Pre Council: Discussion took place regarding building duplexes on
Mission & 1st. Street and removal of trees on north side of Beacon
Light Road to widen intersection of Eagle and Beacon Light roads.
The Eagle City Council met in regular session on May 26, 1992.
Mayor GUERBER presiding.
The following members were present: RICK YZAGUIRRE, THOMAS EASON,
STAN BASTIAN, KELLI BLAIR.
Moved by YZAGUIRRE and seconded by BASTIAN to approve the minutes
of the May 12, 1992 meeting as presented. ALL AYE: MOTION
CARRIED.
Moved by EASON and seconded by BLAIR to approve the minutes of the
May 16, 1992 meeting with the following correction: Mr. Mendiola's
offer to sell the property to the City for $90,000 was rejected,
the motion should read, moved by EASON and seconded by BASTIAN to
have the City Attorney offer Mr. Mendiola $38,500, immediately, for
the property. If the property should sell for more than $38,500 the
City will pay the difference up to $90,000. This correction is to
be incorporated in the minutes of May 16, 1992. ALL AYE: ~3r1C~

UNFINISHED BUSINESS:
ROGER C. CRANDLEMIRE-ANNEXATION/ZONING (continued)
A letter from Ed Thomas, representative for Roger Crandlemire, was
presented to council asking to hold consideration of the
Crandlemire request for 60 days.
Moved by EASON and seconded by BASTIAN to continue the hearing
until the Council Meeting of August 11, 1992. ALL AYE: MOTION
CARRIED.
Findings of Fact and Conclusions of Law/Margaret M. & Dale Chesnut-
CUP: 2 dwellings on one lot in an R5 District. Moved by BASTIAN
and seconded by YZAGUIRRE to approve the findings as presented.
ALL AYE: MOTION CARRIED.
Findings of Fact and Conclusions of Law/Leslie Subdivision-
Preliminary Plat Approval. City Attorney recommended changes in
the Findings of Fact and Conclusions of Law/Leslie Subdivision.
Moved by EASON and seconded by BASTIAN to approve the findings with
~v£s£ons. ALL AYE~ MOTION CARRIED.
Findings of Fact and Conclusions of Law/Avante'Casa Subdivision-
Final Plat Approval. Moved by EASON and seconded by BLAIR to
approve approve the findings as presented. ALL AYE: MOTION
CARRIED.
BODIL¥-BUNDERSON SANDY SPRINGS PHASE #2-Final Plat Approval.
Application for final plat approval for Bodily-Bunderson-Sandy
Springs Phase #2, a subdivision in the Eagle Impact Area. Moved by
YZAGUIRRE and seconded by EASON to approve the application with
conditions as presented. ALL AYE: MOTION CARRIED.
ISLAND WOODS SUBDIVISION-PHASE I-Final Plat Approval.
Don Hubble, project engineer for Island woods presented the final
plat to the Council. Dennis Baker, developer, Steve Bradbury,
attorney, and Karl Gebhardt, Environmental Engineer were also in
attendance to answer any additional questions. Moved by YZAGUIRRE
and seconded by BLAIR to approve application subject to all 36
conditions being met and negotiation of agreement between the City
of Eagle and Island woods Homeowners Association for City to obtain
water system. ALL AYE: MOTION CARRIED.
NEW BUSINESS:
Ada County Transmittal: 92-26-CU/FERGUISON: Moved by YZAGUIRRE and
seconded by BASTIAN to approve the transmittal as presented.
ALL AYE: MOTION CARRIED.
Ada County Transmittal: 92-22-PDR/Larry Hellhake (Triple Ridge
Estates). Moved by BASTIAN and seconded by YZAGUIRRE to approve
the Ada County Transmittal for Triple Ridge Estates with
recommendation that emergency access road between N. Talon Pl. and
Holl Drive remain gravel. ALL AYE: MOTION CARRIED
ORDINANCES-RESOLUTIONS:
Moved by BASTIAN and seconded by EASON to dispense with the three
day ruling and to consider Ordinance #202 at this time. ALL AYE:
MOTION CARRED: Moved by BASTIAN and seconded by EASON to adopt
Ordinance #202, Rates, Rules and Regulations for the Operation of
the Water System of the City of Eagle, Idaho. ALL AYE: MOTION
CARRIED.
RESOLUTION 92-7: Approving the Water Service Contract and First
Amendment thereto, between the City of Eagle and Engineering
Management and Maintenance, Inc. Moved by YZAGUIRRE and seconded
by EASON to approve as presented. ALL AYE: MOTION CARRIED.
RESOLUTION 92-8: Establishing the rates for water usage of the
City's Domestic Water System. Moved by BLAIR and seconded by EASON
to approve as presented. ALL AYEs MOTION CARRIED.
ATTORNEY'S REPORTs City attorney addressed complaint from Alan G.
Lance, Attorney in the matter of DeShazo v Eagle Ranch Property
Owner Association, et al to see if Council wanted to respond to
complaint. Moved by YZAGUIRRE and seconded by BASTIAN to have
attorney respond. ALL AYE~ MOTION CARRIED. Report was given that
Bill #793 - Open Meeting Law goes into effect 7-1-92 and that the
City should publish in newspaper that City Council meetings are
held the second and fourth Tuesday of each month. On special
meetings no special meeting shall be held without at least 24 hour
meeting and agenda notice.
COUNCIL REPORTS:
BLAIR: Have received two bids on resurfacing tennis courts, should
have third bid by June 9, 1992 council meeting.
YZAGUIRREs Pathway Committee will be meeting with Gary Madenford,
Redwood Creek Estates at the May 27, 1992 meeting.
CLAIMS AGAINST THE CITY: Moved by YZAGUIRRE and seconded by EASON
to approve the claims as presented and to reimburse the Eagle
Chamber of Commerce $500.00 for payment of special insurance for
Eagle Fun Days to Stein McMurray. ALL AYEs MOTION CARRIED
