Joint Training Session Eagle Planning & Zoning Commission & City Council. City Attorney McLain conducts the Joint Training Session with the Planning and Zoning Commission and the City Council. INVOCATION: REGULAR AGENDA: 1. CALL TO ORDER: Mayor Reynolds calls the meeting to order at 6:30 p.m. 2. ROLL CALL: BUTLER, MCFARLAND, KUNZ, RIDGEWAY. All present. A quorum is present. 3. PLEDGE OF ALLEGIANCE: Mayor Reynolds leads the Pledge of Allegiance. 4. ADDITIONS, DELETIONS OR MODIFICATIONS TO THE AGENDA: Kunz: I would ask that an item be added to the Consent Agenda confirming or approving Joe Yokum as the primary voting representative for the West Ada School/Eagle Elementary School for the Eagle Road/State Street Intersection Study replacing Christian Housel the principal of Eagle Elementary. I will be riding north in Idaho, traveling down through Washington State and Oregon and then to California. From there to Las Vegas and then I will make my way to Washington D.C. Claims Against the City. ♦ B. Noise Waiver Request: The Eagle Chamber of Commerce is requesting a noise Wavier for Saturday, July 11, 2015 until midnight to accommodate Fun Days activities. The waiver would apply for the area generally located between Eagle Road and Flower Lane and Aikens and the alley between State Street and Idaho. (SKB) ♦ C. Noise Waiver Request: The Parks & Recreation Department is requesting a noise waiver to be utilized on July 11, 2015 for Eagle City limits in order to accommodate the sound associated with the fireworks display for Eagle Fun Days. The waiver is requested until midnight. (MA) ♦ D. Resolution 15 -20 — Solid Waste Collection Adjustment to Customer Rates: A Resolution of the City of Eagle, Idaho, increasing the solid waste fee for residential and commercial customers by $0.12 per month, to be effective with the next regularly scheduled billing cycle following approval of the City, pursuant to Section 2.2 of the Second Addendum to the Waste Collection Services Contract between the City of Eagle and Allied Waste Services Of North America, LLC; and providing for effective date. Findings of Fact and Conclusions of Law for RZ -02 -15 — Rezone from R -4 (residential) to CBD (central business district) — Shawn Nickel: Shawn Nickel is requesting a rezone from R -4 (Residential) to CBD (Central Business District). The 0.137 -acre site is located on the west side of North Eagle Road approximately 500 -feet north of West State Street at 203 North Eagle Road. (WEV) ♦ F. Task Order No. 15 -01— Plaza Drive Extension Project — City of Eagle: City staff is requesting City Council approval of Task Order 15 -10 with Baer Design Group, LLC, Greg Baer, Principal, to 1) create a landscape, irrigation, and lighting design for the Plaza Drive Extension project; and 2) Prepare cost estimates and construction drawings for integration into the ACHD project design and bidding process. Resolution 15 -21— Extending the Sunset Clause to October 31, 2015: A Resolution of the City Council of the City of Eagle, Ada County, Idaho, amending Resolution 14 -29 by amending the sunset date of the Stakeholders Committee and providing an effective date. (JK) ♦ J. Minutes of June 8, 2015. (SKB) ♦ K. Minutes of June 9, 2015. (SKB) Butler: I want to run something past the Council. Other cities look at their Conditional Use Permits and Preliminary Plats when they seem minor in nature and ask if the applicant is okay with the conditions and if the applicant says "yes" then they ask if there is anybody to testify against and if yes then it stays on the agenda. If everybody is in favor then it is put on the Consent Agenda to approve it and then the Findings come back. Would Council be willing to allow me to ask for Item #813 the Contractors Yard for Chris Lombardo those two questions and if that was the case put it on the Consent Agenda and also Item #8C and obviously if any Council Member has questions we need to leave it on the Agenda so we can talk about it at that time. I just thought I would propose that idea for the Council because I presume there will be a lot of testimony to Item #A and thought that would be a way to move those along. So unless the Council has concerns with either one of those and wanted to leave it on I was going to make that recommendation. General Council discussion. Mr. Mayor, I would ask with regard to CU -01 -15 — Contractor's Yard — Chris Lombardo, is the applicant here today? Applicant is present. Are you okay with all of the Conditions recommended by the Planning and Zoning Commission? Applicant responds "yes ". Is there anybody here to testify against this particular application? Ordinance 733 - A Zoning Ordinance Amendment to Eagle City Code Title 8 "Zoning ", Chapter 1 "Zoning Interpretation and Definitions ", Chapter 2 "Zoning Districts and Maps ", Section 3 "Schedule of District Use Regulations "; And Providing An Effective Date. This item was continued from the June 9, 2015 meeting. (WEV) Zoning Administrator Vaughan provides Council an overview of the discussion had on this Ordinance at the last Council Meeting. Ridgeway: I have a question for the City Attorney. When this was voted down there was a motion for reconsideration and in all of the discussion and confusion the person who made the motion for reconsideration voted in the negative and it is my understanding that to reconsider you have to vote in the positive. To bring this up as a reconsideration is inappropriate and