C,ITY..aF EAATE Adaeolrnty, tdaho E. .Ci-W RESOLUTION No.21-04 A RESOLUTION OF THE EAGLE CITY COUNCIL TO VACATE THE WESTERN PORTION OF THE UTILIry EASEMENT ALONG THE EAST PROPERTY LINES WITHIN LOTS 6 AND 7, BLOCK I (AQUILA VILLAGE SUBDIVISION) AS SHOWN ON THE ATTACHMENTS HERETO; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, The City of Eagle, requested a vacation to the final plat of Aquila Village Subdivision to vacate the western 6-feet of the utility easement along the east property lines within Lots 6 and 7, Block I (Aquila Village Subdivision); and WHEREAS, On January 4,2021, the Planning and Zoning Commission recommended approval of the vacation (VAC-04-20), with conditions, to the Council; and WHEREAS, Legal notice of the City Council hearing on the vacation was published in the ldaho Statesman on January 8,2021, and January 15,2021; and WHEREAS, On January 26, 2021, the City Council held a public hearing on the proposed vacation (VAC-04-20), and voted to approve the vacation with conditions; and WHEREAS, The City Council hereby finds that the proposed vacation complies with the provisions of Section 50-1306,at of the Idaho Code, "Vacation of Plats - Procedure", and Section 9-6-2 of Eagle City Code, "Vacations and Dedications;" and NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CIry OF EAGLE,IDAHO. The Eagle City Council hereby vacates the western 6-feet of the utility easement along the east property lines within Lots 6 and 7, Block 1, of the final plat of Aquila Village Subdivision, as considered, heard, and approved by the Council at its January 26,2021, public hearing for application number VAC- 04-20, and as shown on the attachments hereto (Exhibit A). This Resolution shall be in full force and effect immediately upon its adoption and approval. ADOPTED by the Council of the City of Eagle, ldaho, this 9th day of February,202l.
