MEETING MINUTES
January 26, 2021
1. CALL TO ORDER: Mayor Pierce calls the meeting to order at 5:30 p.m.

5. REPORTS:
A. Mayor and Council Reports: Pittman states they have been conducting interviews for the
Development Impact Fee Advisory Committee and there should be recommended
appointments on a future agenda.
B. City Hall Department Supervisor Reports: Nichoel Baird Spencer reports on the
upcoming ITD construction project on Highway 44 and Eagle Road.

Steve Bender thanks Council Member Gold for her service, she is a credit to the Council and the
City.
Jane Rohling 582 N. Palmetto Drive, Eagle, Idaho. Ms. Rohling thanks Council Member for her
service. Gold was a valued member of the community, and Ms. Rohling is saddened at how Gold
has been treated while she was running her campaign and even after she was elected.
Jane Buschart, 235 W. Floating Feather, Eagle, Idaho. Ms. Buschart wants to thank Council
Member Gold for her service to the City. Gold has served on the Urban Renewal Agency and was
always prepared and thoughtful in her contributions to the Agency and Council.

E. FPUD 04 20 & FP-04-20 — Final Development Plan and Final Plat for Molinari
Park Subdivision No. 1 — Eagle 26, LLC: Eagle 26, LLC, represented by Brian
Liquin with Rennison Design, is requesting final development plan and final plat
approvals for Molinari Park Subdivision No. 1, a 41-lot (34-buildable, 7-common),
mixed use subdivision. The 5.18-acre site is located on the south side of East Plaza
Drive approximately 300-feet east of the intersection of South 2nd Street and East
Plaza Drive. (MJW)
F. FP 10 19 Final Plat for Bellemeade Subdivision — Madera Development, Inc.:
Madera Development, Inc., represented by Mary Wall with Breckon Land Design, is
requesting final plat approval for Bellemeade Subdivision, an 80-lot (72-buildable, 8-
common) residential subdivision. The 10.99-acre site is located on the north side of
West Flint drive at the northeast corner of West Flint Drive and North Park Lane at
3850 West Flint Drive and 312 North Park Lane. (MJW)
G. DR 52 20 Storage Facility (Enclosed Buildings and Canopies), including the
Streetscape in front of an existing Single -Family Dwelling — Rob Martin: Rob
Martin, represented by Jeff Hatch with Hatch Design Architecture, is requesting design
review approval to construct a storage facility with enclosed buildings totaling
102,888-square feet and canopies totaling 44,823-square feet, including the streetscape
in front of an existing single-family dwelling. The 7.3-acre site is located on the south
side of West State Street approximately 400-feet west of the intersection of South
Payette Way and West State Street at 1601 West State Street. (BAW)
H. DR 72 20 Common Area Landscaping within Rene Place Subdivision — Sterline
Land Development, Inc.: Sterling Land Development, Inc., represented by Kim
Siegenthaler with Jensen Belts Associates, is requesting design review approval of the
common area landscaping within Rene Place Subdivision. The 18.51-acre site is
located at the northeast corner ofNorth Dicky Drive and North Rene Place at 500 North

I. DR 74 20 Office (Medical and Dental) Building within Hill Road Crossing — Dr.
Jacob Jarvis: Dr. Jacob Jarvis, represented by Jessica Petty with 12.15 Design, LLC,
is requesting design review approval for a 4,000-square foot office (medical and
dental) building. The 0.54-acre site is located on the southeast corner of East Hill Road
and North Echohawk Lane at 60 North Echohawk Lane within Hill Road Crossing.

SF) for Highland Homes. The 0.97-acre site is generally located south of East Shore

K. DR 76 20 Master Sign Plan for a Multi -tenant Office (Business and
Professional) Building — Highland Homes: Highland Homes, represented by
Virginia Cunningham with Golden West Signs, is requesting design review approval
for a master sign plan for a multi -tenant office (business and professional) building.
The 0.97-acre site is generally located south of East Shore Drive at 1015 South
Bridgeway Place (Lot 24, Block 4, Mixed Use Subdivision No. 5) within Eagle River
Development. (BAW)
L. Planning Support Services Agreement with Katherine Wright: An agreement
between Katherine Wright and the City of Eagle for Planning support services in an
amount not to exceed $10,000. (WEV)
M. Parks and Recreation Independent Contract Instructor Agreement: Authorizing
the Mayor to execute an agreement for an independent contract instructor with Create
and Learn to facilitate online computer coding classes for youth for the Parks and
Recreation Department. (BJ)
Pittman asks that item 8G and 8H be removed.
Pike moves to approve consent agenda items A through M, excluding G and H. Seconded by
Bann. BAUN AYE, GOLD AYE, PITTMAN AYE, PIKE AYE. ALL AYE ... MOTION
CARRIES.
G. DR 52 20 Storage Facility (Enclosed Buildings and Canopies), including the
Streetscape in front of an existing Single -Family Dwelling — Rob Martin: Rob Martin,
represented by Jeff Hatch with Hatch Design Architecture, is requesting design review approval to
construct a storage facility with enclosed buildings totaling 102,888-square feet and canopies
totaling 44,823-square feet, including the streetscape in front of an existing single-family dwelling.
The 7.3-acre site is located on the south side of West State Street approximately 400-feet west of

Council member Pittman poses questions regarding the proposed fencing material. He would also
would like the record to reflect that he was opposed to the original final plat associated with this
development.
Planner II Gero discusses the placement and the fencing material options as allowed in Eagle City
Code, as well as the recommendation of the Design Review Board.
Gold notes that she too voted against this development when it came forward as a land use item.
Her concerns remain the same with this application.
Bann moves to approve DR-52-20 — Storage Facility (Enclosed Buildings and Canopies),
including the Streetscape in front of an existing Single -Family Dwelling Seconded by Pike.

