The City would like to honor Margo Walter for her service to the Eagle community while serving on the Library Board of Trustees. B. The City would like to honor Michelle Anderson for her service to the Eagle community while serving on the Eagle Arts Commission. 5. VOLUNTEER OF THE MONTH – APRIL The City of Eagle recognizes the importance of volunteerism and is taking a moment to thank those who selflessly give of themselves to the community. A plaque will be displayed in the lobby recognizing these outstanding volunteers. KERON PRIVON: The Eagle Public Library has a wonderful team of volunteers who are essential to our day-to-day operation. Keron Privon is an indispensable member of this team, and has been a volunteer with the Eagle Public library for almost 17 years. Mrs. Privon began volunteering at the library in 1998, before the current building was constructed, and is an incredibly reliable and dedicated volunteer for the Technical Services Department. Keron is exceedingly dependable, and as the longest working volunteer at the Eagle Public Library, she is an obvious asset to the staff. Mrs. Privon is consistently able to complete tasks quickly, efficiently and accurately, and has completed an impressive amount of work for the library. In fact, in her time volunteering at the library, Keron has covered more than 13,000 books! Mrs. Privon is a pleasure to work with, and approaches all tasks with enthusiasm and interest. She has great attention to detail and obvious pride in her work. Keron regularly covers books and processes audiovisual materials, but has also performed more diverse tasks such as processing board games, video games, and other more unusual library materials. She also is always happy to fill in as needed, and has helped package and mail interlibrary loans when other volunteers are absent. Mrs. Privon is always open to learning new skills, and cheerfully and capably completes any task she is given. The library staff sincerely appreciates Mrs. Privon’s time, her positive attitude, and the consistently excellent quality of her work. 6. ADDITIONS, DELETIONS OR MODIFICATIONS TO THE AGENDA 7. PUBLIC COMMENT: This time is reserved for the public to address their elected officials regarding concerns or comments they would like to provide to the City Council regarding subjects not on the agenda. At times, the City Council may seek comments/opinions regarding specific City matters during this allotted time. This is not the time slot to give formal testimony on a public hearing matter, or comment on a pending application or proposal. CONSENT AGENDA:  Consent Agenda items are considered to be routine and are acted on with one motion. There will be no separate discussion on these items unless the Mayor, a Councilmember, member of City Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in a sequence determined by the City Council.  Any item on the Consent Agenda which contains written Conditions of Approval from the City of Eagle City Staff, Planning & Zoning Commission, or Design Review Board shall be adopted as part of the City Council’s Consent Agenda approval motion unless specifically stated otherwise. A. Claims Against the City. B. Volunteer of the Month Proclamation – A proclamation recognizing April 15, 2015 as Keron Privon Day in the City of Eagle, Idaho. C. Findings of Fact and Conclusions of Law for RZ-20-06 MOD2 – Bel Air Eagle – American Communities: American Communities, represented by Dave Yorgason with Tall Timber Consulting, is requesting a development agreement modification to allow for a multi- family development consisting of 14-buildings (13-multi-family buildings containing 300- dwelling units and one (1) club house) including a height exception to 45-feet for the multi- family buildings. The 22.17-acre site is generally located at the southwest corner of West Old Valley Road and North Linder Road. (WEV) D. FPUD-02-15/FP-02-15 – Final Development Plan and Final Plat for The Preserve Subdivision No. 4 – The Preserve, LLC.: The Preserve, LLC, represented by Becky McKay with Engineering Solutions, LLP, is requesting final development plan and final plat approval for The Preserve Subdivision No. 4, a 11.45-acre, 40-lot (36-buildable, 4-common) residential subdivision. The Preserve Planned Unit Development is generally located 650-feet west of Linder Road and north of State Highway 44. (WEV) E. FPUD-01-15/FP-01-15 – Final Development Plan and Final Plat for Alderwood Village Subdivision No. 2 – Tealey’s Land Surveying: Tealey’s Land Surveying represented by Pat Tealey, is requesting final development plan and final plat approval for Alderwood Village Subdivision No. 2, an 18-lot (15-buildable, 3-common) residential subdivision. The 4.7-acre site is generally located at 947 W. State Street approximately 430-feet west of South Grandean Way. (WEV) F. FP-22-14 - Final Plat for Watermark Subdivision – Watermark Subdivision (formerly Eagle Lofts Subdivision) BHH Investments II, LLC.: BHH Investments, LLC, represented by Kevin McCarthy, P.E., with KM Engineering, LLP, is requesting final plat approval for Watermark Subdivision (formerly Eagle Lofts Subdivision), a 82-lot (76-buildable, 5- common, and 1-open non-buildable) residential subdivision. The 18.58-acre subdivision is located on the south side of Riverside Drive approximately 1,600-feet west of the intersection of Riverside Drive and S. Edgewood Lane. (WEV) G. Task Order No. 15-01 – Isla del Rio – Environmental Conservation Services, Inc.: City staff is requesting City Council approval of Task Order 15-01 under the Master Consulting Services Agreement with Environmental Conservation Services Inc., Charlie Baun, Lead Ecologist/Principal, to review the Isla del Rio Habitat Report and provide the City a recommendation of approval or approval with conditions for the associated applications. (NBS) H. Minutes of March 24, 2015. I. Master Service Agreement between Zayo Group, LLC and the City of Eagle for Ethernet & IP Services. $46,000 funding for the project was approved in the Amended FY 14/15 Budget and the agreements have been reviewed by the City Attorney. FPUD-09-14 & FP-21-14 – Final Development Plan and Final Plat for Mace River Ranch Subdivision No. 4 – Gardner Mace Company, LC. Gardner Mace Company, LC, represented by Scott Wonders, is requesting final development plan and final plat approval for Mace River Ranch Subdivision No. 4, a 69-lot (63-buildable, 6-common) residential development. The 67.33-acre site is located adjacent to the north side of Mace Road west of the intersection of Mace Road and North Eagle Road (SH-55) at 800 W. Mace Road.