervisor Reports: Park/Rec- Facilities Director Aho: I had the opportunity to attend the National Parks and Recreation Conference last week. Director provides Council an overview of the workshops he attended. The Master Plan will be on your next agenda. Discusses the first City Classic car show, some changes that should be made to the bike trails at the Sports Complex, and the Day of Caring which is Thursday, September 24`h. General discussion. CALL TO ORDER: Mayor Reynolds calls the meeting to order at 6:30 p.m. 2. ROLL CALL: MCFARLAND, BUTLER, KUNZ, RIDGEWAY. All present. A quorum is present. 3. PLEDGE OF ALLEGIANCE: Mayor Reynolds leads the Pledge of Allegiance. 4. SERVICE RECOGNITION: A. The City would like to honor the outgoing commission members and thank them for their service and dedication. 1. The City would like to honor Joel Grounds for his service to the Eagle community while serving on the Transportation Committee. The Mayor thanks Joel Grounds for his service on the Transportation Committee and presents him with a City of Eagle plaque in recognition of his service. General discussion on the use of the Eagle In Flight in front of the Sunburst logo. Kunz moves to amend the Consent Agenda to add Item #7K to consider approval for candidates to use the trademark image of the Eagle In Flight in front of the Sunburst for the duration of the 2015 General Election. Seconded by Butler. Discussion. Ridgeway recuses himself on this vote. THREE AYES: MOTION CARRIES............ 6. PUBLIC COMMENT: This time is reserved for the public to address their elected officials regarding concerns or comments they would like to provide to the City Council regarding subjects not on the agenda. At times, the City Council may seek comments /opinions regarding specific City matters during this allotted time. This is not the time slot to give formal testimony on a public hearing matter, or comment on a pending application or proposal. Out of courtesy for all who wish to speak, the City Council requests each speaker limit their comments to three (3) minutes. Shelly Brock, 8770 W. Chaparral Road, Citizens Allied for Integrity and Accountability, displays a power point presentation in regards to fracking and discusses the same. General discussion. Council concurs to have a special meeting including both sides and the City Attorney on October 20`h at 6:00 p.m. Bob Ward, 3007 E. Lakeland Lane, distributes packets to the Council and discusses the issues with Idaho Concrete. Zoning Administrator Vaughan: I have met with the HOA and representatives from Idaho Concrete Company. It appears that both parties have legitimate concerns. This is not going to be an easy resolution. At this point I am still in the fact finding stage of this. This might be a special meeting issue. General discussion. City Attorney McLain: The City Attorney's Office has also been working on this issue. This is not an easy solution as we are working with a very old permit. The permit speaks to hours of operation so we are looking into this. We will continue to work with the concrete company to see what mitigation we can do to cut out the sound as well as the dust abatement. We may reach a point where we will need to do a show cause action but the City Attorney's Office is not ready at this point to say they are in violation. We are still doing fact findings and doing mitigating steps to both help the neighbors as well as the business owners that are in the City. Butler: This is a land use matter and should go through the proper process. Our staff should write a staff report or an opinion about this and let it be appealed by either the homeowners who are adjacent to it or by the developers. This would get it formalized. General discussion. Susan Budge, Idaho Petroleum Council. I appreciate Council's decision to have a special meeting. I do want to let you know that there is no intended activity in this area at all. There are leases in the area. 7. Resolution 15 -24 — City of Eagle Water Department Rate Change: A Resolution of the City Council of the City of Eagle, Ada County, Idaho, establishing City Water System customer charges and volume charges, and providing an effective date. The proposed change will affect only three (3) rates and will be an increase of 2 %. (KA) ♦ F. Noise Waiver Request — Eagle Volunteer Fire Department: The Eagle Volunteer Fire Department is requesting a noise waiver until midnight to accommodate their annual Haunted Woods fundraiser on the following dates: October 9, 10, 16, 17, 23, 24, 30 and 31. The fundraiser takes place near the Boise River behind Merrill Park. ♦ G. Appointment to the Library Board: Mayor Reynolds is requesting the appointment of Jill Mitchell to the Library Board. Ms. Mitchell's term will expire in September 2020. (JDR) ♦ H. Minutes of September 3, 2015. ♦ I. Minutes of September 8, 2015. ♦ J. Findings of Fact and Conclusions of Law for FPUD -06 -15 & FP -09 -15 — Final Development Plan and Final Plat for Snoqualmie Falls Subdivision No. 8 — Brahma LLC: Brahma LLC., represented by Justin Martin, is requesting final development plan and final plat approvals for Snoqualmie Falls Subdivision No. 8, a 60 -lot (49 buildable, 11 common) residential subdivision. The 24.51 -acre site is generally located south of Floating Feather Road, between Linder Road and Palmer