Land Development, Inc.: Sterling Land Development, Inc., represented by Kim Siegenthaler with
Jensen Belts Associates, is requesting design review approval of the common area landscaping
within Rene Place Subdivision. The 18.51-acre site is located at the northeast corner of North
Dicky Drive and North Rene Place at 500 North Rene Place. (ERG)
Pittman questions the future access on the golf course site of the development.
Planner 11 Gero and Planner III Williams provide clarity on the conditions of approval with the
development application. Williams states that Council did not include the requirement of the stub
street in the conditions of approval.

A. ACTIONITEM.• RZ 08-19 MOD — Modifcanon to the Lanewuuu I.u. Lu „�•._��_���-
Aimeement — SCS Brighton, LLC: SCS Brighton, LLC, represented by Kody Daffer, is requesting
a modification to the rezone development agreement associated with the approved Lanewood North
Subdivision. The request is to allow for privacy fencing along the northern and southern subdivision
border and provide a revised fencing exhibit to the development agreement. The 81.16-acre site is
located between North Lanewood Road and North Linder Road approximately 1,100-feet south of
the intersection of North Lanewood Road and West Beacon Light Road at 2810 North Lanewood
Road and 2553 North Linder Road. (MJW)

Kody Daffer, 2929 W. Navigator Drive representing SCS Brighton LLC reviews the application.
They are requesting the installation of privacy fencing along the norther and southern subdivision
border.
Mike Williams, Planner III reviews the how the applicants request would modify the development
agreement should it be granted.
Mayor opens the public hearing.
Nancy Merrill, 3268 W. Skywood Lane, Eagle, Idaho. She would hope that the privacy fencing
would compliment the surrounding areas and if there are any plantings proposed.
Planner III Williams states should this be approved a modified Design Review application would
be required, fencing style, color and plantings would be addressed at that time.
Mr. Daffer states they intend to match fencing in the Homestead when they bring the application
forward.
Mayor closes the public hearing.
Pittman states he believes the fencing will complement the area, and that the fencing will abut
existing homes.
Pittman moves to approve action item 10A RZ-08-19 MOD — Modification to the Lanewood
North Development Agreement —to allow for privacy fencing for the homes indicated on the
north and south side and bring back an updated fencing proposal with the updated privacy
fencing showing on the maps but also with any open style fencing that is required in the
community development. Seconded by Bann. Discussion. Clarification that the open style
fencing is adjacent to the open space. ALL AYE ... MOTION CARRIES.

B. ACTION ITEM: A 04 20/RZ 04-20/CU-02-20/PPUD-01-20/PP-02-20 — Annexation,
Rezone with Development Agreement, Conditional Use Permit, Preliminary Development
Plan, and a Preliminary Plat for Stags Crossing Subdivision — Urban Solutions, LLC: Urban
Solutions, LLC., represented by Steve Hart, is requesting an annexation, rezone from RUT (Rural -
Urban Transition — Ada County designation) to R-2-DA-P (Residential with a development
agreement — PUD), conditional use permit, preliminary development plan, and preliminary plat
approvals for Stags Crossing Subdivision, a 135-lot (113-buildable, 22-common) residential
planned unit development. The 67-acre site is located on the south side of West Beacon Light Road
approximately 2,000-feet west of North Lanewood Road. (MJW)
Mayor Pierce introduces the item.
Steve Hart, PO Box 1304, Eagle, Idaho representing Urban Solutions LLC. Mr. Hart reviews the
application and discusses phasing and construction traffic.
Mike Williams, Planner III reviews the staff report including site specific conditions of approval
and special areas of concern including fencing, setbacks, streetlights, pathways ITD proportionate
share and construction access.
Pike discloses that he received two text messages regarding this matter, to which he responded he
could not comment as it is an active land use application.
General discussion.
Mayor Pierce opens the public hearing.
Steve Bender, 1235 N. Seven Oaks Place, Eagle, Idaho. Mr. Bender compliments Mr. Hart with
the proposed development ant it's adherence to code. Construction traffic is an issue, as is the
possibility of walking paths along the canals. Most irrigation companies are not amiable to public
use of the pathways. He is pleased that fencing is proposed but is concerned with the proximity of
the fencing and it still allowing maintenance access for the canal company.
Council member Baun speaks to the negotiations with the canal company.
Kevin Platts reviews the traffic report from ACHD that he provided on this project regarding
construction traffic. (attached to minutes). He feels like their property values will be decreased by
construction values and homeowners would be inconvenienced to reach their property. Mr. Platt
urges the Council to require construction traffic to be required to use Beacon Light Road.
Roger Foster, 1864 N. Heirloom, Eagle, Idaho. Mr. Foster is the president of Syringa Homeowners
Association. He appreciates Council listening to their concerns about traffic and irrigation. They
have met with Mr. Hart and appreciate his time. However, there is still a concern about access to
irrigation for their subdivision. While they have had good conversations, nothing has been
solidified and would like an agreement reached by both parties.
Russ Blair 5733 W. Montage, Eagle, Idaho. He appreciates the project and that they have listened
to the traffic concerns expressed. He expresses his displeasure with deliberation at the Planning
and Zoning Commission and their lack of attention to the concerns expressed during public
testimony. Mr. Blair discusses the magnitude of the traffic and the impact to existing
neighborhoods; he urges the Council to seek an alternative traffic route.
Steve Hart rebuts testimony. Mr. Hart is happy to work with the City should they be able to work
out an agreement with the canal company. He comments on the open fencing styles, construction
traffic, construction timeline, and irrigation.
Discussion between Mr. Hart and Council. Sgt Wilke. He speaks on behalf of traffic enforcement
on Beacon Light Road. There are currently no traffic restrictions on Beacon Light. He has been in
touch with John Wasson with Ada County Highway District regarding the same. There had been
some historic signage that has been removed.

