Minutes - 2015 - City Council - 03/10/2015 - Special EAGLE CITY COUNCIL Special Meeting Minutes March 10, 2015 4:00 P.M. EARLY START TIME INVOCATION: 1. CALL TO ORDER: Mayor Reynolds calls the meeting to order at 4:05 p.m. 2. ROLL CALL: MCFARLAND, BUTLER, KUNZ, RIDGEWAY. All present. A quorum is present. 3. PLEDGE OF ALLEGIANCE: Mayor Reynolds leads the Pledge of Allegiance. 4. UNFINISHED BUSINESS: A. Fee Waiver Request — M3 Companies/M3 Eagle: M3 Companies/M3 Eagle, represented by Mark Tate, is requesting approval of a fee waiver for a portion of the engineering review fees associated with the review of Spring Valley Subdivision No. 1 (PP-06-12). (WEV/SEB) This item was continued from the March 3, 2015 special meeting. Mayor introduces the issue. Joann Butler, representing M3, provides Council a further overview of M3 Companies/M3 Eagle's request for a fee waiver. Discusses mediation. Mark Tate, M3 Companies, provides an overview of the engineering review fees associated with the request for a fee waiver. We have asked for an explanation of the fees on several occasions and we requested mediation. Displays an Ada County Preliminary Plat Fee Comparison which was sent to the City at the end of last year and discusses the same. General discussion. City Attorney Buxton discusses the last minute submittals. The information that is in the Council packet has also been provided to the M3 representatives. Provides an overview of the fee schedule when M3 made their first submittal for their rezone and annexation. Growth has to pay for itself and why would the citizens of the City have to pay for these submittals. The City negotiated the Reimbursement Agreement so M3 was billed actual costs and not estimated costs. The Reimbursement Agreement was negotiated in good faith by all parties. Discusses the various submittals that were required by the Development Agreement. Discussion on staff time and invoices that were billed. General discussion. Planning and Zoning Administrator Vaughan: other than this issue I feel we have a good working relationship with Mark Tate and M3 Companies. Discusses Eagle City Code sections pertaining to this issue and the fee schedule. The Reimbursement Agreement that the City has with M3 is different than the fee schedule found in Eagle City Code. Planner Baird-Spencer: the closest application to this one is in Ada County and their fees are negotiated fees. Discusses the preliminary plat process and the work that was required prior to filing for the preliminary plat. Discussion on the changes to the Eagle City Code. General discussion. Vern Brewer, Holladay Engineering, there were four preliminary plat submittals over an 18 month period. Provides an overview of Holladay's invoices. The first submittal actually didn't have the foundation documents that were required so this was contrary to our usual fee schedule. Spring Valley defined their submittal process in the Development Agreement. At no time did we ever receive a completed submittal. Discusses the requested changes and the change process. Discussion on the fee schedule, engineering fees and staff time. Joann Butler, representing M3, it seems like Mr. Kunz has more information than we had. (Kunz: I read through the line item detail on the invoices.) The staff asked us why we did not do a request for waiver. The issue for us is not the amounts; it is with transparency and bringing clarity to our relationship going forward. Distributes copies the Reimbursement Agreement. The City and we have been remiss on #2 in the Agreement. Discussion on paying all direct costs; you can only charge direct costs and we have the right to ask about these costs. We are just asking for clarification. Let's work together through the Reimbursement Agreement. General discussion. Mayor to Mark Tate: Is this a financial hardship for M3? Mark Tate: No it is not. We were just looking for a venue for discussion and this was your suggestion. General discussion. McFarland moves to deny the Fee Waiver requested by M3, M3 Companies. Seconded by Butler. Discussion. McFarland amends the motion to include Fee Waiver Request denial of M3, M3 Eagle; however, we will reimburse M3 $600 in engineering fees, $665 in engineering fees and the amount on the record for the codification of Title 11. AA-03-15 — Appeal of DR-30-05 MOD2 regarding the Design Review Board decision to disallow the use of barbed wire fencing along the south side of the public pathway along the south channel of the Boise River within Common Lot 35 within the Laguna Pointe Subdivision—The City of Eagle: The City of Eagle, represented by William E. Vaughan, Eagle City Zoning Administrator, is appealing the Design Review Board decision to disallow the use of barbed wire fencing along the south side of the public pathway along the south channel of the Boise River within Common Lot 35 within the Laguna Point Subdivision. Application description: Laguna Pointe Homeowners' Association, Inc., represented by Nicole Hancock with Stoel Rives, is requesting a Page 2 K:ACOUNCILAMINUTES\Temporary Minutes Work AreaVCC-03-10-15spmtng.doc modification to the subdivision's design review approval to allow for the placement of a barbed wire fence (approximately 3,575—feet previously installed, approximately 