Lane, at the terminus of West Nordic Drive. (WEV) ♦ K. The public may provide formal testimony regarding the application or issue before the City Council. This testimony will become part of the hearing record for that application or matter. Mayor: In the matter of Springhouse Subdivision -CBH Homes, Linder Crossing or the Shadowbluff Planned Unit Development does any member of Council have any exparte contact to declare? Butler: When there was a previous application in for Linder Crossing there was a previous comp plan amendment, sometime before the application was submitted, I met with Mr. Rennison to talk about some YMCA issues. I was still chairman of the URA, and at that time he brought up the fact that he was hoping at some point to apply for apartments next to the Fred Meyer. That was the basic conversation it was probably a year ago, it was a long time ago. City Attorney McLain: I see no problem. Ridgeway: I had a friend at the car show here at City Hall on Saturday mention that he would probably testify tonight on Item #A as a neighborhood issue. Kunz: I have received a number of emails and phone calls regarding these three applications. I just wanted to be on the record that I have received several exparte communications from people regarding their positions on them. Mayor: With regard to Springhouse Subdivision- CBH Homes, Linder Crossing or the Shadowbluff Planned Unit Development does any member of Council have any potential conflict of interest to declare? None A. A- 03- 15/RZ -06 -15 and PP -05 -15 — Springhouse Subdivision- CBH Homes, Inc.: CBH Homes, Inc., represented Scott Wonders with J -U -B Engineers, Inc., is requesting an annexation, rezone from RUT (Rural -Urban Transition — Ada County designation) to MU -DA (Mixed Use with a development agreement in lieu of a PUD) and preliminary plat approvals for Springhouse Subdivision, a 58 -lot (52- buildable, 6- common) residential subdivision. The 18.39 -acre site is generally located on the west side of North Park Lane approximately 750 -feet north of the intersection of State Highway 44 and North Park Lane. (WEV) Mayor introduces the issue. Scott Wonders, J -U -B Engineers, representing the owner /applicant, provides Council an overview of the application. We are in agreement with Staff Conditions of Approval. We are also in agreement with the stub street condition. Discusses the irrigation ditch and whether a 24" or 30" pipe is needed. I have concerns on two items. The first is the area regarding the lateral that provides water to our subdivision, Sedona Creek, and also Eagle Creek. My concerns are with the pipes and the drainage ditch. My second concern is the drainage ditch which I think should be tiled. Joe King, 170 N. Sierra View Way, I'm representing the Ballentyne Ditch Company. The ditch company recommends that the north lateral be tiled. Our position is that the pipe should be the same size that runs under Park Lane and we think that is 30" but it is under water right now so we can't tell. We recommend that the drainage ditch be tiled. General discussion. Bob Bourman, 1440 Bowknot Lake Way, Star, discusses the dirty water that comes from the irrigation ditch and the costs. We would like to have the drainage ditch tiled. General discussion. Nancy Merrill, 692 Opuntia Way, HOA President for Eagle Creek, we have no problems with the development. We have some concerns in regards to the water. We recommend that a 24" pipe would be sufficient. We need some type of a measuring device. We are also concerned about the front setbacks and would like clarification. We would request that there be some type of play equipment for the children. General discussion. Butler moves to approve A- 03- 15/RZ -06 -15 and PP -05 -15 — Springhouse Subdivision with the following amendments on the Development Agreement: 3.1 that currently states the maximum density for the property shall be 2.83 dwelling units per acre, 52 single family lots, add to that the minimum lot size shall be 7,000 sq.ft. in order to allow the south lots to be reduced in size slightly so that the northerly road can be redesigned to include some curvature with staff reviewing the final redesign, Item 3.4 under setbacks just to clarify: under front after it lists the dimensions, in additional parentheses, state that the setbacks shall be measured from the back of the sidewalk, which faces the home, under 3.7 it shall read the owner shall be required to work with the Ballantyne Ditch Company in order to determine the proper pipe size, and all the rest is deleted for discussion and a new condition to the preliminary plat wait, modify condition 12 on the preliminary plat which talks about design review adding at the very end that the open space shall also include a tot lot with the amenities to be reviewed by the Design Review Board, and then adding another condition which shall be condition 18 that signage shall be placed in appropriation locations to prohibit construction traffic from using the stub street that comes from the north, appropriate location shall be determined by staff, appropriate locations may also include entry road into Eagle Creek which intersects Park Lane. Discussion. Butler amends the motion to include condition #19; the Developer shall work with the property owner who wrote a letter to the City with regard