Discussion regarding phasing strategies and irrigation system design. Baun questions if they would
be willing to consider a conservation and education program. Hart states they would be amiable to
that.

Bann moves to approve action item 10B A-04-20/RZ-04-20/CU-02-20/PPUD-01-20/PP-02-20
— Annexation, Rezone with Development Agreement, Conditional Use Permit, Preliminary
Development Plan, and a Preliminary Plat for Stags Crossing Subdivision — Urban Solutions.
With the following conditions of approval.1) With the submittal of the final plat an approved
construction access plan that is approved by the City Staff. 2) Strike Exhibit E in the findings
and replace with the PPRC recommendations dated January 26, 2021 as part of that
recommendation #2 of the PPRC recommendations would be stated that 8' minimum (not 6')
add site specific #17 that an executed traffic control plan be submitted in coordination with
ITD as stated by staff earlier. Condition of approval that open style fencing would be required
adjacent to the irrigation canal in accordance with City Code. In addition to those, not
necessarily a condition of approval, but that staff would work with the applicant CEP
(Conservation Education Program) funding measure, as well as the potential of conservation
easement at the southwest corner. Seconded by Pittman. Discussion. Planner Williams
provides clarification regarding the numbering of the requested conditions stated. And
confirms the condition that the applicant shall provide a copy of the executed ITD mitigation
agreement prior to signing of the first final plat and any construction activity. Staff suggests
that this mitigation would be reviewed and approved by the Council as part of the final plat
approval. Bann amends to make that part of his motion. Second concurs. ALL
AYE ... MOTION CARRIES.
C. ACTION ITEM: VAC-04-20 — Vacation to the final plat of Aquila Village Subdivision
— City of Eagle: The City of Eagle is requesting to vacate the western 6-feet of the 12-foot
subdivision boundary public utility easement located within Lots 6 and 7, Block 1, Aquila Village
Subdivision. The 2.049-acre site is located on the north side of East Civic Lane approximately 250-
feet north of East State Street at 660 East Civic Lane. (BAW)

Planner III, Mike Williams reviews the vacation application and stands for questions.

B. ACTIONITEM: EXT-01-21— Final Plat Extension of Time for Park Lane Estates (FP-14-
18) — Oakmont Signature Homes, LLC: Oakmont Signature Homes, LLC, represented by Dan
Thompson, is requesting an extension of time for the final development plan/final plat approval for
Park Lane Estates Subdivision, a 23-lot (18-buildable, 5-common) residential planned unit
development. The 11.23-acre site is located on the southeast corner of West Beacon Light Road
and North Park Lane at 2686 North Park Lane. (MJW)

A. ACTION ITEM: 2022-2026 Integrated Five -Year Work Plan (IFYWP) Request:
Review the City's Transportation Work Group's recommendation and approve the 2022-2026
recommendation to the Ada County Highway District's Integrated Five -Year Work Plan. (NBS)

Nichoel Baird -Spencer, Planner III reviews the work group recommendations and discusses the
five-year work plan, PowerPoint attached. Staff is not requesting Council action tonight. It will
be placed on the February 4, 2020 Council business meeting for further discussion and potential
action.

A. ACTIONITEM: Acceptance of Resignation of Councilmember Gold Effective January
29,2021.

states that Idaho State Parks and Recreation has an interim Director, Susan Buxton, who has a long
history with the City of Eagle, and it may be an opportunity to move up a pedestrian access near
Eagle Island State Park.

INTERSECTION
The Idaho Transportation Department
will begin construction of a half
continuous flow intersection (CFI) in
February 2021.
The project will improve the intersection
at Eagle Road and Idaho Highway 44
(ID-44) in Eagle by reducing congestion
at this highly traveled intersection that
serves 70,000 drivers each day and is
projected to see a significant increase in
traffic in the coming years.
A half CFI is an innovative intersection MCI
design that improves safety and reduces 4�opHo
congestion. The design has been used
in Utah and many other locations over
the last 10+ years.
A detailed study showed that a half CFI
will significantly decrease delay times
and improve safety at the Eagle Road/ID-
44 intersection. The study showed that
adding lanes to the existing intersection
would not result in the same benefits.
Construction is scheduled to start in
late February and should be complete
by early fall.

Here's how it works
A half CFI allows left -turning traffic and through -traffic to move at the same time in the east
and west direction. Vehicles heading north and south on Eagle Road move into dedicated "right
turn bypass" lanes to turn more efficiently. The layout eliminates the need for a dedicated left -
turn green phase on ID-44, which improves the capacity of the intersection and reduces delays.
The design also includes pedestrian signals and crossings.

(neighborhood meeting and P & Z meeting) but received no response.

We object to the proposed routing of heavy truck and all construction traffic to the Stags
Crossing construction site via Venetian Road or via Arena/Heirloom Place/Venetian
Road to N. Arena when low impact alternatives exist. The noise, debris and inherent
danger these large vehicles bring as they traverse our neighborhood is unacceptable.
Plus the shear volume of DAILY traffic with these MANY contractors and subcontractors
is horrible to go through our Eagle neighborhoods that have no active contraction in
them.
A safer, low impact plan calls for access via Lanewood and the unoccupied Yarnell
to Foudy to Pulaski streets or Beacon Light as stated in the ACHD traffic impact
study. We are requesting that a construction entrance be designated via the above
noted route. ACHD does not have an issue with using this route as the streets are public
and can be used for construction equipment.
Also, have Stags Crossing traffic routed as shown in the ACHD traffic impact map. Up
Linder (or Lanewood) and enter via Beacon Light. That is the traffic impact study map
for Stags Crossing and what was approved! PLEASE make them follow the approved
traffic pattern for all construction traffic.
Why would you allow the use of completely built out residential streets when low impact
alternatives already exist via Lanewood or can be built off their direct relationship to their
property along Beacon Light?
As the employer/developer, Urban Solutions can absolutely dictate the route
employees/contractors take into the development.
I point to Homestead across Lanewood to the east as an example of how a gravel road
was constructed and used for for Phase 3/4/5 of Homestead without going through
Phase 1/2 which was complete at the time. There were large signs up for a year and
then recently new signs installed routing the construction traffic up Lanewood and NOT
through Phase 1/2 of Homestead.
Signs should be required to be posted at the entrances to Syringa and Lilac Springs
subdivisions for contractors not to enter those streets for access to Stags Crossing and
to use Lanewood/Beacon Light. Enforcement should be followed up on to make sure
the contractors follow the signage.
Thank you for your commitment to Keep Eagle, Eagle as it has been and that is what my
family has enjoyed for almost 20 years of living here. Please do not let these
developers disrupt our Eagle Lifestyle to save them money and hurt the residents of
Eagle. We are here for the long run as Eagle residents.

