Findings - CC - 2020 - DR-53-20 - Molinary Park Sub Entry SignageBEFORE THE EAGLE CITY COUNCIL IN THE MATTER OF AN APPLICATION ) FOR DESIGN REVIEW FOR A ) SUBDIVISION ENTRY MONUMENT ) SIGN FOR MOLINARI PARK ) SUBDIVISION FOR EAGLE 26, LLC ) FINDINGS OF FACT AND CONCLUSIONS OF LAW CASE NUMBER DR-53-20 The above -entitled design review application came before the Eagle City Council for their action on October 27, 2020. The Eagle City Council having heard and taken oral and written testimony, and having duly considered the matter, makes the following Findings of Fact and Conclusions of Law; FINDINGS OF FACT: A. PROJECT SUMMARY: Eagle 26, LLC, represented by Virginia Cunningham with Golden West Signs, is requesting design review approval of a subdivision entry monument sign for Molinari Park Subdivision. The 23.06-acre site is located on the south side of East Plaza Drive approximately 300-feet east of the intersection of South 2'd Street and East Plaza Drive. B. APPLICATION SUBMITTAL: The City of Eagle received the application for this item on August 20, 2020. C. HISTORY OF RELEVANT PREVIOUS ACTIONS: On March 12, 2019, the Eagle City Council approved a rezone from CBD (Central Business District) to CBD-DA-P (Central Business District with a development agreement — PUD), conditional use permit, preliminary development plan, and preliminary plat for Molinari Park Subdivision (RZ-07- 18/CU-03-18/PPUD-02-18/PP-06-18). D. COMPANION APPLICATIONS: DR-18-20 (common area landscaping). E. COMPREHENSIVE PLAN DESIGNATION: Downtown, Scenic Corridor, Public/Semi-Public. F. ZONING DESIGNATION: CBD-DA-P (Central Business District with a development agreement — PUD). G. DESIGN REVIEW OVERLAY DISTRICT: The site is located in the CEDA (Community Entry Development Area). H. "Molinari Park" — 4 '/2" high letters routed from '/2" white acrylic stud mounted flush to background. Horizontal line — routed from I/2" white acrylic stud mounted flush to background. Per Eagle City Code — shall be complementary to the subject property as well as the surrounding area *Note: Actual Sign Area is 2' 9 'A" high x 5' 5" wide, offset one foot top and side from the main sign structure. J. AGENCY RESPONSES: None K. LETTERS FROM THE PUBLIC: None received to date. THE CITY COUNCIL RECEIVED AND REVIEWED THE FOLLOWING STAFF ANALYSIS PROVIDED WITHIN THE STAFF REPORT: A. COMPREHENSIVE PLAN PROVISIONS WHICH ARE OF SPECIAL CONCERN REGARDING THIS PROPOSAL: • Protect and enhance the small town character of the City by requiring signage which is creative and distinctive, compatible with its surroundings, and an integral component of the style and character of the building to which it relates. B. ZONING CODE PROVISIONS WHICH ARE OF SPECIAL CONCERN REGARDING THIS PROPOSAL: • Eagle City Code Section 8-2A-2(B) The general theme of the Design Review Overlay District is to specify desirable building and landscape architectural styles and materials to create a sustainable and pleasing environment for residents and visitors alike. The architectural designs, materials, and graphics set forth in this article are complied to create a theme unique to the area called "Eagle Architecture". The city must find that any illuminated sign permitted under the specific regulations within this article is designed such that brightness levels are controlled to assure a soft, subtle effective light in accordance with other city regulations intended to create and maintain the Eagle architecture theme, while encouraging energy efficient lighting. b. Illumination types, styles, and practices not listed herein shall be prohibited unless otherwise deemed by the design review board and city council to be consistent with the Eagle architecture theme. c. Floodlighting is permitted only through the use of incandescent, LED and high pressure sodium light sources. d. Exposed neon is permitted when used to create the sign letter(s) or as an architectural element as part of the sign design. A clear covering may be permitted for protection of the neon element. e. Halo illumination is permitted. f. Metal halide is not permitted as a light source for signage. g. All types of internal illumination is prohibited, except for automated signs and drive- through/drive-up service menu board signs as regulated in this article. • Eagle City Code Section 8-4-4-2: Additional Design and Maintenance