(WEV) K. ACHD Master Street Map Recommendation: Staff is requesting the Council’s approval of the recommendation to ACHD on the Master Street Map within the City of Eagle. (NBS) 9. UNFINISHED BUSINESS: A. Resolution 15-14: A resolution between the City of Eagle and Eagle Park BMX, Inc. A resolution approving an agreement between the City of Eagle and Eagle Park BMX, Inc. for use of 6.61 acres of the Ada-Eagle Sports Complex; authorizing the Mayor and City Clerk to respectively execute and attest said agreement; and providing an effective date.. (MA) This item was continued from the March 24, 2015 meeting. 10. PUBLIC HEARINGS: Public Hearings are legally noticed hearings required by state law. The public may provide formal testimony regarding the application or issue before the City Council. This testimony will become part of the hearing record for that application or matter. A. A-06-14/RZ-07-14/PP-03-14 – Eaglefield Village Subdivision – Coleman Homes, LLC.: Coleman Homes, LLC, represented by Becky McKay with Engineering Solutions, LLP, is requesting an annexation, rezone from RUT (Rural-Urban Transition – Ada County designation) to MU-DA (Mixed Use with a development agreement in lieu of a PUD), and preliminary plat approvals for Eaglefield Village Subdivision, a 39-lot (31-buildable, 1-future development, and 7- common) residential subdivision. The 9.83-acre site is generally located on the north side of State Highway 44, west of Linder Road, at the western terminus of W. Escalante Drive. (WEV) B. CPA-04-14/RZ-07-14 – Comprehensive Plan Map Amendment from Residential Four to Mixed Use and Rezone with a Development Agreement from R-4 (Residential) to MU-DA (Mixed Use with a development agreement) – Jayo Development, Inc.: Jayo Development, Inc., represented by Shawn Nickel with SLN Planning, is requesting a Comprehensive Plan Map Amendment from Residential Four to Mixed Use and rezone with a development agreement from R-4 (Residential) to MU-DA (Mixed Use with a development agreement in lieu of a PUD) for the allowance of six (6) patio homes. The 0.88-acre site is located on the south side of West Floating Feather Road at 135 West Floating Feather Road. (WEV) C. CU-04-14 – Personal Wireless Facility – Doug Kofford/TAEC: Doug Kofford/TAEC is requesting conditional use permit approval for a cell tower (defined as “personal wireless facility height-over 35-feet” in Eagle City Code) to be located at the Eagle High School site in place of an existing baseball field light pole. The applicant is also requesting conditional use permit approval of a setback waiver to decrease the minimum tower setback from two times (2x) the height of the tower from the property line of any residential dwelling. The proposed 2,500-square foot lease area is located adjacent to the outfield fence of the Eagle High School baseball field approximately 175-feet east of North Park Lane at 574 North Park Lane. Republic Service proposed CPI increase: As allowed in Section 4.2A “Customer Rates— Establishment” of the Solid Waste Contract between the City of Eagle and Republic Services provides for fee adjustments according to the current Consumer Price Index (“CPI”) Public testimony is being taken regarding the annual rate adjustment based on the Consumer Price Index (CPI) in the amount not more than 1.862% to be added to the current amount billed per Republic Services Customer. NEW BUSINESS: A. FPUD-03-15/FP-03-15 – Final Development Plan and Final Plat for The Preserve Subdivision No. 5 – The Preserve, LLC. The Preserve, LLC, represented by Becky McKay with Engineering Solutions, LLP, is requesting final development plan and final plat approval for The Preserve Subdivision No. 5, a 15.53-acre, 37-lot (30-buildable, 7-common) residential subdivision. The Preserve Planned Unit Development is generally located 650-feet west of Linder Road and north of State Highway 44. (WEV) B. Ordinance 732 (Annexation & Rezone for Sharon & Shane Mace Property): An Ordinance Annexing Certain Real Property Situated In The Unincorporated Area Of Ada County, Idaho, And Contiguous To The Corporate Limits Of The City Of Eagle, To The City Of Eagle, Idaho; Changing The Zoning Classification Of Said Real Property Described Herein From Rut (Rural- Urban Transition) To R-E (Residential-Estates); Amending The Zoning Map Of The City Of Eagle To Reflect Said Change; Directing That Copies Of This Ordinance Be Filed As Provided By Law; And Providing An Effective Date. Property location: The 4.6-acre site is located approximately 1200-feet west of the intersection of South Chipper Way and South Locust Grove Road at 1960 West Joplin Lane. C. Discussion of Establishing a Process for Requests for Reconsideration: Pursuant to the Local Land Use Planning Act, Idaho Code Section 67-6535(2)(b), the City is to have a process for an applicant or affected person to seek reconsideration within 14-day after the final decision on a land use application by the City. Applicants or affected persons must seek reconsideration prior to seeking judicial review of a City decision. (CDM) D. Discussion and possible acceleration of City of Eagle’s financial commitment for Plaza Drive extension. (JK) 12.