to the fencing location. Butler amends the motion the developer shall work with Drainage Ditch #2 and the property owner to the south to tile the ditch and if an agreement cannot be reached this item shall be re- discussed at final plat. CPA- 01- 15/A- 01- 15/RZ -04 -15 LR5, LLC — Linder Crossing — LR5, LLC.: LR5, LLC represented by Shawn Nickel of SLN Planning, is requesting, a Comprehensive Plan Text Amendment to amend the density language for the "Rim View Planning Area ", and a Comprehensive Plan Map Amendment to change the future land use map designation from Transitional Residential to Mixed Use, and annexation and rezone from RUT (Residential Urban Transition - Ada County Designation) to MU -DA (Mixed Use with a development agreement [in lieu of a conditional use permit]) to construct a166 -unit apartment complex. The 11.13 acre site is located approximately 1,300 feet north of the intersection of Chinden Road and Linder Road at 6940 & 6910 N. Linder Road.(WEV) Mayor introduces the issue. Shawn Nickel, representing the applicant, provides Council an overview of the project. Dan Thompson, Thomason Engineers, we were retained to do a traffic impact study in accordance with ACHD requirements. Provides an overview of the traffic impact study. General discussion. Douglas Gibson, I'm here to offer professional architect design testimony for the project. Discusses reasons why the project is suitable for this area. Planning and Zoning Administrator Vaughan provides Council an overview of the project and the intent of the staff recommendation. Mayor opens the Public Hearing Jeff Beagley, 6940 N. Linder, I sold this property to them based upon this development as it looked like the best development of the property. I support this development. Matt Eells, 6910 N. Linder Road, this property has been in my family for 43 years, and we have seen significant growth in Eagle and in this area. Some members of my family have found it hard to find suitable affording housing in Eagle and this project will provide this suitable housing. We are in support of the project. Merlyn Bodily, 7075 N. Linder, I am half owner of the Gated Garden Subdivision, we have never been in approval of this project. General discussion. Jule Eberle, 7100 N. Rhine Ave, the reason that I oppose this is because of the traffic and the congestion. This design is going to constrict peoples' ability to move out of this road to the north. I have concerns about changing the comp plan. I'm also concerned about the environmental impact. Cam Willett, 7100 N. Rhine Ave, I have 30 years in the area and I am a construction worker and my question is when does construction on the road begin? Construction will have a major impact on traffic and noise pollution. I really don't see any positive. Steve Wilhelm, 7100 N Rhine Ave, I have been here a year and traffic has multiplied to being unreasonable. I am opposed. Merrilee Morton, 7305 Ribier Drive, I am opposed to this. Discusses the comp plan. I feel that this area was originally a rural area and went to residential rural and this doesn't allow for the continuance of how our homes were built. We already have large residential multifamily units in our area. Evelyn Petty, 2101 Almaden Drive, we bought our property 23 years ago. It is a nice quiet subdivision and with this project I am concerned about the traffic. It was mentioned in the presentation about foot traffic. I am opposed to this project. Discusses the height and the lighting. This is going to be a tremendous eye sore. Avery Epperly, 2180 Rhine Ave., I can't afford to live in Eagle and this project would not be affordable. There has been rapid development in this area and transition zones. Discusses transition in the area. This housing does not advance affordable housing. Joe Borton, 4398 Red Grass Court, Meidian, I was brought into this project a while back in regards to the private roads. It is within the Council's discretion to approve private roads. Your comp plan addresses this type of development. The Eagle Island Market Place changed everything in this area. This application is consistent with your comp plan. Carol Montierth, 7175 N. Springcrest Place, I am very much opposed to the change of use. This is not in agreement with your comp plan. We want this to be a safe area. I ask you not to approve this. Hal Bunderson, 582 River Heights Drive, why does the applicant persist in misrepresenting the plat of the Gated Garden Subdivision? What has been given to you are my prepared remarks. There is no support from the neighbors. Summarizes his prepared remarks. Scott Trosper, 7110 Springcrest PI, discusses the comp plan and transition. There is continuous erosion in the comp plan. The density of this project is way over the top. Foad Roghani, 2273 Ribier Dr, I am right across the street from this project. Discusses the density and the affordability of these units. Follow the guidelines of the staff. Ken Mallea, 2241 Almaden, I oppose the project and recommend to you the findings from your Planning and Zoning Commission. Discusses amending the comp plan. This project is in the wrong place. Tom Ferch, ACRD, discusses the ACHD's recommendations. The traffic impact study was not requested by ACHD. General discussion. Butler moves on the comp plan, I recommend that we do modify the comp plan but not