PUBLIC COMMENT: This time is reserved for the public to address their elected officials regarding concerns or comments they would like to provide to the City Council regarding subjects not on the agenda. At times, the City Council may seek comments/opinions regarding specific City matters during this allotted time. This is not the time slot to give formal testimony on a public hearing matter, or comment on a pending application or proposal. Out of courtesy for all who wish to speak, the City Council requests each speaker limit their comments to three (3) minutes. 6. CONSENT AGENDA:  Consent Agenda items are considered to be routine and are acted on with one motion. There will be no separate discussion on these items unless the Mayor, a Councilmember, member of City Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in a sequence determined by the City Council.  Any item on the Consent Agenda which contains written Conditions of Approval from the City of Eagle City Staff, Planning & Zoning Commission, or Design Review Board shall be adopted as part of the City Council’s Consent Agenda approval motion unless specifically stated otherwise. A. Claims Against the City. B. Re-appointments to the Parks and Pathways Development Commission: Mayor Reynolds is seeking the re-appointment of Lynn Moser and Scott Marshall to the Commission. They will be serving three (3) year terms. (JDR) C. Volunteer Recognition Week Proclamation: A proclamation of the City of Eagle declaring April 12-18, 2015 as National Volunteer Week in the City of Eagle. Fellow citizens are urged to volunteer to make a difference in the community in which they live. D. Arbor Day Proclamation: A Proclamation for the City of Eagle declaring April 24, 2015 as Arbor day in the City of Eagle. (MA) E. Appointment to the Historical Preservation Commission: Mayor Reynolds is requesting Council to confirm the appointment of Mike Culton. Mr. Culton’s term will expire in March 2020. (JDR) F. Maintenance Agreement between the City of Eagle and The Preserves’s Homeowners’s Association Inc.: A maintenance agreement for Lot 2 Block 1 within The Preserves Subdivision No.1 (well lot). (WEV) G. Findings of Fact and Conclusions of Law for RZ-06-14 & PP-08-14 - Predico EP Subdivision - Eagle M.F. Partners, LLC: Eagle M.F. Partners, LLC, represented by Doug Russell with The Land Group, Inc., is requesting a rezone with development agreement from A (Agricultural – up to one (1) unit per 20-acres), A-R (Agricultural-Residential – up to one (1) unit per five (5) acres) and R-2-DA-P (Residential – up to two (2) units per acre with a CITY COUNCIL AGENDA March 24, 2015 6:30 P.M. Page 2 of 3 cc-03-24-15ag Development Agreement – PUD) to MU-DA (Mixed Use with a Development Agreement in lieu of a PUD, including a height exception) and preliminary plat approval for Predico EP Subdivision a 4-lot (3 commercial, 1 residential [88 units]) subdivision. The 10.68-acre site is generally located on the northeast corner of North Ballantyne Lane and West State Street. (WEV) H. Minutes of March 10, 2015. I. Addendum to lease agreement between the City of Eagle and Aaron Mayovsky dba: AM Enterprises for the use of Heritage Park from May 1, 2015 through September 15, 2015. (MA) J. Addendum to lease agreement between the City of Eagle and Amy Phillips dba: Eagle Tropical Sno for the use of Guerber Park from May 1, 2015 through September 15, 2015. (MA) K. Addendum to lease agreement between the City of Eagle and Justin Andrews dba: Shaved Ice Barn for the use of Merill Park from May 1, 2015 through September 15, 2015. (MA) L. Findings of Fact and Conclusions of Law for AA-03-15/DR-30-05 MOD2 – Appeal of Laguna Pointe Subdivision Design Review Modification for placement of a barbed wire fence within Common Lot 35 – The City of Eagle: The City of Eagle, represented by William E. Vaughan, Eagle Zoning Administrator, is appealing the Design Review Board decision on this matter. Application Description: Laguna Pointe Homeowners Association, represented by Nicole Hancock with Stoel Rives, is requesting a modification to the subdivision’s design review approval to allow for the placement of a barbed wire fence (approximately 3,575-feet previously installed, approximately 800-feet to be installed) within Common Lot 35 along the south side of the pathway along the south side of the Boise River. The subdivision is located on the east side of South Eagle road approximately 800-feet north of East Colchester Drive. (WEV) M. An addendum to the contract for Summer Lawns to provide lawn care for the BMX portion of the Eagle Sports Complex. Funds for this were provided for under the 2014/15 Budget. (MA) N. Resolution 15-14: A resolution between the City of Eagle and Eagle Park BMX, Inc. A resolution approving an agreement between the City of Eagle and Eagle Park BMX, Inc. for use of 6.61 acres of the Ada-Eagle Sports Complex; authorizing the Mayor and City Clerk to respectively execute and attest said agreement; and providing an effective date.. (MA) O. Resolution 15-12: A resolution of the City of Eagle authorizing the destruction of temporary records. (SKB) P. Resolution 15-13: A resolution of the City of Eagle authorizing the destruction of transitory records. (SKB) Q. Parking Agreement/License Agreement between the City of Eagle and The Charter School Fund – Oro Valley, LLC (Tennis Club Plaza Subdivision).: The City of Eagle and the Tennis Club Plaza Subdivision, represented by John Rennison with Rennison Engineering, is requesting City Council approval of a parking agreement/license agreement for shared public parking located on the Tennis Club Plaza Subdivision site. The site is located on the East side of South Edgewood Lane approximately 625-feet south of State Highway 44. (WEV) 7. UNFINISHED BUSINESS: A. Discussion and possible action on recommendation to table the Eagle Road/State Street intersection study. (JK) B. PUBLIC HEARINGS: Public Hearings are legally noticed hearings required by state law. The public may provide formal testimony regarding the application or issue before the City Council. This testimony will become part of the hearing record for that application or matter. A. RZ-20-06 MOD2 – Bel Air Eagle – American Communities: American Communities, represented by Dave Yorgason with Tall Timber Consulting, is requesting a development agreement modification to allow for a multi-family development consisting of 14-buildings (13- multi-family buildings containing 300-dwelling units and one (1) club house) including a height exception to 45-feet for the multi-family buildings. The 22.17-acre site is generally located at the southwest corner of West Old Valley Road and North Linder Road. (WEV) 9. NEW BUSINESS: A. IFYWP 2016-2020 – Integrated Five Year Work Plan (Agency Requests): Staff and/or a representative of the Eagle Transportation Committee will present the Committee’s recommendation regarding the updated agency request list for the prioritization of transportation projects within the City of Eagle.
