The Eagle City Council met in special session on June 11, 1992.
Mayor GUERBER presiding.
The following members were present: RICK YZAGUIRRE, THOMAS EASON,
STAN BASTIAN. Absent: KELLI BLAIR.
A special meeting was conducted by Eagle City Council with
representatives of Lexington Hills Subdivision and Trail Creek/Echo
Subdivision present. The special meeting was scheduled to
determine action taken on lots where sanitary restrictions are in
effect as mandated by the Department of Environmental Quality. DEQ
lifted sanitary restrictions to 25 homes in Lexington, however, 28
homes are currently under construction. Any further building in
the two subdivisions will continue to have sanitary restrictions
until a release of those restrictions is received by DEQ. DEQ will
not lift the restrictions without approval of a second well and the
pond is sealed.
After discussion took place regarding the two developments, and the
restrictions, a motion was made by YZAGUIRRE and seconded by
BASTIAN not to issue any stop work orders on any homes under
construction over the 25 without restrictions. ALL AYE: MOTION
CARRIED.
Further discussion resulted in an agreement that no active
connections to any water meter will be completed over the 25
permitted by DEQ until restrictions are lifted. The builders will
be advised by the Lexington representatives of the problem.
Lexington will report to Council on the progress at the next
regularly scheduled meeting. Keith Stokes, EM2 will be advised of
the restrictions.
Moved by EASON and seconded by YZAGUIRRE not to make those active
connections for more than 25 homes until restrictions are lifted,
and no building_~ ~,?rmits will be issued by the City for Lexington