doesn't follow the correct procedures. City Attorney McLain: You are correct in accordance to Roberts Rules of Order which Council follows as a guide. However, this is a legislative action and a legislative action can get a no vote and be revived. It is not clear on the agenda, it just says Unfinished Business but it was based on a motion for reconsideration. I will let the Council decide how they want to handle this. General discussion. Butler moves, pursuant to Idaho Code, Section 50 -902, that the rule requiring Ordinances to be read on three different days with one reading to be in full be dispensed with, and that Ordinance #733 be considered after being read once by title only. RZ-28 -06 MOD & PP -02 -15 — Crossley Park Subdivision — Greg Hall: Greg Hall, represented by Tim Mokwa with KM Engineering, LLP, is requesting a development agreement modification (development agreement in lieu of a PUD), and preliminary plat approval for Crossley Park Subdivision, a 33 -lot (32- buildable and 1- common) residential subdivision. The 6.77 -acre site is generally located on the south side of W. Flint Drive at 3391 W. Flint Drive. (WEV) Mayor introduces the issue. Tim discusses the streets within the project. General discussion. Planner Williams display overheads and provides Council an overview of the application. General discussion. Mayor opens the Public Hearing Kevin Shaner, 353 N. Colony Way, I am the President of the Colony Way HOA, presents a power point and discusses the same. Discusses a petition that was submitted to the City. We want the property to be developed properly. This development is not transitional; it fundamentally lacks a transition. Discusses the meeting with Mr. Hall. These homes could be sold to anyone, they are perfect for rentals. We ask Council to require transition. General discussion. Ron Alves, 1086 N. Wind Weaver, I am a member of the HOA Board and a retired fire captain, displays overheads and discusses the same. I agree with everything that Ken had to say. Discusses private streets and the International Fire Code as it applies to streets. Chuck King, 3146 West Wind Court, I strongly urge that you maintain the current zoning for this property. Tony Farrar, 84 N. Cove Colony, I live adjacent to this development. I am a retired policeman and a volunteer fireman. Discusses the frequency of the calls coming from multi - family places. I don't believe the one car theory. Weston Arnell, 101 S. Capital Blvd, Boise, in behalf of Eagle Island Crossing owners, we support this application and we also feel it is an appropriate use for this site. There will be minimal impact on Arts West and the neighboring developments. This development will reduce the traffic through the schools parking lot. Mike McGraft, 678 N. Cove Colony Way, I am here tonight in support of Mr. Shaner. Jason Ellison, 3664 W. Tabasco Trail Lane, I'm not sure I signed up for this development; I wanted to talk about the Henry's Fork Development. Ridgeway: For your information we approved that earlier. Scott Cline, 3188 West Wing Court, I agree with my other homeowners. Why the change? If there was already a rezoning plan on the books what changed? Why are we talking about such a drastic change? How will this be possible for seniors? I disagree that 3 units per acre is not marketable. Maybe we should go back to the original plan. Nancy Merrill, I hear the neighbors' concerns and I to have lived here a long time. I see the fear that these are going to be a low income rental units and if you want to put something in that this has to be for seniors that will be alright. Discusses the Homestead Development that is for seniors. Discusses the transition. This is the type of transition that needs to be made between the types of uses that we have. Tim Mokwa, on behalf of the project, discusses the 1 acre estate lots and compatibility, the density, transition, and private streets. We have room for a tot lot if that is the Council's desire. General discussion. Greg Hall, applicant, the plat that has been discussed here tonight was approved nine years ago. Discusses MLS economic factors in Eagle. Distributes the economic factors from the MLS to the Council. I still have to do a collector road. I tried to listen to the property owners that are most affected by the development. Discussion with Mr. Hall about suggested changes to the development to see if there is way to work something out with the property owners in the Colony. Mayor calls a recess at 9:20 p.m. Mayor reconvenes the meeting at 9:30 p.m. General discussion on mediation. Butler moves that in accordance with Idaho Statue 67 -6510 — Mediation that RZ-28- 06 MOD & PP -02 -15 Park be remanded to mediation with the members to consist of the developer, the developer team, Mr. Shaner and their team consisting of two — three people, up to two Council Members to be chosen before the meeting and our City Attorney as the mediator and that the group take into account not only their concerns but concerns expressed by the City Council and as long as they come forward with a proposal addressing those concerns than a public hearing will not be required. If for some reason there is a drastic change to the plan then the understanding is that a new public hearing will be required. Add the planning staff and also anybody that the planning staff deems necessary to attend. That the meeting be scheduled so that any new information can be provided to the