800— feet to be installed) within Common Lot 35 along the south side of the public pathway along the south side of the south channel of the Boise River. The subdivision is located on the east side of South Eagle Road approximately 800-feet north of East Colchester Drive. (WEV) This item was continued from the March 3, 2015 special meeting. Mayor introduces the issue. Planning and Zoning Administrator Vaughan: You continued this matter and directed us to try and have a meeting with the applicant and brainstorm removal solutions or solutions to increase the safety of the fence. Councilmembers Kunz and Ridgeway and I had an opportunity to meet with Applicants for the DR application. Last Thursday we met and talked about everything under the sun as it relates to this fence. We didn't resolve anything and we did schedule a meeting to walk the pathway yesterday to view the area. We walked the area from noon to 2:00 and I don't believe any resolutions were struck other than a desire to find a resolution. The applicant is here tonight to discuss some possible resolutions. Nicole Hancock, representing Laguna Pointe HOA, displays overheads and discusses the same. Provides Council an overview of her search to find some safety standards. Not finding any standards I looked at Eagle City Code and ACHD Guidelines for Biking path width safety. For the first element of our proposal, pathways 9' or less in width, smooth wire or barbless; and over 9' barbed wire with signs posted. Mr. Peel has researched and suggested adding vinyl safety caps on the posts. General discussion. Nicole Hancock: I want to state on the record that we consider this our appeal and that we satisfied all of the requirements. Planning and Zoning Administrator Vaughan: One of the items from the Thursday meeting that we held with the Applicant last week was for me to find out if there was any safety literature or if there was a knowledgeable safety engineer or if the State Department of Parks/Rec or ICRMP had any points for our consideration as it relates to managing this challenging issue. I did have a chance to talk with ICRMP and they pointed me to the Idaho Recreation Act. While I could not find a specific safety engineer and I did work with our City engineer. Displays overheads and discusses sections from the manual in reference to fences and pathways. General discussion. General Council discussion. Discussion. Zoning Administrator Vaughn: for clarity on the issue I would ask that you specify the color, usually it is black. Additionally extruded aluminum is a material used to build what looks like a wrought iron fence which is also interchangeable so to the extent that you could say wrought iron or extruded aluminum gives the flexibility to the Applicant and the fence virtually looks the same. Update on Parks, Recreation and Trails Master Plan process. (The Land Group) (30 min) Mayor introduces the issue. Mayor: I have been informed by the Land Group that they are willing to do their update at a future date. So moved by Kunz. Seconded by McFarland. ALL AYES: MOTION CARRIES 5. VOLUNTEER OF THE MONTH—MARCH The City of Eagle recognizes the importance of volunteerism and is taking a moment to thank those who selflessly give of themselves to the community. A plaque will be displayed in the lobby recognizing these outstanding volunteers. A. ASHLEY NEUBRAND: Ashley Neubrand has volunteered at the Eagle Historical Museum since October 2010. She came to us from the Basque Museum with knowledge already under her belt and has been a great asset ever since. Ashley's favorite part of helping at the museum is taking photos of the artifacts, which helps us keep a correct database. She is friendly, good at the task at hand, and is always available at a moment's notice to help. Ashley has been an Eagle resident since 1996. She graduated from Eagle High School in 2003 and received two Bachelor's degrees from Boise State in History and Archeology in 2010. Some of Ashley's favorite hobbies are photography, tennis, and archery. Eagle Historical Museum is thankful for her hard work and dedication to helping preserve our city's history. Mayor presents Ashley Neubrand with her Volunteer of the Month Proclamation recognizing March 11, 2015 as Ashley Neubrand Day in the City of Eagle, Idaho. Asheey's name will be on the Volunteer of the Month Plaque which is on display in the City Hall lobby. 6. SERVICE RECOGNITION: A. The City would like to honor Jeff Laughlin for his service to the Eagle community while serving on the Transportation Committee. Mayor presents Jeff Laughlin with the City's eagle plaque for his service on the Transportation Committee. 