ROLL CALL: Present: WRIGHT, GUERBER, MCCAULEY, MCLAUGHLIN, SMITH. A quorum is present. CONSENT AGENDA: ♦ Consent Agenda items are considered to be routine and are acted on with one motion. There will be no separate discussion on these items unless the Chairman, a Commissioner, member of City Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in a sequence determined by the Rules of Order. ♦ Any item on the Consent Agenda that contains written recommendations from the City of Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda approval motion unless specifically stated otherwise. A. Minutes of November 16, 2020. McLaughlin moves to approve the consent agenda as presented. Seconded by McCauley. ALL AYES... MOTION CARRIES. 4. UNFINISHED BUSINESS: NONE City Planner, Mike Williams asks the Commission to move agenda item 6A (VAC-03-20) ahead of agenda item 5A for the sake of time. Guerber moves to amend the agenda to hear agenda item 6A before item 5A. Seconded by McLaughlin. 6-. 5. NEW BUSINESS: A. VAC-03-20 — Vacation to the final plat of Foxglove Estates Subdivision No. 2 — Jennifer & Leonard Fisher: Jennifer & Leonard Fisher are requesting to vacate the southern 6-feet of the 12-foot rear yard public utility, pressurized irrigation, and drainage easement located within Lot 21, Block 2, Foxglove Estates Subdivision No.2. The 9,591-square foot site is located at the north terminus of North Champions Place approximately 270-feet north of the intersection of West Saguro Drive and North Champions Place at 1190 North Champions Place. (MJW) City Planner, Mike Williams provides an overview of the application on behalf of the applicant. Guerber asks a question regarding an easement by the canal on the property. Williams responds to questions from the Commission. Guerber moves to recommend approval of item 5A (VAC-03-20) — Vacation to the final plat of Foxglove Estates Subdivision No. 2. Seconded by Smith. ALL AYES ... MOTION CARRIES. -5- 6. PUBLIC HEARINGS: A. ACTION ITEM: CPA 01-20 & RZ-05-20 — Quarry Village — CDG Enterprise/Quarry Village, LLC: CDG Enterprise/Quarry Village, LLC, represented by Dave Yorgason with Tall Timber Consulting, is requesting a Comprehensive Plan Text Amendment to modify section 6.18.1- Guerber Park Planning Area, a Comprehensive Plan Map Amendment to change the future land use map designation from Business Park to Mixed Use, and a rezone Page 1 of 4 K:\P&Z\MINUTES\2020\PZ-12-07-20min.docx from BP (Business Park) to MU-DA (Mixed Use with a development agreement [in lieu of a conditional use permit]) to allow for a residential, office, retail and indoor entertainment development. The 27.3-acre site is located north of Hill Road between State Highway 55 and North Horseshoe Bend Road at 9755 North Horseshoe Bend Road. (NBS & MJW) This item was continued from the November 16, 2020 Planning & Zoning Commission meeting. Cindy Greco, 18452 Bernardo Trails Court, San Diego, CA 92128. The property owner provides her vision for the site and overview of the application. Dave Yorguson, 14254 W. Battenburg Drive, Boise, ID 83713. Yorguson provides a detailed description of the development and overview of the application. Yorgason responds to questions from the Commission. City Planner, Nichoel Baird Spencer, provides an overview of comprehensive plan. City Planner, Mike Williams, provides a detailed overview of the application. Baird Spencer and Williams respond to questions from the Commission. Chairman Wright opens the Public Hearing. Jeff Stucker, 2255 E. Halsey Drive. Stucker supports the application, expresses excitement related to small town charm and the city needing a multi -use space that the community can walk and bike to. Sandie Gibson, 2682 E. Mariposa Drive (via WebEx). Gibson supports the application, expresses that Eagle is need of a space like this, especially the housing element since in her opinion as a realtor, there is a shortage of inventory. Jason Harmon signed up to participate (via WebEx) but was not present when called upon. Debra Arnold, 2991 E. Gold Creek Street (via WebEx). Arnold supports the application, stating that it would serve the community well and enhance the beauty of the area. Dave Yorguson, the applicant's representative, 14254 W. Battenburg Drive, Boise, ID 83713 addresses concerns raised during the discussion of the application and provides rebuttal. Chairman Wright closes the Public Hearing. General discussion amongst the Commission. MOTION #1: Guerber moves to recommend the approval of item 6A, CPA-01-20 (Quarry Village) to amend the Comprehensive Plan from Business Park to Mixed Use commercial allowance. Seconded by McCauley. MOTION CARRIES. MOTION #2: Guerber moves to rezone this property to mixed use with a development agreement and send this item to staff for negotiation to return to council with an outline of what would be recommended, a rezone to MU/DA in a development agreement to go forward that includes the 18 items that were outlined by the staff, three-foot berm, two access points to the north and a cap of 196 residential units on the site. Seconded by McCauley. City Planner Mike Williams requests the applicant propose amendments to the conditions: 3.6 — that they allow the parking garage to a maximum of 48 feet and 3.8 — that the building be limited to a maximum of 235,000 square feet, non-residential. AMMENDED MOTION #2: Guerber agrees to amend the motion. McCauley seconds. SUBSTITUTE MOTION: Smith moves to recommend RZ-05-20 be remanded back to the city planners. Seconded by Guerber. A-04-20/RZ-04-20/CU-02-20/PPUD-01-20/PP-02-20 — Stags Crossing Planned Unit Development — Urban Solutions LLC: Urban Solutions, LLC, represented by Steve Hart, is requesting an annexation, rezone from RUT (Rural -Urban Transition — Ada County designation) to R-2-DA-P (Residential with a development agreement — PUD), conditional use permit, preliminary development plan, and preliminary plat approvals for Stag Crossing Subdivision, a 135-lot (113-buildable, 22-common) residential planned unit development. Access via Beacon Light for the entirely of the project is a viable alternative.
