Findings - CC - 2015 - AA-04-15 - 430 E Floating Feather Rd.BEFORE THE EAGLE CITY COUNCIL IN THE MATTER OF AN APPEAL OF THE ) ZONING ADMINISTRATOR'S DECISION ) POST RECONSIDERATION TO REQUIRE REMOVAL OF FENCE IN ) ORDER GRANTING FRONT YARD LOCATED AT 430 E. ) APPEAL AA -04 -15 FLOATING FEATHER ROAD 1 The above - entitled matter came before the Eagle City Council for their action on July 14, 2015, at which time testimony was taken and the decision was made to deny the appeal. The City Council, on August 25, 2015, voted 2 -2 (Mayor in favor) to reconsider the above matter. On September 8, 2015, after having received oral and written testimony from the Applicant Dylan Schneider and City Staff, and reviewed the record, the Council voted 4 to 0 to approve the above referenced appeal. The City Council, having reviewed the particular facts and circumstances regarding the Zoning Administrator's decision to require the removal of the previously - constructed six (6') tall cedar fence within the front yard located at 430 E. Floating Feather Road, and based upon the Council's review of all information provided, the City Council makes the following findings and conclusions and authorizes the Mayor to sign this Order. A. Dylan and Erika Schneider are the owners of property located at 430 E. Floating Feather Road, Eagle, Idaho. B. The property is not similar to other properties in the general area; it was unable to be included with the development of surrounding subdivisions and the only access to the site is via Floating Feather Road. C. The site has topographical constraints; the only usable area is located adjacent to Floating Feather Road. The north portion of the site slopes significantly thereby limiting the usable area. D. A fence located within the front yard area will provide some privacy for the limited, usable area of the property. E. The fence information shown on Exhibit A, attached hereto, reflects the approved fence style. The existing fence shall be immediately reconstructed to match the fence shown on Exhibit A. The fence shall be painted to match the exterior color of the house (located at 430 E. Floating Feather Road). F. The height and width fence dimensions shown on Exhibit A (for the portion of the fence located to the right of the driveway) shall by reference be the same fence dimensions for the fence located to the left of the driveway.