1. Description of Application: The applicant is requesting approval of an annexation and rezone

4. Adjacent Development: The following developments are pending or underway in the vicinity of
the site:

• Belvoir Estates, preliminary plat to develop 913 single family lots, 52 common lots, 2 common
drive lots, 3 private roads, 1 elementary school, and 1 City of Eagle Park on 372 acres locate
directly west of the site and was approved by ACHD Commission on June 5, 2019. However,
this was not approved by the City of Eagle.
• Brookway Subdivision, a preliminary plat to develop 106 single family lots and 17 common
lots on 61 acres directly west of the site and was approved by ACHD November 17, 2017.
5. Transit: Transit services are not available to serve this site.
6. New Center Lane Miles: The proposed development includes 1.85 centerline miles of new public
road.
7. Impact Fees: There will bean impact fee that is assessed and due prior to issuance of any building
permits. The assessed impact fee will be based on the impact fee ordinance that is in effect at that
time. The impact fee assessment will not be released until the civil plans are approved by ACHD.
8. Capital Improvements Plan (CIP)/ Integrated Five Year Work Plan (IFYWP):
• Beacon Light Road is listed in the 2020 CIP to be widened to 3-lanes from SH-16 to Palmer
Lane between 2036 and 2040 (0090).
• Beacon Light Road is listed in the 2020 CIP to be widened to 3-lanes from Palmer Lane to
Linder Road between 2036 and 2040 (0100).
• Floating Feather Road is listed in the 2020 CIP to constructed as new 3-lane roadway from
SH-16 and Palmer Lane between 2036 and 2040 (0540).
• Floating Feather Road is listed in the 2020 CIP to be widened to 3-lanes from Palmer Lane to
Linder Road between 2036 and 2040 (0550).
• The intersection of Beacon Light Road and Palmer Lane is listed in the 2020 CIP to be
reconstructed as a single lane roundabout with 2-lanes on all legs between 2036 and 2040
(0150).
• The intersection of Beacon Light Road and Linder Road is listed in the 2020 CIP to be

9. Roadways to Bikeways Master Plan: ACHD's Roadways to Bikeways Master Plan (BMP) was
adopted by the ACHD Commission in May of 2009 and was update in 2018. The plan seeks to
implement the Planned Bicycle Network to support bicycling as a viable transportation option for
Ada County residents with a wide range of ages and abilities, maintain bicycle routes in a state
of good repair in order to ensure they are consistently available for use, promote awareness of
existing bicycle routes and features and support encouragement programs and to facilitate
coordination and cooperation among local jurisdictions in implementing the Roadways to
Bikeways Plan recommendations.
The BMP identities Beacon Light Road abutting the site as a Level 3 facility that will be
constructed as part of a future ACHD project.

B. Traffic Findings for Consideration
1. Trip Generation: This development is estimated to generate 1,164 additional vehicle trips per day;
114 additional vehicle trips per hour in the PM peak hour, based on the traffic impact study.
Traffic Impact Study
CR Engineering, Inc. prepared a traffic impact study for the proposed Stags Crossing Subdivision.
The executive summary of the findings as presented by CR Engineering, Inc. can be found as
Attachment 3. The executive summary is not the opinion of ACHD staff. ACHD has reviewed the
submitted traffic impact study for consistency with ACHD policies and practices, and may have
additional requirements beyond what is noted in the summary. ACHD Staff comments on the
submitted traffic impact study can be found below under staff comments.
Roadway Segments (red lines) and Intersections Studied (yellow circles)
a. Policy
Mitigation Proposals: Mitigation recommendations shall be provided within the report. At a
minimum, for each roadway segment and intersection that does not meet the minimum
acceptable level of service planning threshold or v/c ratio, the report must discuss feasible
measures to avoid or reduce the impact to the system. To be considered adequate, measures
should be specific and feasible. Mitigation may also include.-
0 Revision to the Phasing Plan to coincide with the District's planning Capital Projects
• Reducing the scope and/or scale of the project.
Alternative Mitigation Measures: 7106.7.3 states that if traditional mitigation measures
such as roadway widening and intersection improvements are infeasible as determined by
ACHD, the TIS may recommend alternative mitigation measures, Alternative mitigation
measures shall demonstrate that impacts from the project will be offset.
• If the impacted roadway segments and/or intersections are programmed as funded in
the Integrated Five Year Work Plan (IFYWP) or the Capital Improvements Plan (GIP);
no alternative mitigation is required.