City Council at least 5 days before the next City Council meeting and this will be scheduled for the next regular City Council meeting to see if a resolution has been obtained. PP -11 -05 MOD2 - Henry's Fork Preliminary Plat Modification (Formerly Park Place Gardens /Shaunnesv Subdivision) — Henry's Fork LLC: Henry's Fork, LLC, represented by T. Butler moves to budget up to $3,000 and instruct our staff to find a facilitator that doesn't work for the City and we find somebody to look over the survey documentation and that those folks be presented to us at our next meeting to propose a budget, hopefully not to exceed $3,000. Ridgeway I would like to add an amendment and ask that the facilitator work with Mr. Kunz to run those meeting and use Mr. Kunz's previous knowledge and pull the project together. Discussion. Council concurs to continue to have the $10 a month payment be made on the damage to the light post. 10. REPORTS: a. Mayor and Council Reports: Ridgeway: Reports on the Idaho Botanical Gardens Tour. Reports on the Best of Treasure Valley, we had some business that did really well. Butler: Some people submitted some written complaints about a sign and one complaint was filed on Ballantyne. P & Z Commission/Council Roles In fact, there is a substantial difference between planning and zoning. Planning is long range; zoning is immediate. Planning is general; zoning is specific. Planning involves political processes; zoning is a legislative function and an exercise of the police power. Planning is generally dynamic while zoning is more or less static. Planning often involves frequent changes; zoning designations should not. Planning has a speculative impact upon property values, while zoning may actually constitute a valuable property right. It seems clear, therefore, that while zoning designations should generally follow and be consistent with the long-range designations established in the Comprehensive Plan, there is no requirement that zoning immediately conform to the Plan. The Plan is a statement of long-range public intent; zoning is an exercise of power which, in the long run, should be consistent with that intent. Planning is a determination of public policy, and zoning, to be a legitimate exercise of police power should be in furtherance of that policy. Giltner I, 145 Idaho at 633,181 P.3d at 1241. Cell Towers -federal preemption Unlike the majority of land use applications before the City Council, an application for a cell tower is governed by both federal and local laws through the Federal Telecommunications Act, (the "TCA"), 47 U.S.C. 332 and ECC 8-3-5(5). Both federal and local laws must be applied harmoniously. The TCA is generally designed to promote the continued growth and competition of telecommunications but still allows for local regulation. For instance, if the City Council applies the local and state requirements and finds that the application satisfies those requirements and approves the application, the analysis ends there. It appears that only when the City applies its' local and state requirements and concludes that a denial is proper does the TCA require a further analysis under federal law to determine whether the Council must change its mind and approve the application. The TCA requires the governing body to make a 2 part analysis. First, it must apply its own local governing law, ECC 8-3-5(S) and state law, the Local Land Use Planning Act, chapter 65, title 67, Idaho Code. Then it must apply the Ninth Circuit's two -prong test: Is there a "gap" in coverage? And, is this the least intrusive means? If the Council determines that the Ninth Circuit test is satisfied then it must approve the application as required by the TCA. If it finds that the application does not satisfy its ordinance or the Ninth Circuit test, then the City may deny the application but the denial must be supported by substantial evidence. TEST: 1. Does the application satisfy the City's ordinance and LLUPA requirements? If yes, then it should be approved. If no, then the Council must continue its analysis. 2. Does application of City's ordinance or LLUPA act as an effective prohibition? a. Is there a "gap" in the applicant's network coverage? b. If yes, is this the least intrusive means? Factors: feasible alternative sites within search ring area; did applicant apply alternative technology or design options or rule out collocation? The TCA limits state and local regulation "of the placement, construction, and modification of personal wireless service facilities." 47 U.S.C. § 332(c)(7). Such regulation "(I) shall not unreasonably discriminate among providers of functionally equivalent services; and (II) shall not prohibit or have the effect of prohibiting the provision of personal wireless services." 47 U.S.C. §§ 332(c)(7)(B) (i). Further, state and local governments must act on applications "within a reasonable period of time" and may not deny such an application except in a written decision "supported by substantial evidence contained in a written record." Id. § 332(c)(7)(B) (emphasis added). Joint Training 06/23/15 Page 3 5. ECC 8-2A-6-B.6.a. Height Allowances 6. Architectural appurtenance height restrictions: a. All spires, poles, antennas, steeples, towers, and any other such structures shall be limited to a maximum of forty feet (40') within the DDA and TDA and thirty five feet (35') in all other locations. Additional height may be permitted if a conditional use permit is approved by the city council. 