ADDENDUM NO. 1 TO AGREEMENT FOR
CITY PROSECUTOR/CRIMINAL LEGAL SERVICES
DATED OCTOBER 17, 2014
This addendum No. I is entered into % day 5', _, 2015 by and
between the City of Eagle (hereinafter referred to as "Eagle "), and the City of
Boise, (hereinafter referred to as "Boise "), for the purpose of amending and extending an
Agreement for City Prosecutor /Criminal Legal Services dated October 17, 2014.
Whereas, on October 17, 2014, Eagle and Boise entered into an agreement for Boise to
provide certain prosecutorial /criminal legal services to Eagle; and
Whereas, Eagle and Boise desire to modify certain terms of the agreement related to
the amount of payment; and
Whereas, Eagle and Boise desire to extend the agreement as modified for an additional
one (1) year term.
Now, therefore, in consideration of the foregoing, Eagle and Boise agree to amend
that certain Agreement for City Prosecutor /Criminal Legal Services dated October 17,
2014 as follows:
1. That Section 4 of the Agreement is hereby modified to read as follows:
4. PAYMENT FOR SERVICES. Eagle agrees to pay Boise for services rendered
pursuant to the terms of this Agreement as follows:
4.1.1 As compensation for all Prosecution Services, Eagle shall pay Boise the total
sum of five thousand and sixty four and 17 100ths dollars ($5,064.17) per
month, with an annual total cost of sixty thousand seven hundred and seventy
dollars ($60,770) which is inclusive of all expenses incurred by Boise in
performing the prosecution services.
4.1.2 Payment of %rimary Legal Services shall be paid by Eagle to Boise on or
before the 20t day of the following month.

2. That section 9 of the Agreement is hereby modified to read as follows:
POSSIBLE EXTENSION OF TERM OF AGREEMENT. The parties may mutually
agree to extend the term of this Agreement, as provided in the Contract Extension —
FY -2016, attached hereto as Exhibit "D"
3. Except as modified by this Addendum No. 1, the original Agreement for City
Prosecutor /Criminal Legal Services between the City of Eagle and the City of
Boise dated October 17, 2014, shall remain in full force and effect.

CONTRACT EXTENSION - FY -2016
Prosecution and Criminal Legal Service for the City of Eagle
Cost for Services
The Boise City Attorney's Office proposes to continue to offer the City of Eagle a flat annual fee
to be billed in monthly installments to provide the services described in this proposal.
Primary Legal Services
Primary prosecutorial legal services include:
• Prosecutorial intake screening and review of all police - generated misdemeanor reports
and citations;
• Timely filing decisions and notification to Eagle Police;
• Prosecution of infractions and misdemeanors occurring within the Eagle City limits or
pursuant to Memorandums of Understanding or Joint Task Force Enforcement between
EPD, MPD and BPD;
• Victim - Witness services through a dedicated coordinator;
• Coverage of the additional caseloads in the new criminal courtrooms assigned by the
Trial Court Administrator.
Primary civil legal advice and guidance to the Eagle Police Chief and EPD to include:
• Access to members of the Police Advice Team for immediate assistance 24 hours a day,
7 days a week through cell phone and/or pager pursuant to EPD's protocol;
• Assistance with telephone blood draw DUI warrants;
• On -site legal services one day per week;
• Legal training for EPD Officers as requested by the Chief;
• Coordinated release of legal bulletins that include Idaho case law, U.S. Supreme Court,
and the Ninth Circuit holdings in consultation with the Ada County Sheriff's legal
counsel and the Chief.
Annual Cost - $ 60,770 Monthly Installment - $ 5,064.17