If the impacted roadway segments and/or intersections are not programmed in either
the IFYWP or the CIP; the applicant may (i) analyze the shoulder hour and (ii) provide
a safety analysis to determine alternative mitigation requirements.
o If the impacted roadway segments and intersections meet the minimum
acceptable level of service planning thresholds in the shoulder hour the
applicant may suggest feasible alternative mitigation such as: sidewalks, bike
facilities, connectivity, safety improvements, etc. within 1.5 miles of the
proposed development.
o If the shoulder hour planning thresholds are exceeded the applicant may
request to enter into a Development Agreement and pay into the Priority
Corridor Fund an amount determined by the ACHD to offset impacts from the
project.
• Alternative Mitigation may also include:
o Revision to the Phasing Plan to coincide with the District's future Capital
Projects.
o Reducing the scope and/or scale of the project.
b. Staff Comments/Recommendations: Staff comments are provided by District Traffic Services
and Development Review staff. Staff has reviewed the submitted traffic impact study (TIS) and
generally agrees with the findings and recommendations.
The TIS indicates that all roadway segments studied meet ACHD's level of service planning
thresholds for the existing 2020 traffic, 2024 background and 2024 total traffic.
The TIS indicated that a designated westbound left -turn is required on Beacon Light Road at
the intersection of Stags Avenue per ACHD's Turn Lane policy. The TIS and applicant's
engineer then indicated that a turn lane should not required per National Cooperative Highway
Research Program (NCHRP) Reports 279 and 457 where the percentage of left turns can be
interpolated between trend lines. However, the applicant should be required to construct the
dedicated westbound left turn lane on Beacon Light Road at Stags Avenue consistent with
District policy.
The TIS identified the intersections of Palmer Lane/SH-44 and Linder Road/SH-44 will exceed
ACHD's level of service planning thresholds for the 2024 background and 2024 total traffic.
The TIS recommended mitigation, however, the PM peak hour site traffic at these intersections
is 4.2% and 5.9%, respectively, of the 2024 total traffic. Therefore, no improvements are
required for these intersections and roadway segment consistent with District policy for Level
of Service Planning Thresholds, that states a proposed development with site traffic less than
10% of the existing downstream roadway or intersection peak hour traffic shall not be required
to provide mitigation for a roadway or intersection that currently exceeds minimum acceptable
level of service planning threshold or V/C ratio.
The TIS identified that the intersections of Palmer Lane/SH-44 and Linder Road/SH-44 exceed
ITD's minimum operational thresholds and recommended improvements to mitigate the
existing, 2024 background and 2024 total traffic. ITD has programmed SH-44 to be widened
between Linder Road and SH-16 in 2023 and a traffic signal project as part of the 2027-20207
Idaho Transportation Investment Program (ITIP) for the Palmer lane/SH-44 intersection in
2027. The ITIP traffic signal project was programmed to address increased traffic and delays
on Palmer Lane with the understanding that ITD would be requesting proportionate share from
new developments in the area to accelerate construction.
ITD is also planning to reconstruct the SH-44/1-inder Road intersection as a continuous flow
intersection. ITD has not set a timeframe for the reconstruction of the intersection.

ITD has requested that the City of Eagle require the developer to pay their proportionate share
of $80,876 towards future improvements programmed by ITD at these intersections.

4. Average Daily Traffic Count (VDT)
Average daily traffic counts are based on ACHD's most currant traffic counts.
• The average daily traffic count for Beacon Light Road west of Linder Road was 3,348 on
6/1 /2017.
• The average daily traffic count for Linder Road south Beacon Light Road was 1,371 on
2/21 /2019.
C. Findings for Consideration
1. Beacon Light Road
a. Existing Conditions: Beacon Light Road is improved with 2-travel lanes and no curb, gutter
or sidewalk abutting the site. There is 50 to 73-feet of right-of-way for Beacon Light Road (27-
feet from centerline).
b. Policy:
Arterial Roadway Policy: District Policy 7205.2.1 states that the developer is responsible for
improving all street frontages adjacent to the site regardless of whether or not access is taken
to all of the adjacent streets.
Master Street Map and Typology Policy: District Policy 7205.5 states that the design of
improvements for arterials shall be in accordance with District standards, including the Master
Street Map and Livable Streets Design Guide. The developer or engineer should contact the
District before starting any design.
Street Section and Right -of Way Width Policy: District Policy 7205.2.1 & 7205.5.2 states
that the standard 3-lane street section shall be 46-feet (back -of -curb to back -of -curb) within 70
feet of right-of-way. This width typically accommodates a single travel lane in each direction, a
continuous center left -turn lane, and bike lanes.
Right -of -Way Dedication: District Policy 7205.2 states that The District will provide
compensation for additional right-of-way dedicated beyond the existing right-of-way along
arterials listed as impact fee eligible in the adopted Capital Improvements Plan using available
impact fee revenue in the Impact Fee Service Area.
No compensation will be provided for right-of-way on an arterial that is not listed as impact fee
eligible in the Capital Improvements Plan,
The District may acquire additional right-of-way beyond the site -related needs to preserve a

