PUBLIC COMMENT: This time is reserved for the public to address their elected officials regarding concerns or comments they would like to provide to the City Council regarding subjects not on the agenda. At times, the City Council may seek comments/opinions regarding specific City matters during this allotted time. This is not the time slot to give formal testimony on a public hearing matter, or comment on a pending application or proposal. Out of courtesy for all who wish to speak, the City Council requests each speaker limit their comments to three (3) minutes. 6. CONSENT AGENDA:  Consent Agenda items are considered to be routine and are acted on with one motion. There will be no separate discussion on these items unless the Mayor, a Councilmember, member of City Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in a sequence determined by the City Council.  Any item on the Consent Agenda which contains written Conditions of Approval from the City of Eagle City Staff, Planning & Zoning Commission, or Design Review Board shall be adopted as part of the City Council’s Consent Agenda approval motion unless specifically stated otherwise. A. Claims Against the City. B. Noise Waiver Request: The Eagle Chamber of Commerce is requesting a noise Wavier for Saturday, July 11, 2015 until midnight to accommodate Fun Days activities. The waiver would apply for the area generally located between Eagle Road and Flower Lane and Aikens and the alley between State Street and Idaho. (SKB) C. Noise Waiver Request: The Parks & Recreation Department is requesting a noise waiver to be utilized on July 11, 2015 for Eagle City limits in order to accommodate the sound associated with the fireworks display for Eagle Fun Days. The waiver is requested until midnight. (MA) D. Resolution 15-20 – Solid Waste Collection Adjustment to Customer Rates: A Resolution of the City of Eagle, Idaho, increasing the solid waste fee for residential and commercial customers by $0.12 per month, to be effective with the next regularly scheduled billing cycle following approval of the City, pursuant to Section 2.2 of the Second Addendum to the Waste Collection Services Contract between the City of Eagle and Allied Waste Services Of North America, LLC; and providing for effective date. Findings of Fact and Conclusions of Law for RZ-02-15 – Rezone from R-4 (residential) to CBD (central business district) – Shawn Nickel: Shawn Nickel is requesting a rezone from R-4 (Residential) to CBD (Central Business District). The 0.137-acre site is located on the west side of North Eagle Road approximately 500-feet north of West State Street at 203 North Eagle Road. (WEV) F. Task Order No. 15-01 – Plaza Drive Extension Project – City of Eagle: City staff is requesting City Council approval of Task Order 15-10 with Baer Design Group, LLC, Greg Baer, Principal, to 1) create a landscape, irrigation, and lighting design for the Plaza Drive Extension project; and 2) Prepare cost estimates and construction drawings for integration into the ACHD project design and bidding process. (WEV) G. Memorandum of Understanding between the City of Eagle and the Eagle and the Eagle Urban Renewal Agency. (SKB) H. Award of Bike Skill Park Service Agreement to Progressive Bike Ramps: Authorizing the Mayor to enter into an agreement with Progressive Bike Ramps for the installation of a bike skill park at Eagle Sports Complex. Resolution 15-21 – Extending the Sunset Clause to October 31, 2015: A Resolution of the City Council of the City of Eagle, Ada County, Idaho, amending Resolution 14-29 by amending the sunset date of the Stakeholders Committee and providing an effective date. Ordinance 733 - A Zoning Ordinance Amendment to Eagle City Code Title 8 “Zoning”, Chapter 1 “Zoning Interpretation and Definitions”, Chapter 2 “Zoning Districts and Maps”, Section 3 “Schedule of District Use Regulations”; And Providing An Effective Date. This item was continued from the June 9, 2015 meeting. (WEV) 8. PUBLIC HEARINGS: Public Hearings are legally noticed hearings required by state law. The public may provide formal testimony regarding the application or issue before the City Council. This testimony will become part of the hearing record for that application or matter. A. RZ-28-06 MOD & PP-02-15 – Crossley Park Subdivision – Greg Hall: Greg Hall, represented by Tim Mokwa with KM Engineering, LLP, is requesting a development agreement modification (development agreement in lieu of a PUD), and preliminary plat approval for Crossley Park Subdivision, a 33-lot (32-buildable and 1-common) residential subdivision. The 6.77-acre site is generally located on the south side of W. Flint Drive at 3391 W. Flint Drive. (WEV) B. CU-01-15 – Contractor’s Yard – Chris Lombardo: Chris Lombardo represented by Brad Smith with Babcock Design Group, is requesting conditional use permit approval for a contractor’s yard. The 1.07-acre site is generally located on the north side of East State Street approximately 125 feet west of the intersection of East McGrath Road and East State Street at 1740 East State Street. (WEV) C. PP-11-05 MOD2 - Henry’s Fork Preliminary Plat Modification (Formerly Park Place Gardens/Shaunnesy Subdivision) – Henry’s Fork LLC: Henry’s Fork, LLC, represented by T. Hethe Clark with Spink Butler, LLP, is requesting a modification to the preliminary plat for Henry’s Fork Subdivision, a 126-lot (112-buildable, 14-common) residential development. The applicant is requesting to delete the requirement to provide a stub street (De Soto Ave.) and bridge across the Dry Creek Canal for access to the property to the north of the development. The 95.32–acre site is located between Meridian Road and Park Lane approximately 1,300 feet north of Floating Feather Road. (WEV) CITY COUNCIL AGENDA June 23, 2015 6:30 P.M. Selvage, is requesting City Council approval for the release of the surety ($5,000.00) currently being held by the City for the construction of the “west pathway” within Streamside Subdivision. Discussion and possible action on the development of a budget and hiring of an subcontractor to perform the analysis, interpretation and reporting of the Eagle Road/State Street Intersection surveys.