mixed use, that we do high density on the property and that the language state something like: the density shall be allowed to be high density but will transition from 16 units per acre adjacent to Linder Road to a compatible density of around 6 units per acre adjacent to Gated Gardens. Butler moves based upon state statutes on mediation that the mediation policies be moved forward with, that the developers meet with the affected neighbors and two Council Members that chose to meet and our City Attorney and City Staff and see if they can work out a revised plan and once that is done that another public hearing be scheduled and if they do work out a revised plan we have that public hearing and if they don't work out a revised plan then this comes back on the agenda understanding that public comment is over and we act on this. RZ -03 -06 MOD /CU- 05- 15/PPUD- 02- 15/PP -06 -15 — Shadowbluff Planned Unit Development - Envision Homes, Inc. — Chad Olsen: Envision Homes, Inc. — Chad Olsen, represented by Shawn Nickel with SLN Planning, Inc., is requesting a development agreement modification, conditional use permit, preliminary development plan, and preliminary plat approvals for Shadowbluff Subdivision, a 19 -lot (15- buildable, 4- common) residential planned unit development. The 4.35 -acre site is generally located at the west side of North Horseshoe Bend Road approximately a quarter mile south of the intersection of East Floating Feather Road and North Horseshoe Bend Road. (WEV) Mayor introduces the issue. Shawn Nickel, representing the applicant, provides the Council an overview of the application. Planning and Zoning Administrator Vaughan, staff and the Planning and Zoning Commission have recommended approval of this application. Mayor closes the Public Hearing Zoning Administrator Vaughan: Since I brought up the issues of development for your consideration to be placed in the Development Agreement and to be included in your findings, I provided those conditions to Mr. Nickel this evening and item 3.5 in those recommended conditions of development states: owner shall provide potable water and sewer connections to the parcel containing the existing residential dwelling located at 10895 Horseshoe Bend Road, upon completion of the subdivision owner shall connect the existing residence to potable water and central sewer. Discussion. Mayor reopens the Public Hearing Shawn Nickel: this is the first time I have seen these conditions. Based upon my conversations with staff, we strike 3.5 or allow us to modify it with staff based on the comments that we previously had. Discusses the drain field. I believe that issue is resolved. I still think we can revise 3.5 to the satisfaction of staff. Mayor recloses the Public Hearing Butler moves to approve RZ -03 -06 MOD /CU- 05- 15/PPUD- 02- 15/PP -06 -15 with any conditions that are in the staff report with the Development Agreement that has the first three criteria which are basic criteria in a development agreement, generally 3.1 that the owner will develop the property subject to the conditions that are provided by staff and it Page 8 KACOUNCIUMTNUTES \Temporary Minutes Work AreACC- 09 -22 -1 Smin doc goes on with standard language that Bill has, 3.2 owner shall complete the Design Review process with the standard language that Bill has, 3.3 that the concept plan, the plan that was submitted today, represents the owner's current concept for the project, that standard language in the development agreement, and specifically that this specific plan with the density that is proposed and the layout that is proposed is approved as is with a condition that two trees be planted in the back of each lot prior to certificate of occupancy for each property. There shall be a roll call vote on the motion and the vote shall be recorded in the minutes. An executive session shall be authorized by a two- thirds (2;`3) vote of the governing body. An executive session may be held: A. 474 -206 (1)(f) Pending and /or Threatened Litigation: To communicate with legal counsel for the public agency to discuss the legal ramifications of and legal options for pending litigation, or controversies not yet being litigated but imminently likely to be litigated. The mere presence of legal counsel at an executive session does not satisfy this requirement. Lot Lines/Fence Lines for Lots along Shadow Bluff to match Lot Lines/Fence Lines for existing homes along the southside of Shadowwolf Dr. We ask that the fence lines and lot line along Shadowwolf neighbors line up. This can be done quickly and easily by subtracting one lot. If the Council decides that unmatching lot lines are ideal and approved, the developer in discussion after the Planning and Zoning Hearing agreed to extra tree plantings in the rear yards(each backyard corner,2 trees per lot). We ask this condition be added to the development agreement or placed as a condition once building permits are pulled on each lot. 2. Subdivision Park- During the Planning and Zoning hearing there was lengthy discussion between the HOA and the Commission with the Chairman ending the discussion, stating "He could see the park area at either location." Commissioner Smith asked for data to support our assertion, that a centrally located park is better planned, safer and a better amenity to the overall community. A simple search of planning publications and scholarly journals would support our request that the common area be located in the middle of the subdivision and not tucked back in a corner, out of sight and out of mind. The common area and the subdivision most likely will become part of the Shadowridge HOA, just like Shadowview. The park should be a focal point, easily shared and a meeting place for kids and families. It will be safer with more homes having direct view of the park. Page2of2 . 