Minutes - 1991 - City Council - 08/27/1991 - Regular EAGLE CITY COUNCIL MEETING AUGUST 27, 1991 The Eagle City Council met in regular session on August 29, 1991. Mayor GUERBER presiding. The following members were present: WALKER, RICK YZAGUIRRE, TOM MINOW. Moved by YZAGUIRRE and seconded by HAMMONS to approve the minutes of the August 13, 1991 meeting as presented. ALL AYE: MOTION CARRIED. STEVE HAMMONS, GARY ORDINANCES-RESOLUTIONS: Moved by MINOW and seconded by YZAGUIRRE to dispense with the three day ruling and to consider Ordinance 190, the Annual Appropriation Ordinance 1991-92 at this time. ALL AYE: MOTION CARRIED. Moved by MINOW and seconded by WALKER to adopt Ordinance 190, the Annual Appropriation Ordinance 1991-92 at this time. ALL AYE: MOTION CARRIED. Moved by YZAGUIRRE and seconded by MINOW to dispense with the three day ruling and to consider Ordinance 191, an ordinance changing the hours the election hours from 12:00 P.M. to 8:00 P.M. to 8:00 A.M. to 8:00 P.M. at this time. ALL AYE: MOTION CARRIED. Moved by YZAGUIRRE and seconded by MINOW to adopt Ordinance 191, establishing new election hours at this time. ALL AYE: MOTION CARRIED. ORDINANCE 192: City Attorney, Mona Mack advised Council that this amendment to Title 8 must go through the public hearing process in order to pass Council. NEW BUSINESS: RANDALL ACRES/complaints of the public regarding the mobile homes and trash in the area. Two written complaints, one in the form of a petition, were presented to the City. Randall Johnson, told Council his complaint was in reference to the whole subdivision. He asked for control in an orderly fashion for mobile homes to be legally placed on lots within the subdivision, with permits from the City. Other property owners giving testimony were: Anna Johnson, B.L. Henderson, Al D. Low, Susan R. Saint, Steve M. Saint, Clark H. Lot, Karen A. Cary, Jeff Allen, Rita Allen, Elvin J. Albeston, Ruby Burlap, Barbara J. Albeston and Duane and Shirley Burnet. By Council direction the City Attorney is instructed to send letters to those property owners along State Street and within the subdivision in violation of the nuisance and weed Ordinance to clean up their property. The City Engineer will aid the City Clerk in locating illegal mobile homes in the subdivision in order to begin the legal process. The City Building Inspector will be asked to aid there also. The City Clerk was asked to contact the Mosquito Abatement team and drainage ditch in charge of the area to clean it up. A report will come back to the City Council in 30 days. Discussion also took place regarding the amendment to the zoning ordinance (Ordinance #192) permitting a mobile home to be placed on a single family dwelling lot, along with the home in order to shelter a member of the family. It was concluded that this CUP should be monitored by a condition of Council that the CUP be reviewed each year, so that the City would be sure the mobile home is removed once the need is gone. SEWER DISTRICT-Request for Septic Tank Placement: Lynn Sedleck, Eagle Sewer District representative asked Council for a condition of plat approval require that all homes being constructed with individual septic systems must have the septic systems placed on the street side of the home. By Council direction the City Clerk will add the requirement as #31 to the "standard list of subdivision conditions" recently submitted to the Council. MAYOR'S REPORT: Reported on the budget of ACHD for roads and Bridges within the Eagle area for the next 2 years. COMMITTEE REPORTS: MINOW reported on the Redevelopment/grant application. Larry Sale, spoke to Council on the extension of water lines within the area of State Street and Eagle Rd. prior to reconstruction. He informed the Council that typically a utility company will pay for the public improvements when they are asked to extend or relocate their systems, at their expense, providing they are in the public right-of-way. If they are out of the right-of-way the agency sponsoring the improvement usually pays for the relocation. All utilities should be notified about the plans and given the opportunity to work on those systems if they anticipate any changes within the next 5 or 10 years. MINOW also reported on the mitigation regarding the Eagle Alternative Route. He asked for direction in that the agreement includes a provision that the City accept ownership and management of the area (S of western leg of the alternate route and N of the channel). The cost and obligations were discussed by Council. MINOW will report to the City at the next Council meeting after he has meeting with the Transportation Dept. again, expressing our concerns. CLAIMS AGAINST THE CITY: Moved by WALKER and seconded by HAMMONS to approve the claims as presented. ALL AYE: MOTION CARRIED. Moved by MINOW and seconded by HAMMONS to adjourn to go into executive session to discuss acquisition of property. The time was 9:22 p.m. ALL AYE: MOTION CARRIED.