Sidewalk Policy: District Policy 7205.5.7 requires a concrete sidewalk at least 5-feet wide to
be constructed on both sides of all arterial streets. A parkway strip at least 6-feet wide between
the back -of -curb and street edge of the sidewalk is required to provide increased safety and
protection of pedestrians. Consult the District's planter width policy if trees are to be placed
within the parkway strip. Sidewalks constructed next to the back -of -curb shall be a minimum of
7-feet wide.
Detached sidewalks are encouraged and should be parallel to the adjacent roadway.
Meandering sidewalks are discouraged.
A permanent right-of-way easement shall be provided if public sidewalks are placed outside of
the dedicated right-of-way. The easement shall encompass the entire area between the right-
of-way line and 2-feet behind the back edge of the sidewalk. Sidewalks shall either be located
wholly within the public right-of-way or wholly within an easement.
Frontage Improvements Policy: District Policy 7205.2.1 states that the developer shall widen
the pavement to a minimum of 17-feet from centerline plus a 3-foot wide gravel shoulder
adjacent to the entire site. Curb, gutter and additional pavement widening may be required
(See Section 7205.5.5).
ACHD Master Street Map: ACHD Policy Section 3111.1 requires the Master Street Map
(MSM) guide the right-of-way acquisition, arterial street requirements, and specific roadway
features required through development. This segment of Beacon Light Road is designated in
the MSM as a Residential Arterial with 3-lanes and on -street bike lanes, within 96-feet of right-
of-way.
c. Applicant Proposal: The applicant has proposed to dedicate additional right-of-way to total 48-
feet from the centerline of Beacon Light Road abutting the site. The applicant has also proposed
to construct a 3-foot wide gravel shoulder on Beacon Light Road abutting the site and 5-foot
wide detached concrete sidewalk located 41-feet from the centerline of the roadway abutting
the site.
d. Staff Comments/Recommendations: The applicant's proposal for the right-of-way dedication,
and to construct gravel shoulder and sidewalk abutting the site are consistent with the MSM
and meet District policy and should be approved, as proposed. The applicant should be required
to widen the pavement on Beacon Light Road abutting the site to total 17-feet from the centerline
of the roadway consistent with the District's Frontage Improvements policy.
The applicant should be required to construct a dedicated westbound left turn -lane on Beacon
Light Road at Stags Avenue when the intersection is constructed consistent with the TIS
recommendations.
Consistent with District policy, compensation will be provided for the right-of-way dedication for
Beacon Light Road abutting the site as this segment of Beacon Light Road is listed in the CIP.
Compensation will not be provided for additional right-of-way dedicated beyond 48-feet from the
centerline of Beacon Light Road.
2. Internal Local Roads
a. Existing Conditions: There are no local roadways within the site. There is one local street,
Arena Avenue, that stubs to the site's south property line, and one local street, Estuary Street,
that stubs to the site's east property line.
b. Policy:
Local Roadway Policy: District Policy 7207.2.1 states that the developer is responsible for
improving all local street frontages adjacent to the site regardless of whether or not access is
taken to all of the adjacent streets.

Street Section and Right -of -Way Policy: District Policy 7207.5 states that right-of-way widths
for all local streets shall generally not be less than 47-feet wide and that the standard street
section shall be 33-feet (back -of -curb to back -of -curb).
Standard Urban Local Street 33-foot Street Section and Right-of-way Policy: District
Policy 7207.5.2 states that the standard street section shall be 33-feet (back -of -curb to back -of -
curb) for developments with any buildable lot that is less than 1 acre in size. This street section
shall include curb, gutter, and minimum 5-foot wide concrete sidewalks on both sides and shall
typically be constructed within 47-feet of right-of-way.
For the City of Kuna and City of Star: Unless otherwise approved by Kuna or Star, the standard
street section shall be 36-feet (back -of -curb to back -of -curb) for developments with any
buildable lot that is less than 1 acre in size. This street section shall include curb, gutter, and
minimum 5-foot wide concrete sidewalks on both sides and shall typically be constructed within
50-feet of right-of-way.
Continuation of Streets Policy: District Policy 7207.2.4 states that an existing street, or a
street in an approved preliminary plat, which ends at a boundary of a proposed development
shall be extended in that development. The extension shall include provisions for continuation
of storm drainage facilities. Benefits of connectivity include but are not limited to the following:
• Reduces vehicle miles traveled.
• Increases pedestrian and bicycle connectivity.
• Increases access for emergency services.
• Reduces need for additional access points to the arterial street system.
• Promotes the efficient delivery of services including trash, mail and deliveries.
• Promotes appropriate intra-neighborhood traffic circulation to schools, parks,
neighborhood commercial centers, transit stops, etc.
• Promotes orderly development.
Sidewalk Policy: District Policy 7207.5.7 states that five-foot wide concrete sidewalk is
required on both sides of all local street, except those in rural developments with net densities
of one dwelling unit per 1.0 acre or less, or in hillside conditions where there is no direct lot
frontage, in which case a sidewalk shall be constructed along one side of the street. Some local
jurisdictions may require wider sidewalks.
The sidewalk may be placed next to the back -of -curb. Where feasible, a parkway strip at least
8-feet wide between the back -of -curb and the street edge of the sidewalk is recommended to
provide increased safety and protection of pedestrians and to allow for the planting of trees in
accordance with the District's Tree Planting Policy. If no trees are to be planted in the parkway
strip, the applicant may submit a request to the District, with justification, to reduce the width of
the parkway strip.
Detached sidewalks are encouraged and should be parallel to the adjacent roadway.
Meandering sidewalks are discouraged.

the dedicated right-of-way. The easement shall encompass the entire area between the right-
of-way line and 2-feet behind the back edge of the sidewalk. Sidewalks shall either be located
wholly within the public right-of-way or wholly within an easement.
Landscape Medians Policy: District policy 7207.5.16 states that landscape medians are
permissible where adequate pavement width is provided on each side of the median to
accommodate the travel lanes and where the following is provided:

