Mayor GUERBER presiding. The following members were present: STAN BASTIAN, KELLI BLAIR. RICK YZAGUIRRE, THOMAS EASON, Moved by YZAGUIRRE and seconded by EASON to approve the minutes of the August 25, 1992 meeting as presented. ALL AYE: MOTION CARRIED. Moved by BASTIAN and seconded by BLAIR to approve the minutes of the September 1, 1992 budget public hearing as presented. ALL AYE: MOTION CARRIED. UNFINISHED BUSINESS: 1992-93 FY BUDGET: Moved by BLAIR and seconded by YZAGUIRRE to take $1,000 from salary and benefits, $1,000 from Capital Expenditures-Building, $1,500 from Capital Expenditures- Recreation, $3,000 from Law Enforcement, and $4,000 from Legal to cut the tax portion of the budget and to identify Water Administration as Carry Over. ALL AYE: MOTION CARRIED. WATER BUDGET: Moved by BASTIAN and seconded by EASON as presented. ALL AYE: MOTION CARRIED. Moved by BLAIR and seconded by EASON to move item #6~ ORDINANCE AND RESOLUTIONS to #13 on the agenda in order to balance the budget with the changed figures. ALL AYE: MOTION CARRIED. PUBLIC HEARING/EAGLE HILLS WEST #5: Mayor GUERBER announced that this was the time and place set for a public hearing on Eagle Hills West #5, a preliminary and final plat. Applicant: Dave Beggrow Location: Intersection of Eagle Hills Way and N. Edgewood Ln. Proposal: a 3 lot subdivision preliminary and final plat Public Testimony: Opposition: Written Opposition: Nell Wilton A1 Courtial Frank Marvin Carol Knudsen Jerry & Debbie Sprague Concerns of the public: traffic, need for open space, water pressure Public hearing closed at 7:55 p.m. Moved by BASTIAN and seconded by YZAGUIRRE to approve the preliminary and final plat as presented with the Standard Subdivision Conditions, all utilities underground and sidewalks along Eagle Hills Dr. ALL AYE: MOTION CARRIED. PUBLIC HEARING/Edgewood Estates Subdivision Mayor GUERBER announced that this was the time and place set for a public hearing on Edgewood Estates Subdivision Applicant: Ron Leslie Location: NE Edgewood between State St. & Hill Rd. Proposal: 33.48 acres, exclusive of existing home site, 113 lots, gross density 3.37, 1 park and 7 common areas w/ pedestrian access trails Presentation given by Don Hubble, Project Engineer, who discussed the park area, bike paths, and building lots. Mr. Hubble told the Council the lot sizes were approximately 8,000 sq. ft. He asked for consideration of a cul de sac longer than generally permitted. The cul de sac is 520 ft. Mr. Hubble also indicated that the community water system will be built to Eagle's standards and later to be dedicated to the City, and street lights will be installed by Eagle's standards. The Trails exceed 2,300 ft, the park is 1.8 acres, common areas are in excess of 2 acres. All trees will be specified by the City of Eagle. This is expected to be a 4 to 5 year project. Mr. Leslie agreed, in Eagle than Meridian. developer for support for school impact saying he would rather have fees be used Further discussion took place on the drainage ditch and fencing of the ditch and of common areas. Moved by BASTIAN and seconded by BLAIR to accept the preliminary plat of the subdivision with the Standard Subdivision Conditions, plus the conditions of the Eagle Planning and Zoning Commission with the exception of condition #2 asking for fencing around the canal with a 80% open view. Further, to reconsider condition #2 and present a conclusion at final plat time, to require a letter supporting impact fees, all pathway areas to be paved with asphalt, to accept the 520 ft. cul de sac and meet with the Eagle Pathway Co~tmittee on the location of the pathways through the subdivision prior to submitting a final plat. ALL AYE: MOTION CARRIED. Moved by EASON and seconded by BASTIAN to move item #10-Sheriff's report to the next item on the agenda. ALL AYE: MOTION CARRIED. Lt. Pat Cowles reported on the Sheriff's Department activities in Eagle for the past year and indicated that Ada County crime is up 11%. He told the Council and audience that crimes are becoming more violent in nature, they are beginning to be 2 man calls. There are more people and more awareness on behalf of people. Ada County Transmittal: 92-29-PR/Macaw: Private Rd. Moved by BLAIR and seconded by YZAGUIRRE to approve the Ada County Transmittal as presented. ALL AYE: MOTION CARRIED. Ada County Transmittal: 92-38-PDR/Marshall: 2 Lot Planned Development. Moved by EASON and seconded by BASTIAN to approve the Ada County Transmittal as presented. ALL AYE: MOTION CARRIED. ABC SEAMLESS SIDING-DESIGN REVIEW: Moved by EASON and seconded by BLAIR to approve as presented. ALL AYE: MOTION CARRIED. APPOINTMENTS: Mayor GUERBER presented the appointment of Donald Brinton to Eagle Planning and Zoning Commission for Council consideration. Moved by YZAGUIRRE and seconded by BASTIAN that approval be given to the appointment of Donald Brinton. ALL AYE: MOTION CARRIED. Mayor GUERBER asked for a motion to table the 504 appointments to the next regularly scheduled meeting. Moved by BLAIR and seconded by EASON to table the 504 appointments as requested. ALL AYE= MOTION CARRIED. COMMITTEE REPORTS: Summer Recreation will be available at the next meeting. The seniors discussed the handicapped signs. The sign at the tennis courts has been vandalized and the outdoor facilities at O.K. park were thrown into the canal. Eagle Quest will be meeting at City Hall on Thursday at 7:00 p.m. ATTORNEY REPORT: The attorney discussed the water service statement to be circulated to developers. Moved by BLAIR and seconded by YZAGUIRRE to provide Bob DeShazo, owner of Eagle Water Co. with a copy of the proposal for his input and to put the item on the next agenda. ALL AYE: MOTION CARRIED. A report on the PUC Order #24474 was given limiting Eagle Water Company's service area for the time being. A draft of a memorandum was given to the City Clerk; however, the firm is not comfortable with it. Mike Moore will review the Open Meeting Law and Mona will report to Council on it at the next meeting. Mr. Moore will address the law at the AIC Legislative Meeting on September 18. The Attorney General will be asked to clarify it. A revision of the Eagle Subdivision Standard Conditions has been introduced and will also be addressed at the next meeting. ORDINANCES-RESOLUTIONS: Moved by EASON and seconded by BASTIAN to dispense with the three day ruling and to consider Ordinance 210, the FY92-93 Appropriation Ordinance at this time. ALL AYE: MOTION CARRIED. Moved by EASON and seconded by BLAIR to adopt Ordinance 210 for the upcoming FY92-93 year. ALL AYE: MOTION CARRIED. Moved by BASTIAN and seconded by YZAGUIRRE to adopt Resolution 14- 92, A Resolution for property tax increase over 5% or levy increase. ALL AYE: MOTION CARRIED. CLAIMS AGAINST THE CITY: Moved by YZAGUIRRE and seconded by EASON to approve the claims as presented. ALL AYE: MOTION CARRIED.
