A RESOLUTION OF THE EAGLE CITY COUNCIL TO VACATE THE SOUTHERN SIX FEET OF
THE TWELVE-FOOT REAR YARD PUBLIC UTILITY, PRESSURIZED IRRIGATION, AND
DRAINAGE EASEMENT WITHIN LOT 21, BLOCK 6 (FOXGLOVE ESTATES SUBDIVISION NO.
2)AS SHOWN ON THE ATTACHMENTS HERETO;AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, Jennifer and Leonard Fisher, requested a vacation to the final plat of Foxglove
Estates Subdivision No. 2 to vacate the southern 6-feet of the 12-foot rear yard public utility, pressurized
irrigation, and drainage easement along the rear property line within Lots 21, Block 2 (Foxglove Estates
Subdivision No. 2); and
WHEREAS, On December 7, 2020, the Planning and Zoning Commission recommended
approval of the vacation(VAC-03-20),with conditions,to the Council;and
WHEREAS,Legal notice of the City Council hearing on the vacation was published in the Idaho
Statesman on December 23,2020, and December 30,2020; and
WHEREAS, On January 12, 2021, the City Council held a public hearing on the proposed
vacation(VAC-03-20), and voted to approve the vacation with conditions; and
WHEREAS, The City Council hereby finds that the proposed vacation complies with the
provisions of Section 50-1306A of the Idaho Code, "Vacation of Plats - Procedure", and Section 9-6-2 of
Eagle City Code, "Vacations and Dedications;"and
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF
EAGLE, IDAHO.
The Eagle City Council hereby vacates the southern 6-feet of the 12-foot rear yard public utility,
pressurized irrigation, and drainage easement along the rear property line within Lots 21, Block 6, of the
final plat of Foxglove Estates Subdivision No. 2, as considered, heard, and approved by the Council at its
January 12, 2021, public hearing for application number VAC-03-20, and as shown on the attachments
hereto(Exhibit A).
This Resolution shall be in full force and effect immediately upon its adoption and approval.
ADOPTED by the Council of the City of Eagle, Idaho,this 18th day of February,2021.

final plat'of Foxglove Estates Subdivision No.2,as considered,heard,and approved by the Council at.its
January 12,2021,public hearing for application number VAC-03-20, and as:shown on the attachments
hereto.(Exhibit A)
This Resolution shall be in full force and effect inri ediately upon its:adoption and approval

WHEREAS, Jennifer and Leon Fisher; requested a vacation to the final plat of Foxglove,

WHEREAS, On December 7, 21320, the Planning .and Zoning >Commission recommended
approval of the vacation('VAC-1)3 20),with conditions,to the Council;and.
' 1 AS,Legal notice of the City Council hearing on the vacation was published in the Idaho
States an.en.December 23,2020,and.December 30,202Q;and
WHEREAS, Oa January 12, 2021, the City Council held a public hearing on the proposed
vacation(VAC--0 20),and voted to approve the vacation with conditions;and
WHEREAS, The City Council hereby finds that the proposed vacation complies with the
provisions of Secticni 550-1306A.of the Idaho Code,"Vaoation of Plats-:.Procedure', and Section 9-6-2 of
Eagle City Code,"Vacations and Dedications;"and
NOW-THEREFORE,: BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY .OF
EAGLE,IDAHO.
