THIS FIRST AMENDMENT TO AGREEMENT FOR DEVELOPMENT OF DOG
PARK, made this 16th day of December, 2020 (hereinafter referred to as " First Amendment"),
between the City of Eagle, Idaho, an Idaho municipal corporation ("City") and PetIQ, LLC, an
Idaho limited liability company "Donor"). City and Donor are sometimes collectively referred to
herein as the "Parties."
RECITALS
WHEREAS, the Parties entered into that certain Agreement For Development of Dog
Park on November 24, 2020 (the "Agreement") wherein Donor agreed to construct certain
improvements to a portion of the Ada/Eagle Sports Complex to be used as a dog park (the "Dog
Park")
WHEREAS, pursuant to the terms of Agreement, Donor was to install sod at the Dog
Park but instead has installed a paved asphalt trail;
WHEREAS, the Parties wish to amend the Agreement to remove Donor's obligation to
install sod at the Dog Park, since Donor installed a paved asphalt trail.
NOW THEREFORE, for good and valuable consideration, the receipt and sufficiency of
which is hereby acknowledged, the Parties agree to amend the Agreement as follows:
1. Exhibit A to the Agreement is hereby amended to delete the words "and sod" as shown
in the strike through on Exhibit A-1 attached to this First Amendment.
2. All other terms of the Agreement shall remain the same and in full force and effect.
IN WITNESS WHEREOF, the parties hereto have executed this First Amendment as of
the date first above written.

2. Earthwork to Establish roughly 6" of Top Soil and Grade
3. Landscape which includes sprinkling system and Sed over approximately 77,000 Sqft
4. Split rail fencing around Little and Big Dog Park
