Minutes - 1992 - City Council - 05/12/1992 - RegularEAGLE C1wx COUNCIL MEETING NAY 12, 1992 PRE COUNCIL: The Council reviewed the water contract, ordinance and attached resolutions, which resulted in scheduling a special meeting, workshop, for continuing the discussion toward adopting those documents. The workshop will also include the Engineering contract for the block grant and a discussion regarding setbacks on the Boise River. The Eagle City Council met in regular session on May 12, 1992. Council president, YZAGUIRRE presiding in Mayor GUERBER'S absence. The following members were present: STAN BASTIAN, KELLI BLAIR. RICK YZAGUIRRE, THOMAS EASON, Moved by BASTIAN and the April 28, 1992 CARRIED. seconded by EASON to approve meeting as presented. ALL the minutes of AYE: MOTION PUBLIC HEARING/Chestnut-CUP Councilman YZAGUIRRE announced that this was the time and place set for a public hearing on an application by Margaret and Dale Chesnut a Conditional Use Permit for 2 dwellings on one lot in an R5 District. The existing unit, a mobile home, will be removed once it is not needed for an elderly parent to occupy. The new unit will be a manufactured home on a permanent foundation. Applicant: Margaret and Dale Chesnut Location: 2052 Syringa, Eagle, Id Proposal: a CUP application pursuant to Ord. #192 permitting a temporary mobile home for elderly family members Public Testimony: No opposition In favor: Dale Chesnut Maragret Chesnut Public hearing closed at 7:40 p.m. Moved by BASTIAN and seconded by BLAIR to approve the application with the condition that the mobile home be removed once it is not occupied by Maragret Chesnut. PUBLIC HEARING/Crandlemire-Quail Ridge Farm: Annexation, zoning Ri Councilman YZAGUIRRE announced that this was the time and place set for a public hearing on an application by Roger Crandlemire-Quail Ridge Farm for annexation and R1 zoning to the City of Eagle. Applicant: Roger Crandlemire (representative Ed Thomas) Location: Proposal: N side of Floating Feather Rd, between Eagle Rd and Ballantyne annexation to the City of Eagle. Proposal of R2 by application, recommended zoning by P&Z AR (agricultural-residential), amendment to zone by application for R1 Public Testimony: In favor: Jerry Iverson, Ed Thomas Opposed: Tim Shaklee Eleanor Chase Clarence Stockstill Arlee Kawakanis Bret Byrns Janet Bushert Russ Bushert Bob Batey Faith Peterson Colleen Maile Bert Bradley Diane Anderson Dana Hoffstetter Concerns of the public: overuse of wells, to great a density, saturation of ground, drainage and irrigation problems, school crowding, congestion of traffic, parks and recreation spaces. NOTE: The concerns included a request for a study of the area on drainage and irrigation, wells/water conditions and school and traffic problems. There was also a request for consideration of a moratorium on growth until the study was done. Public hearing closed at 8:35 p.m. Moved by BASTIAN and seconded by EASON to continue the hearing until the next Council meeting on May 26, 1992 in order to review the application further. ALL AYE: MOTION CARRIED. PUBLIC HEARING/Leslie Subdivision-Preliminary Plat Councilman YZAGUIRRE announced that this was the time and place set for a public hearing on an application by Ronald Leslie on behalf of owner, David Smart, for a 129 unit subdivision on 34.61 acres. Applicant: Location: Proposal: Ronald Leslie and David Smart E side of Edgewood Dr., approx 1/2 M N of State St an application for preliminary approval of a 129 unit subdivision on 34.61 acres, gross density 3.73 units per acre, zoning R4 The Engineer, David Torgeson of Hubble Engineering, represented the interests of the applicant and owner. Mr. Torgeson advised the Council that the plat had undergone some changes per the recommendation of the Eagle Planning and Zoning. There were now "green spaces" along Edgewood Rd and within the subdivision, a lot consisting of 1/8 of an acre for common area or park space and trees planned throughout the subdivision. He also indicated there was a private road adjacent to the park area. Public hearing closed at 9:35 p.m. Moved by EASON and seconded by BLAIR to deny the application for a preliminary plat as there are unresolved issues connected to roads, and water, also the density is too great. ALL AYE: MOTION CARRIED. JIM CORTA-DESIGN REVIEW APPLICATION Proposal: A drive-in restaurant in a C2 District, a permitted use~ The design review application consists of the building, signs, and landscaping. Moved by BASTIAN and seconded by EASON to approve the application as presented with conditions and to add a condition that all signs must conform with City Codes. ALL AYE: MOTION CARRIED. TRASH LICENSES, 1992 Moved by BLAIR and seconded by EASON to approve the licenses as presented. ALL AYE: MOTION CARRIED. AVANTE CASA-final plat approval (continued from April 14, 1992) Discussion by Council resulted in determining that the water and road issues previously questioned have now been resolved. Moved by EASON seconded by BASTIAN to approve the final plat with City Subdivision Standard Conditions and sign off of the final plat conditioned on approve of the covenants (CC and R's) by the City Attorney, and the culdesac designed and road paved prior to any issuance of a building permit. ALL AYE: MOTION CARRIED. Moved by EASON and seconded by BASTIAN to adjourn at the end of the meeting into executive session regarding land acquisition. ALL AYE: MOTION CARRIED. Moved by BASTIAN and seconded by EASON to approve the claims as presented. ALL AYE.. MOTION CARRIED. COMMITTEE REPORTS.. Seniors~ The seniors are willing to commit to splitting the cost of a sign in the front area of the grounds indicating there is parking in the rear. BLAIR will explore the cost of a sign. Greenbelt.. The Committee will meet with Dennis Baker regarding the plans for a greenbelt along the Boise River. Sewer Dist: The District is concerned about setback regulations to developments along the river. Moved by BASTIAN and seconded by EASON to go into executive session for discussion regarding land acquisition at this time. ALL AYEs MOTION CARRIED.