3. The Shadowridge Board would like to confirm that the improvements along Horseshow Bend road(sidewalk connection, common area) be constructed when ground breaks on either parcel. The elimination of curbside plastic bag pick-up and limiting the pick-up of yard waste to four weeks in November are radical changes in business practice that, I believe, violate both the letter and the intent of the 1998 Contract and the First and Fourth Addendums, regardless of the "inconsistency" language, contained in paragraph 1. Defined Terms, of the Fourth Addendum. Paragraph 4, 1 c and ld of the Fourth Addendum define unlimited service as a contractor supplied cart or customer supplied cans. How can this service be defined as unlimited when the practice of unlimited since 2010 ---and consistent with the 1998 Contract and the First Addendum of 2003 ---has been contractor supplied cart(s) and customer supplied cans and non -containerized curbside plastic bags and tied bundles? Because this has been the practice, it is reasonable to conclude that the intent and assumption of the Fourth Addendum was to continue in force 3.1 A (2) and 3.1 A (7) from 1998 and 3.1 A (3) and 3.1 A (8) from 2003. It was reaffirmed by Republic Services at the August 25, 2015, council meeting that the collection of tied bundled waste will continue. In the Fourth Addendum, tied bundles are not specified or deleted, but 3.1 A (7) (1998) and 3.1 A (8) (2003) mention them specifically. It is reasonable to conclude from this that, by not specifying and deleting 3.1 A (2) and 3.1 A (3) in the Fourth Addendum, these paragraphs, too, remain in effect. We need a reasonable alternative to the changes in unlimited service that Republic Services plans to implement. The applicant's revisions to his original plat are relatively minor compared to the matters discussed below — the applicant still does not satisfy or even address the major concerns of B&B and its other neighbors and neighborhoods. 2. When you approved Gated Garden subdivision, you did so specifying transitional density. Eells and Beagley, then owners of the subject land, were part of that application (since withdrawn). As part of those deliberations at the Staff, P&Z Commission and City Council levels, it was made clear that Eells and Beagley would also be required to comply with that same transitional density for their property. The subject application violates all of those directions, discussions and understandings — They are now proposing nearly five times the density allowed. 3. Three-story apartment buildines towering over Gated Garden's sinsrle story cottage homes will adversely affect those homeowner's property values by diminishing their privacy and resulting quality of life. 4. Traffic - Unresolved Problems: a) I expect there will be a "traffic back-up" at the Linder Crossing/West "Temple Drive junction and the short distance to the Temple Drive/Linder road intersections — 166 homes produce a lot of trips. b) ACRD requires the applicant build a thru public street from Temple Drive through the subject property, thus the ACHD required stub access road shown on the approved Gated Garden plat. The applicant has not addressed that requirement. 5. Linder Crossing's "ACHD- required" northern entrance is located a short distance after Gated Garden's landscaped entrance off Linder Road, thus confusing and compromising the name integrity of Gated Garden's entrance. The sheer size of Linder Crossing vs. Gated Garden (166 families on 11 acres vs. 55 families on 17 acres) exacerbates the incompatibility between these two totally different developments. 6. Eagle's Development Staff (Staff) weighed the merits of the applicant's proposal against the City's comprehensive plan and ordinances and ACHD's requirements and found that this application does not even pass threshold requirements. Accordingly, they RECOMMENDED DENIAL of this application. 7. The housing type and density is well suited to this location from a regional perspective and should be viewed as future transit -oriented development. While State Street is the only transit corridor identified in Eagle's Comprehensive Plan however Chinden is identified in the long-range regional transportation plan and ValleyRide's long-range plans as a future transit corridor. The proposal fulfills goals and objectives in your Comp Plan for housing diversity and transit oriented development but the plan has few identified locations to fulfill these. This location provides the city an excellent opportunity to fill this gap. The site and design provide good transition from the lower residential densities to the north and east to the mixed use commercial uses to the south and the significant regional roadway planned immediately to the west. The proposed design creates good connectivity for residents to be able to walk