7. ADDITIONS,DELETIONS OR MODIFICATIONS TO THE AGENDA: Kunz moves to move Agenda Item#9 to just ahead of Item#11New Business and secondly I'm going to propose that we move Agenda Item#10C the public hearing item RZ-06-14 & PP-08-14 - Predico Eagle Point Subdivision move it from sub point C up to A and A will become the new C and B will become the new C. Discussion. Kunz moves to leave the Consent Agenda in place I would propose that we change Item 10C to A and rename,the current A will become B and B will become C. Seconded by McFarland. The work would get the pedestrian bridge project ready for grant applications and would include developing the scope, schedule, budget, design sketches and environmental scan for the project. McFarland I have questions on the discussion at the prior Council meeting about adding playground equipment. Becky McKay, representing the applicant, in addition to the pool facility they want to build a sport court/tennis court and we have submitted our Design Review Application. Commercial playground equipment is very expensive so the developer has opted to put in the sport court/tennis court which will cost the developer a lot of additional money. Requesting adoption of the Parks,Recreation and Trails Mission Statement and Values Ridgeway: I have a recommendation on the Mission Statement. I think the Mission Statement is really good. The second line under Eagle Parks and Recreation,just to standardize it, after embrace I would like you to consider adding "Eagle Residents" to match the line above it. Findings of Fact and Conclusions of Law for CU-01-14—Conditional Use Permit - Skyway Towers,LLC. Ridgeway I pulled this because I have a specific question for the attorney. In Butler's motion he recommended that we approve a cell phone tower 110' with 5' extra for decorative limbs, whatever they are, but under 0 the Findings of Facts it specifically says it is 95' and I'm wondering if that should be corrected to reflect what the motion was. Discussion. It is incorrect on the Agenda and I'm wondering if the Agenda should match Page 8 K:\COUNCIL\MINUTES\Temporary Minutes Work Area\CC-03-10-15spmtng.doc the actual motion. Planning and Zoning Administrator: we can make that change. Discussion. McFarland: I would request that we add some language to Page 17 and 18 on Item 3C to match our Code. It would say "additionally a 30' high pine tree would be required to be planted within proximity to the site to provide a tree appearance, not readily identifiable as a cell tower, additional landscaping is required and designed and proposed personal wireless facility height over 35' and the associated structures,fencing and landscaping will be required to be reviewed and approved by the Design Review Board." Partners, LLC, represented by Doug Russell with The Land Group, Inc., is requesting a rezone with development agreement from A (Agricultural — up to one (1) unit per 20-acres), A-R (Agricultural-Residential — up to one (1) unit per five (5) acres) and R-2-DA-P (Residential —up to two (2) units per acre with a Development Agreement — PUD) to MU-DA (Mixed Use with a Development Agreement in lieu of a PUD, including a height exception) and preliminary plat approval for Predico EP Subdivision a 4-lot (3 commercial, 1 residential [88 units]) subdivision. The 10.68-acre site is generally located on the northeast corner of North Ballantyne Lane and West State Street. (WEV) Mayor introduces the issue. Mayor: Does anyone on Council have any exparte contact to declare? Mayor: we have all had emails and the emails were sent to the Planning and Zoning Department. Ridgeway: I did have people stop me on the street and in church and told them that I could not comment. Mayor: Does anyone on Council have any potential or actual conflict of interest? Discusses the Staff recommendation that came before the Planning and Zoning Commission and the PZ recommendation. All we were really reviewing when staff reviewed this was a multifamily complex with three commercial units that is located within an area with a mixed use Comprehensive Plan designation. These four parcels were specifically identified within the comp plan. General discussion. Mayor opens the Public Hearing Mayor will reads all of the names on the Public Hearing signup sheets and whether they are Pro or Con and those that want to speak will have that opportunity. Deric Simmons, 2083 W. Tahoe Ridge St, I have two questions, if this development is so interested in complying with everything that is set forth then why can't they just make these two story units? If they can't make enough money doing that then I would ask why they would want the City Council to bail them out of a poor real estate speculation. Randy Bloom, 1851 W. Wood Valley St., I'm not concerned about what happened 15 years ago. This is Eagle today. We do prejudge and make our decisions. Discusses the density. General discussion. Patrick Courtright, 1648 Hereford Drive, I don't live in Countryside I live on Hereford Drive, Eagle looks different today than it did in 2000. The comp plan is just a plan, it's flexible and it needs to fit with the vision of Eagle. The height requirement is an issue. Would this be the second highest building in Eagle? Laura Borio, 328 N. Lost Canyon, I was at the PZ meeting and I want to speak to a couple of things that were discussed at that meeting. The parking was a concern. The commercial has parking spaces and I believe the units have one parking space. (Planner Williams discusses the parking requirements which are more than one parking space per unit.) Where are all of the other cars going to park? I'm not sure if there is enough parking on the residential side. There is a lot of concern about this project and I am miffed at the notion that our attitude is that "I've got mine and not in my backyard" as stated by the developer. I find this offensive.