6. Conditional Use Permits ECC 8-7-3-1: PURPOSE AND INTERPRETATION OF CONDITIONAL USE: A. Purpose: It is recognized that an increasing number of new kinds of uses are appearing daily, and that many of these and some other more conventional uses possess characteristics of such unique and special nature relative to location, design, size, method of operation, circulation and public facilities that each specific use must be considered individually. B. Interpretation Of Conditional Use: Any use which is permitted as a conditional use in a district under the terms of this title shall not be deemed a nonconforming use in such district, but shall, without further action, be considered a conforming one. (Ord. 40, 10- 1978, rev. 9-1980) 7. Density A. Net v. Gross ECC 8-1-2 DENSITY: A unit of measurement; the number of dwelling units per acre of land. Gross Density: The number of dwelling units per acre of total land to be developed, including public right of way, private streets, and common area open space; excluding floodway. Net Density: The number of dwelling units per acre of land when the acreage involved includes only the land devoted to residential uses, excluding public right of way, private streets, common area open space, and floodway. Comprehensive Plan Land Use 6.3. For the purposes of this comprehensive plan, the density shall be defined as the ratio of the total number of dwelling units within a project divided by the total project area. Should that number be a fraction, it shall be rounded up to the nearest whole number, except where the comprehensive plan details a fractional density, and then the density shall not exceed the number described in the comprehensive plan. Comprehensive Plan A. "In accordance with" -IC 67 -6511(b) -only applies to enactment of zoning ordinances A comprehensive plan is not a legally controlling zoning law, it serves as a guide to local government agencies charged with making zoning decisions. The 'in accordance with' language of I.C. § 67-6511 does not require zoning decisions strictly conform to the land use designations of the comprehensive plan. However, a board of commissioners cannot ignore their comprehensive plan when adopting or amending zoning ordinances. Evans v. Teton Cnty, 139 Idaho 71, 76, 73 P.3d 84, 89 (2003) (citations omitted). B. "Not in conflict with" -IC 67-6512(a) applies to special use permits "[A] valid comprehensive plan is a precondition to the validity of zoning ordinances." Sprenger, Grubb & Associates v. Hailey ("Sprenger Grubb 11"), 133 Idaho 320, 322, 986 P.2d 343, 345 (1999). "The enactment of a comprehensive plan is a precondition to the validity of zoning ordinances.... It follows a fortiori that an amendment to a zoning ordinance must also be in accordance with the adopted plan." Love v. Bd. of Cnty Comm'rs of Bingham Cnty, 105 Idaho 558, 559, 671 P.2d 471, 472 (1983). "[T]he mandate ... is not a mere technicality .... Rather, the comprehensive plan is the essence of zoning. Without it, there can be no rational allocation of land use.... [W]ithout a comprehensive plan, zoning ... may tyrannize individual property owners." Dawson Enterprises, Inc. v. Blaine Cnty, 98 Idaho 506, 509, 567 P.2d 1257, 1260 (1977) The land use application should include a detailed, point -by -point recitation of the comprehensive plan provisions and how the proposed action squares with the comprehensive plan. Likewise, a project opponent should prepare a detailed critique of the proposed action based on the comprehensive plan. These analyses should be made part of the record and should serve as a guide for the decision -makers providing for a more defensible decision, in the event of an appeal. Likewise, the P&Z commission and the governing board should include in their decision documents a thorough discussion of those elements of the comprehensive plan bearing on their decision. Joint Training 06/23/15 Page 5 9. Scope of Deliberation/Improper Considerations A. Improper findings or considerations at deliberation: "We don't want apartments" "It will bring in the riff-raff" "We don't want rentals" B. Be wary of unsubstantiated claims: "Our property values will decrease" "It will be too loud" "This will increase traffic" "The schools will become overcrowded" C. Make sure to deliberate facts that are actually in the record. In Sanders Orchard v. Gem Cnty, 137 Idaho 695, 702, 52 P.3d 840, 847 (2002), the Idaho Supreme Court found that the county based its decision on a factual finding which was supported by no evidence in the record. Gem County denied a developer's subdivision application because it did not provide for a central water and sewer system. Although the Idaho Supreme Court found that the county had discretion to require such infrastructure, there was no factual basis for the county's conclusion that "it is projected that development of central sewer system and water lines will be extended to that area in the reasonably near future." Sanders Orchard, 137 Idaho at 702, 52 P.3d at 847. The court reached this conclusion despite the fact that there was some opinion testimony in the record regarding when water and sewer service might be extended. The court was rigorous in looking past these "opinions" and "feelings", emphasizing that there were no facts in the record to support the county's finding. D. Don't make "pre -decisional" statements during the hearing or deliberation.
