EAGLE CITY COUNCIL MEETING
June 11,
1991
The Eagle City Council met in regular session on June 11, 1991.
Mayor GUERBER presiding.
The following members were present:
WALKER, RICK YZAGUIRRE, TOM MINOW.
STEVE HAMMONS, GARY
Moved by YZAGUIRRE and seconded by MINOW to approve the minutes
of the May 28, 1991 meeting as presented. ALL AYE: MOTION
CARRIED.
Moved by YZAGUIRRE and seconded by MINOW to delay the public
hearing on the LID until the City Engineer arrives. ALL AYE:
MOTION CARRIED.
PUBLIC HEARING/Island Woods: Developer, Dennis Baker, requested
a continuance of a public hearing until the City Council meeting
of July 23, 1991. Moved by MINOW and seconded by YZAGUIRRE to
continue the public hearing as requested, until July 23, 1991.
ALL AYE: MOTION CARRIED. Public hearing closed: 7:40 p,m,
EAGLE ALTERNATIVE ROUTE:
Mayor GUERBER gave an some background to this subject by making a
statement. On May 20, 1991, the Idaho Transportation Dept, made a
recommendation that the short west route be used for the
alternate route. They indicated that the decision was
contingent on a response back from the City of Eagle regarding
its decision on the route it supported. The City notified the
public that written comments would be accepted at City Hall and
that there would be a meeting regarding a decision, The
Transportation Dept. gave the City of Eagle 30 days to respond.
This issue will be discussed by Council tonight. Mayor GUERBER
described the routes and gave the public in attendance the
statistics of the letters and petitions received in this office.
They are as follows:

20, 1991 meeting forwarded to the City 44

4, short west route 9
5, long west route 277
Discussion took place and a motion was made by WALKER and
seconded by HAMMONS to not make a decision for ITD, send no
recommendation to them, AYE: WALKER. NAY: MINOW, HAMMONS,
YZAGUIRRE. MOTION FAILED.
Moved by HAMMONS and seconded by YZAGUIRRE to return a letter to
ITD giving them the information we have received from the
community and supporting the long route, as we have with the APA
2010 Transportation Study and continue to support as we have in
the past. AYE: MINOW, HAMMONS, YZAGUIRRE, NAY: WALKER,
MOTION CARRIED.
Mayor GUERBER will draft a letter for Council signatures,
PUBLIC HEARING/ Creation of a Local Improvement District:
Mayor GUERBER announced that this was the time and place set for
a public hearing on an LID to accomplish the redevelopment of the
downtown district.
Proposal: We have applied for a federal grant for the purpose
of a downtown redevelopment project. The application for the
grant can be for as much as $500,000, but the project costs
$730,000. In order to complete this project, even with matched
funds, it would be necessary to establish a LID. The project
includes landscaping, sidewalks, curb and gutter & street
lighting. The total LID would be $40,000. based on lineal feet
of commercial property, for a total of 2,432 ft. of improvements
at a cost of $14.59 per ft.
Public Testimony: written: Jerry Hetrick, Tri-City Meats
(opposed) to cost per foot per property, Sheri Sharp, (opposed)
cannot support the LID because of removal of storm drains, cost
of landscaping, sidewalk and curb work should extend further.
Rick and Sandy Smith (opposed) sidewalk appears to be unbalanced,
cost of trees, bypass uncertainty.

Moved by MINOW and seconded by HAMMONS to dispense with the 3
day ordinance ruling and consider Ordinance 188, an Ordinance
creating a local improvement district, providing improvements,
appointing an engineer, authorizing bid advertising for bids and
providing for payment of cost and expenses of improvements to be
assessed against the property with the district, and providing
for the issuance of local improvements district bonds and
warrants. ALL AYE: MOTION CARRIED.
Moved by MINOW and seconded by WALKER to adopt Ordinance 188 as
presented. ALL AYE: MOTION CARRIED,
CHRISTENSEN SUBDIVISION FINAL PLAT (IMPACT AREA):
Representative, Larry Sale of Briggs Engineering, advised the
Council that there had been substantial changes to the project
since prior Council approval, therefore, the Council needed to
review the new plat. The latest plat includes 9 lots, rather
than 10, and one culdesac through the project. The preliminary
plat included 2 culdesacs. The subdivision is located N. of
Beacon Light Rd, along Ballantyne Rd. Eagle City Council
approved the Ada County Transmittal on this subdivision earlier
in the year, but the Ada County Commissioners denied it,
Subsequently, the plat was changed to secure their approval,
Moved by YZAGUIRRE and seconded by WALKER to approve the final
plat as presented. ALL AYE: MOTION CARRIED,
MAYOR'S REPORT: The Mayor reported that Eagle Fun Days was a
success that they were still serving food at 11:00 p.m,
ATTORNEY'S REPORT: Mona reported that we will have a franchise
ordinance for the next meeting and suggested a letter be written
United Cablevision advising them of the change. We now have the
names for the property owners around Prime Earth, the public
hearing before Planning and Zoning will be July 15.
CLAIMS AGAINST THE CITY: Moved by YZAGUIRRE and seconded by
MINOW to approve the claims as presented. ALL AYE: MOTION
CARRIED.
There being no further business the meeting adjourned at 8:25
p.m.
