Minutes
1. CALL TO ORDER: Meeting called to order at 6:02 P.M.
2. ROLL CALL: Present: WRIGHT, GUERBER, MCLAUGHLIN, SMITH & MCCAULEY. A
quorum is present.
3. CONSENT AGENDA:
♦ Consent Agenda items are considered to be routine and are acted on with one motion. There
will be no separate discussion on these items unless the Chairman, a Commissioner, member
of City Staff, or a citizen requests an item to be removed from the Consent Agenda for
discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in
a sequence determined by the Rules of Order.
♦ Any item on the Consent Agenda that contains written recommendations from the City of Eagle
shall be adopted as part of the Planning & Zoning Commission's Consent Agenda approval
motion unless specifically stated otherwise.
A. Minutes of January 19, 2021.
B. Findings of Fact and Conclusions of Law for the Approval of A-11-20 & RZ-15-20 —
Annexation and Rezone from RUT to R-E-DA — Russell and Collette Brunson: Russell
and Collette Brunson, represented by Todd W. Heist with TWH Construction, are requesting
annexation and rezone from RUT (Rural -Urban Transition — Ada County designation) to R-E-
DA (Residential -Estates with a development agreement). The 5-acre site, consisting of two (2)
parcels, is located on the south side of East Clearvue Drive approximately 845-feet east of
North Meridian Road at 385 East Clearvue Drive. (MJW)
C. Findings of Fact and Conclusions of Law for the approval of A-10-20 & RZ-13-20 —
Annexation and Rezone from RUT to C-1-DA for a Convenience Store with Fuel Service
— Treasure Valley Chevron, Inc: Treasure Valley Chevron, Inc., represented by Stephanie
Leonard with KM Engineering, is requesting annexation and rezone from RUT (Residential -
Urban Transition — Ada County designation) to C-1-DA (Neighborhood Business District with
a development agreement [in lieu of a conditional use permit]) for a mixed used commercial
development, which includes a convenience store with fuel service. The 10.01-acre site is
located at the southeast corner of West Beacon Light Road and North Highway 16. (MJW)
McLaughlin moves to approve the consent agenda as presented. Seconded by McCauley.
ALL AYES... MOTION CARRIES.
4. ACTION ITEM: Election of Chairman and Vice -Chairman of the Planning & Zoning
Commission.
City Attorney Victor Villegas requests that the Commission postpone discussion of these positions
to May when the positions expire.
Guerber moves to continue item 4 regarding the election of the Chairman and Vice -
Chairman of the Planning & Zoning Commission to May 1, 2021. Seconded by McCauley.
ALL AYES... MOTION CARRIES.
City Planner, Mike Williams asks the Commission to move the new business item 7A (VAC-
01-21) ahead of agenda item 6A & 613, and to hear item 611 before item 6A, for the sake of
time.

5. UNFINISHED BUSINESS: NONE.
6. NEW BUSINESS:
A. VAC-01-21— Vacation to the final plat of Streamside Subdivision — Todd and Kristy
Shreeve: Todd and Kristy Shreeve are requesting to vacate the plat notes specifying
additional setback requirements for Lot 43, Block 1, Streamside Subdivision. The .76-acre
site is located on the southeast corner of South Marypost Avenue and West Bogus View
Drive at 452 West Bogus View Drive. (MJW)
City Planner, Mike Williams, provides an overview of the application on behalf of the applicant.
Williams responds to questions from the Commission.
Smith moves to recommend for approval item 5A (VAC-01-21) — Vacation to the final plat
off Streamside Subdivision with the staff recommended conditions. Seconded by Guerber.
ALL AYES... MOTION CARRIES.
6: 7. PUBLIC HEARINGS:
B-. A. ACTION ITEM: A-09-20 & RZ-12-20 — Annexation and Rezone from RR and RUT to
R- E- DA — J&M Land, Cabra Creek, and M2 Land (LLC's): J&M Land, LLC, Cabra
Creek LLC, & M2 Land LLC, represented by Van Elg and Scott Wonders, P.E., with J-U-B
Engineering, are requesting annexation and rezone from RR (Rural Residential — Ada County
designation) and RUT (Residential -Urban Transition — Ada County designation) to R-E-DA
(Residential -Estates with a development agreement). The 388.4-acre site, consisting of nine (9)
parcels, is located on the north side of West Beacon Light Road and the east side of Hartley Road
at 4012 North Hartley Road and 5802 West Beacon Light Road. (MJW)
City Planner, Mike Williams requests that this hearing be continued to the February 16, 2021
Planning and Zoning Commission meeting to allow staff more time to complete the staff report.
Guerber moves to continue 6A A-09-20 & RZ-12-20 — Annexation and Rezone from RR and
RUT to R- E- DA — J&M Land, Cabra Creek, and M2 Land to February 16, 2021.
Seconded by McLaughlin. ALL AYES ... MOTION CARRIES.
B. ACTIONITEM: RZ-11-20 & PP-06-20 — Rezone from A-R to R-7-DA and Preliminary
Plat for Eastfield Subdivision — Erika and Dylan Schneider: Erika and Dylan Schneider,
represented by Mark Butler with Land Consultants, Inc., is requesting a rezone from A-R
(Agricultural -Residential) to R-7-DA (Residential with a development agreement [in lieu of a
PUD]) and preliminary plat approvals for Eastfield Subdivision, a 35-lot (30-buildable, 5-
common) residential subdivision. The 4.58-acre site is located on the northwest corner of East
Hill Road and North Edgewood Lane at 200 North Edgewood Lane. (MJW)
Mark Butler, 1675 East Bishop Way. The applicant's representative provides a detailed description
of the development and overview of the application.
Butler responds to questions from the Commission.
City Planner, Mike Williams, provides a detailed overview of the application.
Williams responds to questions from the Commission.
Chairman Wright opens the Public Hearing.
Dawn Haskins, 218 North Harvey Lane (via WebEx). Haskins expresses concerns related to high -
density housing. Haskins feels that this development does not fit into the neighborhood and Eagle

needs to maintain more open space.
Kurt Rockenhaus, 201 Sanders Street (via WebEx). Rockenhaus is opposed to such high -density
housing and would like to see the density reduced.
Karen Towne, 1544 West Hampton Bay Drive (via WebEx). Towne is a lifelong resident of Eagle
and supports this development. She and her husband farmed this property for over 40 years and
watched the development of Hill Road throughout the years. Towne states that while she and her
husband farmed their property over the years, their longtime neighbors always spoke of supporting
the development of this property and that its refreshing to see it developed by longtime Eagle
residents.
The applicant's representative, Mark Butler, addresses concerns raised during the Public Hearing
and provides rebuttal.
Chairman Wright closes the Public Hearing.
General discussion amongst the Commission.
Guerber moves to recommend for approval item 611, RZ-11-20 & PP-06-20 — Rezone from A-
R to R-7-DA and Preliminary Plat for Eastfield Subdivision with the standard city guidelines
the addition of the ITD traffic report, that we limit the number of buildable lots to 27 with 5
common lots, and the staff recommended conditions on items 3.4 and 3.9. Seconded by
McCauley. 4 AYES... MOTION CARRIES (McLaughlin abstains).
8. REPORTS:
A. Commission: Smith expresses concern about the damage made to the Church outside City Hall
as well as the yellow building on Highway 44. City Planner Williams responds to questions.
B. City Attorney: None.
C. Staff. City Planner Williams informs P&Z Commission that a Planner and GIS Technician
have been hired.
9. ADJOURNMENT:
