ROLL CALL: Present: WRIGHT, GUERBER, MCCAULEY, MCLAUGHLIN, and SMITH. A quorum is present. CONSENT AGENDA: ♦ Consent Agenda items are considered to be routine and are acted on with one motion. There will be no separate discussion on these items unless the Chairman, a Commissioner, member of City Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in a sequence determined by the Rules of Order. ♦ Any item on the Consent Agenda that contains written recommendations from the City of Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda approval motion unless specifically stated otherwise. A. Minutes of December 7, 2020. B. Findings of Fact and Conclusions of Law for the Approval of A-04-20/RZ-04-20/CU-4- 20/PPUD-01-20/PP-02-20 — Stags Crossing Planned Unite Development — Urban Solutions LLC: Urban Solutions, LLC, represented by Steve Hart, is requesting an annexation, rezone from RUT (Rural -Urban Transition - Ada County designation) to R-2-DA-P (Residential with a development agreement - PUD), conditional use permit, preliminary development plan, and preliminary plat approvals for Stag Crossing Subdivision, a 135-lot (113-buildable, 22-common) residential planned unit development. The 67-acre site is located on the south side of West Beacon Light Road approximately 2,000-feet west of North Lanewood Road. (MJW) McLaughlin moves to approve the consent agenda as presented. Seconded by Smith. ALL AYES... MOTION CARRIES. 4. UNFINISHED BUSINESS: NONE. 5. PUBLIC HEARINGS: A. ACTIONITEM: CU-10-20 — Change of Nonconforming Use — Jeremiah Smith & Melissa Wilde: Jeremiah Smith & Melissa Wilde are requesting conditional use permit approval for a change of nonconforming use to allow an addition to an accessory structure (located within the street side yard area) to encroach into the required rear yard setback. The 1-acre site is located on the southwest corner of North Downing Drive and West Floating Feather Road at 1235 North Downing Drive. (MJW) Jerry Smith, 1235 North Downing Drive. The applicant provides his and his partners background, their intentions for the site, and an overview of the application. Smith responds to questions from the Commission. Miller supports the application, expresses enthusiasm for the project as many of the neighbors have goats and other farm animals. Scott Russell, 847 North Arlington Drive. Russell supports the application. He believes that it is the perfect addition to the area as it will add to "farm -like" setting of Downey Downs. Believes that the neighborhood children will benefit, especially those interested in the High School 4-H program. Mario Gianvito, 700 Steeple View Drive. Gianvito supports the application and feels that the project's Dutch doors, will enhance the view from Floating Feather and will make it more aesthetically pleasing. He explains that all the other neighbors have farm animals and have the freedom to do this sort of thing and feels that the applicant should be given the same rights. Jerry Smith adds a few comments, addresses his neighbors and thanks them for their support. He adds to his narrative and answers a few more questions from the Commissioners. Guerber moves to recommend for approval item 5A, CU-10-20, Change of Nonconforming Use for Jeremiah Smith & Melissa Wilde. Seconded by McLaughlin. ALL AYES... MOTION CARRIES. B. ACTIONITEM: A-08-20/RZ-10-20/CU-08-20/PPUD-03-20/PP-05-20 — Brookway North Planned Unit Development: Hall Capital, LLC, represented by Kent Brown, is requesting an annexation, rezone from RUT (Rural -Urban Transition - Ada County designation) to R-2-DA-P (Residential with a development agreement - PUD), conditional use permit, preliminary development plan, and preliminary plat approvals for Brookway North Subdivision, a 58-lot (53-buildable, 5-common) residential planned unit development. The 28-acre site is located on the south side of West Beacon Light Road approximately 100- feet west of North Lanewood Road at 6001 West Beacon Light Road. (MJW) Kent Brown, 3161 East Springwood Drive, Meridian, ID 83642. Brown provides a detailed description of the development and overview of the application. City Planner, Mike Williams, provides an overview of the application. Brown responds to questions from the Commission. Chairman Wright opens the Public Hearing. There were no members of the public present who wished to testify. Chairman Wright closes the Public Hearing. General discussion amongst the Commission. McCauley moves to recommend for approval item A-08-20/RZ-10-20/CU-08-20/PPUD-03- 20/PP-05-20, Brookway North Planned Unit Development with the following changes: that the verbiage be changed to 18 foot easement for the pathway, that it be dated January 4, 2021 as it pertains to the approval of Dry Creek Ditch Company, that the open style fencing be modified as recommended by staff and that the setbacks be edited to include a 30 foot for living space and a 36-foot for garage. City Planner Williams suggests amending the motion to state: "with staff recommended conditions of approval, with the change to Condition 3.9 to change the date from the September date to the January 4" date, and on -site specific condition # 10 at 30 feet living". ACTIONITEM.- VAC-04-20 - Vacation to the final plat of Aquila Village Subdivision - City of Eagle: The City of Eagle is requesting to vacate the western 6-feet of the 12-foot subdivision boundary public utility easement located within Lots 6 and 7, Block 1, Aquila Village Subdivision. The 2.049-acre site is located on the north side of East Civic Lane approximately 250-feet north of East State Street at 660 East Civic Lane. McLaughlin moves to recommend for approval item VAC-04-20, Vacation to the final plat of Aquila Village Subdivision, City of Eagle. Seconded by Smith. ALL AYES... MOTION CARRIES. 7. REPORTS: A. Commission: Commissioner Smith asks about the structure of the agenda items and map sizes of 8 %2 x 11. Smith also asks about the ACHD maps, vicinity, and subdivision maps. Commissioner Guerber offers details about City Hall expansion project and the funds earned from the sale of city property being used to pay for the expansion so that it doesn't fall on the residents/ taxpayers. B. City Attorney: None. C. Staff: Planner Mike Williams noted that the next P&Z meeting will be held on Tuesday, January 19t' (due to MLK holiday on the 181). Commissioner McCauley will not be able to attend meeting on January 19t''. Smith's attendance on January 19" is questionable. 8. ADJOURNMENT: Wright moves to adjourn. Seconded by Guerber. ALL AYES...