• The median is platted as right-of-way owned by ACHD.
• The width of an island near an intersection is 12-feet maximum for a minimum distance of
150-feet. Beyond the 150-feet, the island may increase to a maximum width of 30-feet.
• At an intersection that is signalized or is to be signalized in the future, the median width
shall be reduced to accommodate the necessary turn lane storage and tapers.
• The Developer or Homeowners Association shall apply for a license agreement if
landscaping is to be placed within these medians.
• The license agreement shall contain the District's requirements of the developer including,
but not limited to, a "hold harmless" clause; requirements for maintenance by the
developer; liability insurance requirements; and restrictions.
• Vertical curbs are required around the perimeter of any raised median. Gutters shall slope
away from the curb to prevent ponding.
c. Applicant's Proposal: The applicant has proposed to construct the entry portion of Stag
Avenue as a 53-foot wide street section, with an 11-foot wide center landscaped island, two 21-
foot wide travel lanes with vertical curb, gutter, an 8-foot wide planter strip within 67-feet of right-
of-way and 5-foot wide detached concrete sidewalk located outside of the right-of-way.
The applicant has proposed to extend Estuary Street, and Arena Avenue into the site and to
construct all other local public streets, as 33-foot wide local street section with rolled curb,
gutter, an 8-foot wide planter strip within 47-feet of right-of-way and construct 5-foot wide
detached concrete sidewalks outside of the right-of-way. The applicant has proposed to
construct 4 knuckles with attached 5-foot wide concrete sidewalk. The applicant has also
proposed to construct a landscaped island within those knuckles.
Staff Comments/Recommendations: The applicant's proposal for the entry portion of Stag
Avenue and the internal local street section meets District policy and should be approved, as
proposed. For detached sidewalks, the applicant should be required to dedicate additional
right-of-way to 2-feet behind the back of sidewalk, or provide a permanent right-of-way
easement extending from the right-of-way line to 2-feet behind the back of sidewalk. The entry
roadway center island should be platted as right-of-way owned by ACHD. The applicant or
homeowner's association should enter into a license agreement with ACHD for any
landscaping proposed to be located within the landscape island.
3. Roadway Offsets
a. Existing Conditions: There are no roadways within the site.
b. Policy:
Local Street Intersection Spacing on Minor Arterials: District policy 7205.4.3 states that
new local streets should not typically intersect arterials. Local streets should typically intersect
collectors. If it is necessary, as determined by ACHD, for a local street to intersect an arterial,
the minimum allowable offset shall be 660-feet as measured from all other existing roadways
as identified in Table 1 a (7205.4.6).
c. Applicant's Proposal: The applicant has proposed to construct Stag Avenue to intersect
Beacon Light Road 1,640-feet east of Hartley Road.
d. Staff Comments/Recommendations: The applicant's proposal meets District policy and
should be approved, as proposed.
4. Stub Streets
a. Existing Conditions: There are no roadways within the site. There is one local street, Arena
Avenue, that stubs to the site's south property line, and one local street, Estuary Street, that
stubs to the site's east property line.

b. Policy:
Stub Street Policy: District policy 7207.2.4.3 (local) states that stub streets will be required to
provide circulation or to provide access to adjoining properties. Stub streets will conform with
the requirements described in Section 7207.2.4 (local), except a temporary cul-de-sac will not
be required if the stub street has a length no greater than 150-feet. A sign shall be installed at
the terminus of the stub street stating that, "THIS ROAD WILL BE EXTENDED IN THE
FUTURE."
In addition, stub streets must meet the following conditions:
• A stub street shall be designed to slope towards the nearest street intersection within the
proposed development and drain surface water towards that intersection; unless an
alternative storm drain system is approved by the District.
• The District may require appropriate covenants guaranteeing that the stub street will
remain free of obstructions.
Temporary Dead End Streets Policy: 7207.2.4.4 (local) requires that the design and
construction for cul-de-sac streets shall apply to temporary dead end streets. The temporary
cul-de-sac shall be paved and shall be the dimensional requirements of a standard cul-de-sac.
The developer shall grant a temporary turnaround easement to the District for those portions of
the cul-de-sac which extend beyond the dedicated street right-of-way. In the instance where a
temporary easement extends onto a buildable lot, the entire lot shall be encumbered by the
easement and identified on the plat as a non -buildable lot until the street is extended.
c. Applicant Proposal: The applicant has proposed to extend Arena Avenue and Estuary Street
into the site.
The applicant has also proposed to construct two stub streets to the site's west property line:
Yarnell Drive, located 1,110-feet south of the site's north property line, and Evita Street, located
283-feet south of the north property line, which will also stub to the site's east property line.
The applicant has proposed to construct one stub street to the site's north property line, Redland
Avenue, located 240-feet west of the east property line.
d. Staff Comments/Recommendations: The applicant's proposal meets District policy and
should be approved, as proposed. The applicant should be required to install a sign at the
terminus all stub streets stating that, "THIS ROAD WILL BE EXTENDED IN THE FUTURE."
The applicant should be required to construct a temporary cul-de-sac turnaround at the terminus
of the stub street Redland Avenue which extends greater than 150-feet in length. The temporary
turnaround should be paved and constructed to the same dimensional standards as a standard
cul-de-sac turnaround. If the turnaround extends onto a buildable lot, the entire lot shall be
encumbered by the easement and identified on the plat as a non -buildable lot until the street is
extended. If the applicant wishes to not construct a temporary turnaround, the applicant may
provide approval from the Fire Department since the length of the proposed street is
approximately 157-feet.
The stub streets of Yarnell Drive and Evita Street are less than 150-feet in and will not require
a temporary turnaround consistent with District policy.
5. Traffic Calming
a. Speed Control and Traffic Calming Policy (Local): District policy 7207.3.7 states that the
design of local street systems should discourage excessive speeds by using passive design
elements. If the design or layout of a development is anticipated to necessitate future traffic
calming implementation by the District, then the District will require changes to the layout and/or
the addition of passive design elements such as horizontal curves, bulb -outs, chokers, etc. The
District will also consider texture changes to the roadway surface (i.e. stamped concrete) as a