Regulations and Requirements: 6. Except as otherwise permitted within this title, incandescent lights, two hundred fifty (250) watt maximum high pressure sodium lights, 3000K maximum LED lights (or approved equivalent) shall be the only type of site and building lighting permitted. C. DISCUSSION: • The applicant is proposing to construct one monument sign for Molinari Park Subdivision on the southeast corner of South Finn Street and East Plaza Drive. The sign will be made of concrete with variable texture and corten steel with rust patina finish. The applicant is proposing to externally flood illuminate the single face monument sign. Staff defers comment regarding the subdivision entry monument sign to the Design Review Board. ADDITIONAL FACTS ADDRESSED BY THE CITY COUNCIL: A. DEVELOPMENT AGREEMENT PROVISIONS WHICH ARE OF SPECIAL CONCERN REGARDING THIS PROPOSAL: 3.14 The Owner shall submit a design review application showing at a minimum: 1) proposed development signage, 2) planting details within the proposed common areas throughout the development, 3) landscape screening details and buffering for the residential units located adjacent to State Highway 44, 4) elevation plans for all proposed common area structures and irrigation pump house (if proposed), and 5) useable amenities such as picnic tables, covered shelters, benches, playground equipment, gazebos, and/or similar amenities. The design review application shall be reviewed and approved by the Eagle Design Review Board and City Council prior to the submittal of a final plat application. STAFF RECOMMENDATION PROVIDED WITHIN THE REPORT: Based upon the information provided to staff to date, staff recommends approval of the requested design review application with the site specific conditions of approval and the standard conditions of approval provided within the staff report. A meeting to consider the application was held before the Design Review Board on September 24, 2020, at which time the Board made their decision. B. Oral testimony in opposition to the application was presented to the Design Review Board by no one. C. Oral testimony in favor of the application was presented to the Design Review Board by no one (not including the applicant/representative). BOARD DELIBERATION: (Granicus time 2:18:00) Upon completion of the applicant's and staff's presentations, the Board discussed during deliberation that: • The Board determined that the design and materials of the subdivision entry monument sign are modern looking and may not compliment the proposed buildings. The Board has not reviewed any proposed buildings within Molinari Park Subdivision to date and cannot at this time determine whether the subdivision entry monument sign will be harmonious with the overall subdivision design elements. BOARD DECISION: The Board voted 6 to 0 (Brasher absent) to recommend denial of DR-53-20 for a design review application for a subdivision entry monument sign for Molinari Park Subdivision for Eagle 26, LLC. PUBLIC MEETING OF THE COUNCIL: D. A meeting to consider the application was held before the City Council on October 27, 2020, at which time the Board made their decision. E. Oral testimony in opposition to the application was presented to the City Council by no one. F. Oral testimony in favor of the application was presented to the City Council by no one. COUNCIL DECISION: The Council voted 4 to 0 to deny DR-53-20 for a design review application for a subdivision entry monument sign for Molinari Park Subdivision for Eagle 26, LLC. CONCLUSIONS OF LAW: 1. The Council reviewed the particular facts and circumstances of this proposed design review application (DR-53-20) with regard to the Eagle City Code Title 8, Chapter 2, Article A, DR Design Review Overlay District, and based upon the information provided concludes that the proposed design review application is not in accordance with the Eagle City Code and the Eagle Comprehensive Plan. 2. The Council reviewed the particular facts and circumstances of the proposed design review in terms of Eagle City Code 8-2A-13(B)(2)(i), and has concluded: i. The proposed subdivision entry monument sign has not been determined to be harmonious with the architectural design of the proposed buildings throughout the Molinari Park development, since the buildings have not been submitted for design review approval.