to the Fred Meyer and other retail to the south and is within walking distance to existing and future activities including schools and churches. Public facilities are adequate to serve this use without placing unplanned demand on services. This development proposal fulfills many elements of smart growth development and warrants consideration as an opportunity that helps fulfill Eagle's Comp Plan goals to provide a mix of housing and transit oriented development. All of this leads to my conclusion that from a regional as well as Eagle City perspective this proposed development meets many of the challenges of smart growth and I encourage you to consider the strengths of this project for this location as valid reason to consider the requested higher density. I will be out of town on Tuesday night but would like this letter to be part of the testimony supporting the development. I attended past Council hearings in opposition to a planned apartment project off Ballantyne Road. My opposition to that project focused on compatibilitywith the adjacent homes, including height of the structures in comparison to existing home heights, and traffic, specifically on Ballantyne and other local streets. The opposition testified that this was not the appropriate area of the City to build multi -family, and that there were other areas in the City that were better suited for this use. For the record, I am not against apartments in general, as they are definitely needed in Eagle to serve those that do not wish to, or cannot purchase a house but want the option of renting. I was opposed to the location! When I found out that a new apartment complex was proposed on Linder next to the Fred Myers, my immediate reaction was that someone finally figured out the right location for this type of land use. Next to commercial, where residents have direct access to services and along two major transportation corridors where traffic would not affect local residents seems like the best place for apartments to me. Our concerns are directed to Eagle City Officials who we believe to have disregarded their responsibilities to protect the residents of Eagle and to ensure compliance with ordinances and codes regarding the 1970 Conditional Use Permit granted by Ada County to Ready Pour Concrete Company, modified in 1980 under Monroc/Doil Lane, for property located approximately 1/2 mile west of Horseshoe Bend Road on the south side of State Street annexed into Eagle City. We believe the company is now owned and/or operated by International Stone/Idaho Concrete. Current and historic owners will hereafter be referred to as "Idaho Concrete." Our research leads us to believe City Officials have been negligent in their responsibilities either due to lack of knowledge, or by ignoring their duties, allowing Idaho Concrete to violate the Conditional Use Permit and Modification as follows: 1) By importing huge quantities of untested mineral content gravel from unknown, locations to this State Street location (importation is not included in the approved operation); 2) Constructing mountainous mounds of gravel which in peak winter operation (Sept. — March) exceed the height of the power lines (again, not included in the approved operation); 3) Emanating uncontrolled massive quantities of dust potentially containing significant amounts of the hazardous Crystalline Silica; 4) Operating at all hours of the day and night, emphasizing operations between 10:00 pm and 6:00 am; 5) Erecting spot lights to enable night operations; August 21, 2015 City Officials Page 2 of 4 6) Operating in excess of an 80 decibel noise level allowed by the original use permit; 7) Operating trucks on top of these massive mountains at all hours day and night endangering both the Idaho Concrete employee and the Lakeland Estate property owners; 8) Not providing and maintaining sufficient landscaping with an adequate underground sprinkler systems and required fencing to buffer surrounding properties from plant operations including open access from the green belt; 9) Using State Street property as a junk yard, dumping the owners' construction debris and construction debris by other 'business partners' with no regard to the type, content, or location of construction garbage; 10) Potential pollution of the Boise River through untested, untreated, ponds and leeching minerals from dumped construction debris; 11) Enabling growth of excessive uncontrolled noxious weeds; 12) Operating immediately adjacent to the Lakeland Estates property and endangering its residents; 13) Establishing inadequate narrow, unmaintained, unpaved roads for plant vehicle and equipment use; 14) Requiring a significant increase in the traffic entering and exiting the State Street complex, approximately one truck every one and one-half minutes in peak operations, which was specifically disallowed by the 1980 Modification; 15) Continuous use of temporary mobile home, further compounded by an additional construction trailer; In addition to these significant violations, we believe the importation process constitutes an expansion of a major material change/addition to the operation of an existing gravel pit; limited to a wet crushing process only; limited to the SW % of the SE 1/4 of the plant location thus requiring a NEW conditional use application which we believe