passive design element. These alternative methods may require maintenance and/or license
agreement.
b. Staff Comments/Recommendations: There are several long sections of local roadways
proposed with the Stags Crossing Subdivision development, which are greater than or
approaching 750-feet in length and will need to be redesigned to reduce the length of the
roadways or to include the use of passive design elements. The following roadways should be
redesigned:
• Wingspan Way
• Yarnell Drive
• Ajax Avenue
• Acuity Avenue
• Strant Street
• Heirloom Avenue
• Estuary Street
Stop signs, speed humps/bumps and valley gutter will not be accepted as traffic calming.
Prior to plan submittal the applicant should be required to submit a revised preliminary plat
showing the redesigned roadways for review and approval.
6. Tree Planters
Tree Planter Policy: Tree Planter Policy: The District's Tree Planter Policy prohibits all trees in
planters less than 8-feet in width without the installation of root barriers, Class II trees may be
allowed in planters with a minimum width of 8-feet, and Class I and Class III trees may be allowed
in planters with a minimum width of 10-feet.
7. Landscaping
Landscaping Policy: A license agreement is required for all landscaping proposed within ACHD
right-of-way or easement areas. Trees shall be located no closer than 10-feet from all public storm
drain facilities. Landscaping should be designed to eliminate site obstructions in the vision triangle
at intersections. District Policy 5104.3.1 requires a 40-foot vision triangle and a 3-foot height
restriction on all landscaping located at an uncontrolled intersection and a 50-foot offset from stop
signs. Landscape plans are required with the submittal of civil plans and must meet all District
requirements prior to signature of the final plat and/or approval of the civil plans.
8. Other Access
Beacon Light Road is classified as a minor arterial roadway. Other than the access specifically
approved with this application, direct lot access is prohibited to this roadway and should be noted
on the final plat.
D. Site Specific Conditions of Approval
1. Dedicate additional right-of-way to total 48-feet from the centerline of Beacon Light Road abutting
the site, as proposed. Compensation will be provided for the right-of-way dedication for Beacon
Light Road abutting the site. Compensation will not be provided for additional right-of-way
dedicated beyond 48-feet from the centerline of Beacon Light Road.
2. Widen the pavement on Beacon Light Road abutting the site to 17-feet from the centerline of the
roadway and construct a 3-foot wide gravel shoulder, as proposed.

3. Construct a 5-foot wide detached concrete sidewalk located 41-feet from the centerline of Beacon
Light Road abutting the site, as proposed.
4. Construct a dedicated westbound left -turn lane on Beacon Light Road at Stags Avenue when Stags
Avenue is constructed and intersects Beacon Light Road. Compensation will not be provided for
additional pavement widening or additional right-of-way dedication beyond 48-feet from the
centerline of the roadway.
6. Construct Stag Avenue to intersect Beacon Light Road 1,640-feet east of Hartley Road, as
proposed.

8. Construct all internal local roads as 33-foot wide local street sections with rolled curb, gutter, an 8-
foot wide planter strip and 5-foot wide concrete sidewalks and dedicate 47-feet of right-of-way, as
proposed. For detached sidewalk located outside of the right-of-way, dedicate additional right-of-
way to total 2-feet behind the back of sidewalk, or provide a permanent right-of-way easement that
extends from the right-of-way line to 2-feet behind the back of sidewalk.
9. Construct 4 knuckles, as proposed. The center islands should be platted as right-of-way owned by
ACHD. The applicant or homeowner's association should enter into a license agreement with ACHD
for any landscaping proposed to be located within the center landscape island.
10. Construct two stub streets to the site's west property line: Yarnell Drive, located 1,110-feet south of
the site's north property line, and Evita Street, located 283-feet south of the north property line,
which will also stub to the site's east property line, as proposed.

assessment will not be released until the civil plans are approved by ACHD.
17. Payment of impact fees is due prior to issuance of a building permit.
18. Comply with all Standard Conditions of Approval.
E. Standard Conditions of Approval
1. All proposed irrigation facilities shall be located outside of the ACHD right-of-way (including all
easements). Any existing irrigation facilities shall be relocated outside of the ACHD right-of-way
(including all easements).
2. Private Utilities including sewer or water systems are prohibited from being located within the ACHD
right-of-way.
3. In accordance with District policy, 7203.3, the applicant may be required to update any existing non-
compliant pedestrian improvements abutting the site to meet current Americans with Disabilities
Act (ADA) requirements. The applicant's engineer should provide documentation of ADA
compliance to District Development Review staff for review.
4. Replace any existing damaged curb, gutter and sidewalk and any that may be damaged during the
construction of the proposed development. Contact Construction Services at 387-6280 (with file
number) for details.
5. A license agreement and compliance with the District's Tree Planter policy is required for all
landscaping proposed within ACHD right-of-way or easement areas.
6. All utility relocation costs associated with improving street frontages abutting the site shall be borne
by the developer.
7. It is the responsibility of the applicant to verify all existing utilities within the right-of-way. The
applicant at no cost to ACHD shall repair existing utilities damaged by the applicant. The applicant
shall be required to call DIGLINE (1-811-342-1585) at least two full business days prior to breaking
ground within ACHD right-of-way. The applicant shall contact ACHD Traffic Operations 387-6190
in the event any ACHD conduits (spare or filled) are compromised during any phase of construction.
8. Utility street cuts in pavement less than five years old are not allowed unless approved in writing by
the District. Contact the District's Utility Coordinator at 387-6258 (with file numbers) for details.
9. All design and construction shall be in accordance with the ACHD Policy Manual, ISPWC Standards
and approved supplements, Construction Services procedures and all applicable ACHD Standards
unless specifically waived herein. An engineer registered in the State of Idaho shall prepare and
certify all improvement plans.
10. Construction, use and property development shall be in conformance with all applicable
requirements of ACHD prior to District approval for occupancy.
11. No change in the terms and conditions of this approval shall be valid unless they are in writing and
signed by the applicant or the applicant's authorized representative and an authorized

representative of ACHD. The burden shall be upon the applicant to obtain written confirmation of
any change from ACHD.
12. If the site plan or use should change in the future, ACHD Planning Review will review the site plan
and may require additional improvements to the transportation system at that time. Any change in
the planned use of the property which is the subject of this application, shall require the applicant
to comply with ACHD Policy and Standard Conditions of Approval in place at that time unless a
waiver/variance of the requirements or other legal relief is granted by the ACHD Commission.
F. Conclusions of Law
The proposed site plan is approved, if all of the Site Specific and Standard Conditions of Approval
are satisfied.
2. ACHD requirements are intended to assure that the proposed use/development will not place an
undue burden on the existing vehicular transportation system within the vicinity impacted by the
proposed development.