has never been sought by Idaho Concrete, nor have violations been recognized by City Officials, further evidencing City Officials' lack of due diligence. These serious concerns are not being brought to you without numerous attempts by individual homeowners to contact Idaho Concrete and City Officials. We have encountered comments such as "grandfathered rights", "nuisance" complaints by residents without foundation, short term mollification followed by immediate reinstate of violations, etc. When the majority of homes within the Lakeland Estate Subdivision were being built, Idaho Concrete was primarily dormant and residents were under the impression that Idaho Concrete was at the end of its life cycle. None of us were aware of the hazards of Crystalline Silica. Doctors cutting through the lungs of stonecutters in the 1700s stated they "found heaps of sand that in running the knife through the pulmonary vesicles he thought he was cutting through some sandy body." In the late 1800s this was given the name silicosis, derived from Latin silex, or flint. Although silicosis has been a recognized ailment for centuries, its presence has become more obvious since the developmentof mechanized mining. Industrial hygiene measures in the western world have resulted in a decline of silicosis in recent years. Article Silicosis, Mesothelioma and Asbestosis are all three occupational related cancers that are preventable. Silicosis is a respiratory disease caused by the inhalation of silica dust, which leads to inflammation and scarring of the lung tissue. Similar to Mesothelioma and Asbestosis, Silicosis silently caused millions of industry related health issues and deaths before it was discovered and could be properly diagnosed. The main cause of Silicosis is long-term exposure to silica. Silica is a common, naturally occurring crystal. It is found in most rock beds and forms dust during mining, quarrying, tunneling, construction and work with many metal ores. Silica is a main component of sand, so glass workers, sand -blasters and construction laborers also receive heavy exposure to silica. Risk factors for Silicosis include but are not limited to any work that includes exposure to silica dust. Mining, stone and concrete cutting, quarrying, road and building construction, work with abrasives manufacturing, sand blasting and many other occupations and hobbies involve exposure to silica. Intense exposure to silica may result in symptoms of or full blown Silicosis in a year or less, but it usually takes at least 10 or 15 years of exposure before most symptoms of Silicosis develop. Silicosis as well as Mesothelioma and Asbestosis have become less common since the Occupational Safety and Health Administration (OSHA) instituted laws and regulations requiring the use of protective equipment, to be provided by employers, that limit the amount of a worker's hazardous material exposure. Now, in most cases, it is legally and lawfully the responsibility of your employer to protect you by providing personal protection equipment (PPE). Page 2 of 2 The three different types -of Silicosis are: * Acute Silicosis — results from short-term exposure to very large amounts of silica. The lungs become very inflamed and may fill with fluid, causing severe shortness of breath and low blood oxygen levels. * Accelerated Silicosis — occurs after exposure to larger amounts of silica over a shorter period of time (5 – 15 years). Inflammation, scarring, and symptoms progress faster in accelerated silicosis than in simple silicosis. * Simple chronic silicosis — results from long-term exposure (more than 20 years) to low amounts of silica dust. Nodules of chronic inflammation and scarring provoked by the silica dust form in the lungs and chest lymph nodes. This disease may feature breathlessness and may resemble chronic obstructive pulmonary disease (COPD). If you feel that you are in an industry with a high risk of exposure to silica dust, or any other hazardous material, you should take it upon yourself to use every method necessary to protect yourself from exposure. It is important to discuss any health concerns that you may have with your employer and have your employer provide you with the personal protective equipment required by law to minimize your exposure to hazardous materials such as silica. It is legally your employers responsibility to provide you with safety devices that will protect you but it is ultimately your responsibility to protect your health and the health of your family. If your employer is lax or refuses to provide for your safety, it is important that you contact your local, state or federal agency that oversees health and safety law and compliance to report it right away. In most situations you can report any negligence anonymously to prevent being singled out and demoted or fired by your employer. Many times your employer will be forced to comply with the laws by the governing agency and your problems will be solved. As an employer myself, I see the need to protect my employees at any cost because they are not only my most valued assets they are people with families and simply - deserve to live and work in the safest environment possible. If your employer does not feel this way, you should not feel one bit of remorse if you have to report abuse to the proper authorities.
